1356 0 •rCj i ORDINANCE NO. 1356 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, ENACTING A FIAR HOUSING ORDINANCE TO PROMOTE EQUAL HOUSING OPPORTUNITY AND TO DISCOURAGE AND ELIMINATE DISCRIMINATORY PRACTICES BY TIMELY PROCESSING OF COMPLAINTS, BY CONCILIATION AND MEDIATION AND BY PUBLIC HEARINGS; AUTHORIZING THE COMMUNITY RELATIONS BOARD TO ADMINISTER THIS ORDINANCE; PROVIDING A PENALTY FOR FAILURE TO COMPLY HEREWITH; PROVIDING FOR REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF AND PRO- VIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Declaration of Policy. It is hereby declared to be the policy of the City of Clearwater, Florida, to foster the public health, public safety and general welfare, by promoting equal opportunity for all persons, regardless of race, color, creed, national origin or ancestry in obtaining adequate housing, and to that end to eliminate discrimination in housing. Section 2. Objectives. The objective of this ordinance is to provide a positive means to implement the policy stated above by promoting equal housing opportunity and to discourage and eliminate discriminatory practices by timely processing of complaints, by conciliation and mediation, and by public hearings. Section 2A. Rights of the Seller, Lessor, Pro ert Owner or His Authorized Agent. Nothing contained in this ordinance shall preclude the Seller, Lessor, Property Owner or his Authorized Agent from setting forth reasonable rules, regulations, terms and conditions pertaining to the sale or lease or disposal of his or her property provided such rules, regulations, terms and conditions are not based on race, color, religion or national origin. Section 3. Definitions. (1) "Board" - The Community Relations Board of the City of Clearwater, Florida. I`, { vas ST . - . 3 t• M f ' 12) "Housing" - any building, facility or structure, or portion thereof,' which is used or occupied or is intended, ar'r'anged or designed to be used or occupied as the home, residence or sleeping place of one or more individuals,' groups or families and any vacant land offered for sale or lease for the construction or location thereon of such building, facility or structure. (3) '1Familylf - a group living together ar. a unit and include an individual. (4) "Lending Institution" - any bank, insurance company, savings and loan association or any other person or organization regularly engaged in the business of lending money or guaranteeing loans. (5) "Person" - includes one or more individuals, corporations, partnerships, associations, labor organizations, legal representatives, mutual companies, joint stock companies, trusts, unincorporated organi- zations, trustees, trustees in bankruptcy, receivers, and fiduciaries. 46) "Real Estate Broker" - any person duly licensed as a real estate broker in accordance with the laws of the State of Florida. (7) "Real Estate Salesman" - any person duly licensed as a real estate salesman in accordance with the laws of the State of Florida. (8) "To rent" - includes to lease, to sublease, to let and otherwise grant for a consideration the right to occupy premises not owned by the occupant. Section 4. Discriminatory Hauling Practices. Except as provided in Section 7 hereof, it shall be a discriminatory housing practice: (a) to refuse to sell or rent after the making of a bona fide offer, or to refuse to negotiate for the sale or rental of, or otherwise make unavailable or deny, a dwelling to any person because of race, color, religion or national origin. (b) to discriminate against any person in the terms, conditions, or privileges of sale or rental of a dwelling, or in the provisions of services or facilities in connection therewith, because of race, color, religion, or national origin. Section 6. Discrimination in the Provision of Brokerage Services. Section 7. Exceptions. Nothing in Sections 4, 5 and 6 shall apply to: (a) a religious organization, association or society, or any nonprofit institution or organization operated, supervised or controlled by or in con- Junction with a religious organization, association, or society, from limiting the sale, rental or occupancy of dwellings which it owns or operates for other than a commercial purpose to persons of the same religion, or from giving preference to such persons, unless membership in such religion is restricted on account of race, color, or national origin. (b) rooms or units in dwellings containing living quarters occupied or intended to be occupied by no more than four families living independently of each other, if the owner actually maintains and occupies one of such living quarters as his residence. Section 8. Community Relations Board. The Community Relations Board, as previously established, shall be the enforcing Board for this ordinance. They shall have the assistance of the Community Relations Coordinator and the office of the City Attorney as required. Section 9. Filing of Complaints. Any person subjected to a discriminatory act or practice in contravention of this ordinance may file with the Board a complaint in writing, sworn to or affirmed, which shall state the name and address of the complainant and the person or persons against whom complaint is made. It (shall also state the alleged facts surrounding the alleged com- mission of an unfair housing practice and such other information as the Board may require. The Board, upon recommendation of a majority of its members, may initiate a complaint in accord with the provisions set forth above. Every complaint shall be held in confidence by the Board unless and until the complainant and the person complained against consent to its being made public or a hearing such as is described in Section 10 hereunder is begun. (c) If the Board determines that the complaint lacks reasonable grounds upon which to base a violation of this ordinance, the Board may in its discretion recommend that the matter be closed or order such further investigation as =x may be necessary. (d)- If the Board, with respect to a matter which involves a contravention , of this ordinance, (ij fails to conciliate a complaint after the parties have, _ q. in good faith, attempted such conciliation, or (ii) fails to effect an informal conciliation agreement or a formal consent: agreement, or (iii) determines that a complaint is not susceptible of conciliation, the Board shall thereafter LA j schedule a public hearing to determine the facts. The Board shall serve upon all interested parties a notice of the time and place of the hearing. The respondent or his authorized counsel may file such statements with the Board prior to the hearing date as it deems necessary in support of its position. -7- Ord.01366 1777: 77- 1 11-4 i 40 4@ a W present testimony and evidence, and the right to cross-examine witnesses shall be preserved. All testimony and evidence shall be given under oath or by affirmation. The Board shall not be bound by strict rules of evidence prevailing in courts of law or equity. The Board shall keep a full record of the hearing, which records shall be public and open to inspection by any person, and upon request by any principal party to the proceedings the Board shall furnish such party a copy of the hearing record, if any, at such cost as the Board deems appropriate. The Board shall make a finding of fact. (e) The purpose and effect of the procedure before the Board and of its findings is to obtain (a)- the resolution of differences and postures not consistent with the law of the land, and (b) where conciliation has failed to resolve the discriminatory postures, to clarify the issues and to assist an aggrieved person to formulate his case, if he elects to seek remedies afforded by the laws of the land, particularly, but not limited to the United States Civil Rights Act of 1968. However, if in the opinion of the Community Relations Board, such action is warranted, the matter shall be turned over to the City Prosecutor for further investigation with a view towards filing charges against the offending party in the municipal court of the City of Clearwater. Nothing herein shall prevent any person from exercising any right or seeking any remedy to which he might otherwise be entitled or from filing of any complaint with any other agency or any court having proper jurisdiction. -8- Id. #1356.' Any person who shall violate the provisions of this ordinance shall be subject, upon conviction in the Municipal Court, to a fine up to but not exceeding the sum of Five Hundred Dollars,($500.00), or imprisonment in the City Jail for not exceeding sixty (60) days, or by both such fine and imprison- ment in the discretion of the Municipal Judge. Section 12. All ordinances or parts of ordinances in conflict herewith to the extent of such conflict are hereby repealed. Section 13. If any provision of this ordinance or the application thereof to any person or circumstances is held invalid, the remainder of the ordinance and the application of the provision to other persons not similarly situated or to other circumstances shall not be affected thereby. Section 14. This ordinance shall become effective immediately upon its passage.
