ORDINANCE NO. 1359
AN ORDINANCE OF THE CITY OF CLEARWATER,
FLORIDA, ANNEXING PORTIONS OF SECTION 9,
TOWNSHIP 29 SOUTH, RANGE 16 EAST, AND PART
OF LOT 1Z OF CLEARWATER INDUSTRIAL PARK,
PINELLAS COUNTY, FLORIDA, TOGETHER WITH
ALL ABUTTING STREETS, INTO THE CORPORATE
LIMITS OF THE CITY OF CLEARWATER, FLORIDA,
AND REDEFINING THE BOUNDARY LINES OF THE
CITY TO INCLUDE SAID ADDITIONS, ACCORDING TO
THE PROVISIONS OF THE CHARTER OF THE CITY OF
CLEARWATER, FLORIDA, AND THE LAWS OF FLORIDA;
AFTER PROPER PUBLIC NOTICE AND PUBLIC HEARING
THEREON, ESTABLISHING THE ZONING USE DISTRICT
CLASSIFICATIONS AND THE FIRE DISTRICT CLASSI-
FICATIONS FOR SAID PROPERTY; AND PROVIDING
FOR THE EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, the City Commission of the City of Clearwater, Florida,
received a sworn petition from Brown Homes, Inc, requesting the City to
annex a certain parcel of real estate hereinafter described, owned by it,
into the corporate limits of the City of Clearwater, Florida; and
WHEREAS, the City Commission of the City of Clearwater, Florida,
also received a sworn petition from Kapok Tree Inn, Inc. requesting the City to
annex a certain parcel of real estate hereinafter described, owned by it, into
the corporate limits of the City of Clearwater, Florida; and
WHEREAS, the City Commission after due consideration of said requests
for annexation, at a regular meeting held on November 1, 1971, voted unanimously
to accept said requests and authorized the proper officials to set up a public
hearing thereon for the determination and establishment of zoning and fire
district classifications and to prepare an ordinance to annex said parcels of
real estate into the corporate limits of the City of Clearwater in accordance with
the provisions of Section 6 (d) of the Municipal Charter of the City of Clearwater
and the Laws of Florida; and
WHEREAS, on December 6, 1971, the City Commission of the City of
Clearwater, after proper public notice, held a public hearing for the determinaticn
and establishment of zoning and fire district classifications for said real

property, which public hearing was continued until December 20, 1971,
and thereupon completed; and
WHEREAS, the City Commission of the City of Clearwater, Florida,
received a sworn petition from Upper Pinellas Association for Retarded
Children requesting the City to annex a certain parcel of real estate hereinafter
described, owned by it, into the corporate limits of the City of Clearwater,
Florida; and
WHEREAS, the City Commission after due consideration of said request
for annexation, at a regular meeting held on November 15, 1971, voted
unanimously to accept said request and authrized the proper officials to set up
a public hearing thereon for the determination and establishment of zoning and
fire district classifications and to prepare an ordinance to annex said parcel
of real estate into the corporate limits of the City of Clearwater in accordance
with the provisions of Section b (d) of the Municipal Charter of the City of
Clearwater and the Laws of Florida; and
WHEREAS, on December. ZO, 1971, the City Commission of the City
of Clearwater, after proper public notice, held a public hearing for the
determination and establishment of zoning and fire district classifications for
said real property;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. After its evaluation of all evidence presented at a proper public
hearing, the City of Clearwater, acting by and through its City Commission,
by the authority and under the provisions of Section b (d) of the Municipal Charter
of said City of Clearwater and the Laws of Florida, hereby annexes into the
corporate limits of the City of Clearwater, Florida, and redefines the boundary
lines of said City so as to include the following described parcels of real property
in Pinellas County, Florida, and establishes zoning and fire district
classifications therefor:

Section 2. The City Commission hereby formally and according to law
accepts the dedication of all easements, streets, parks, plazas, places, rights
of way and other dedications to thepublic which have heretofore been made by
plat, deed or user within the areas so annexed.
Section 3. The City Engineer, the City Clerk and the Planning Director
are directed to include and set out and shover upon the official zoning map and
other official maps and records of the City of Clearwater the foregoing property
and the zoning and fire district classifications therefor.
Section 4. This ordinance shall become effective immediately upon,
its passage and enrollment in the City of Clearwater Ordinance Book and a
certified copy thereof being recorded in the Office of the Clerk of the Circuit
Court of Pinellas County, Florida.

WHEREAS, the City Commission of the City of Clearwater, Florida,
received a sworn petition from Brown Homes, Inc.. requesting the City to.
annex a certain parcel of real estate hereinafter described, owned by it,
into the corporate limits of the City of Clearwater, Florida; and
WHEREAS, the City Commission of the City of Clearwater, Florida,
also received a sworn petition from Kapok Tree Inn, Inc. requesting the City to
annex: a certain parcel of real estate hereinafter described, owned by it, into
the corporate limits of the City of Clearwater, Florida; and
WHEREAS, the City Commission after due consideration of said requests
for annexation, at a regular meeting held on November 1, 1971, voted unanimously
to accept said requests and authorized the proper officials to. set up a public •
hearing thereon for the determination and establishment of zoning and fire
district classifications and to prepare an ordinance to-annex sand parcels of
real estate into the corporate limits of the City of Clearwater in accordance with
the provisions of Section 6 (d) of the-Municipal Charter of the City of Clearwater

and thereupon completed; and
WHEREAS, the City Commission of the City of Clearwater, Florida,
received a sworn petition from Upper Pinellas Association for Retarded
Children requesting the City to annex a certain parcel of real estate hereinafter
described, owned by it, into the corporate limits of the City of Clearwater,
Florida; and
. WHEREAS, the City Commission after due consideration of said request
for annexation, at a regular meeting held on November 15, 1971, voted
unanimously to accept said request and authrized the proper officials to set up
a public hearing thereon for the determination and establishment of zoning and
fire district classifications and to•prepare an ordinance to annex said parcel
of real estate into the corporate limits of the City of Clearwater in accordance
with the provisions of Section 6 (d). of the Municipal Charter of the City of
Clearwater and the Laws of Florida; and
WHEREAS, on December 20, 1971, the City Commission of the City
of Clearwater, after proper public notice, held a public hearing for the
determination and establishment of zoning and fire district classifications for
said real property;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1, After its evaluation of all evidence presented at a proper public
hearing, the City of Clearwater, acting by and through its City Coimission,
by the authority and under the provisions of Section 6 (d) of the Municipal Charter
• of said City of Clearwater and the Laws of Florida, hereby annexes into the I
corporate limits of the City of Clearwater, Florida, and redefines the boundary
lines of said City so as to include the following described parcels of real property
in Pinellas County, Florida, and estlablishes zoning and fire district
