ORDINANCE NO. 1380
AN ORDINANCE OF THE CITY OF CLEARWATER,
FLORIDA, AMENDING ARTICLE I, IN GENERAL, OF
CHAPTER 19, STREETS AND SIDEWALKS, OF THE
CODE OF ORDINANCES OF THE CITY OF CLEARWATER,
FLORIDA, 1962, TO ENACT A NEW SECTION 19-17,
SETTING FORTH REQUIRED NOTICE OF PUBLIC HEARING
AND PROCEDURE TO CHANGE OR VACATE ANY STREET,
ALLEY, RIGHT OF WAY OR EASEMENT WITHIN THE CITY;
REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES
IN CONFLICT HEREWITH; PROVIDING FOR THE SEPAR-
ABILITY OF THE PROVISIONS HEREOF; PROVIDING
PENALTIES FOR THE VIOLATION HEREOF; AND
PROVIDING FOR THE EFFECTIVE DATE OF THIS

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Article I, In General, of Chapter 19, Streets and Sidewalks,
of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby
amended to enact a new Section 19.17 to read as follows:
Section 19-17 - Vacation of streets, alleys, rights of way
and easements.
The City Commission has the full and complete power to
change or vacate any street, alley, right of way or easement
within the City of Clearwater within the exercise of its sound
discretion. Such vacation or change shall be requested in
writing by the owner of the abutting real property or by any
department of the City presented to the City Engineer, together
with the payment of a filing fee to cover cost of processing the
request, which fee shall be set and established by resolution
passed by the city commission, together with letters of no
objection from such utility companies as may be affected. Under
no condition shall such sum, or any part thereof, be refunded
for failure of such change or vacation to be granted by the city
commission.
The City Engineer shall investigate the feasibility of the
requested change or vacation and report his findings to the
City Manager for transmittal to the city commission at its public
hearing on the request.
The notice of such change or vacation shall be given by the City
Clerk to the owners of all lands abutting the street, alley, right of
way or easement and for all intent and purpose such notice shall be
deemed sufficient if it has been published in a newspaper of general
circulation once each week for two consecutive weeks, stating in
substance that at a specified time, date not less than fourteen (14)
days.from date of first publication, and place, said City Commission
intends to consider the request to change or vacate such City street,
alley, right of way or easement, naming or describing it and
calling on all persons to show cause why the proposed action should
not be taken by said Comiission.

Section 2., All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed,

Section 3.' Should any part or provision of this ordinance be declared

by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part th

Section 4. Any person violating any provision of this ordinance
upon conviction thereof shall be subject to a fine not to exceed Five Hundred
Dpllars ($500. 00) or imprisonment for a period not to exceed sixty (60) days
or both, in the discretion of the Judge of the Municipal Court.
Section 5.' This ordinance shall become effective immediately upon
its passage.
