I: ORDINANCE NO. 1348 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, MAKING IT UNLAWFUL FOR ANY PLACE OF PUBLIC ACCOMMODATION OR PUBLIC RECREATIONAL FACILITY TO REFUSE, WITHHOLD FROM OR DENY TO ANY PERSON, FOR ANY REASON DIRECTLY OR IN- DIRECTLY RELATING TO THE RACE, COLOR, RELIGION OR NATIONAL ORIGIN OF SUCH PERSON, ANY OF THE ACCOMMODATIONS, ADVANTAGES, FACILITIES OR SERVICES OF SUCH PUBLIC ACCOMMODATION OR PUBLIC RECREATIONAL FACILITY; SETTING FORrM CERTAIN EXCEPTIONS; DEFINING A PLACE OF PUBLIC ACCOMMODATION AND A PUBLIC RECREATONAL FACILITY; PROVIDING A PROCEDURE FOR ANY AGGRIEVED PARTY TO FILE A COMPLAINT AND THE PROCEDURE TO HAVE SAID COMPLAINT INVESTIGATED BY THE COMMUNITY RELATIONS BOARD OF THE CITY OF CLEARWATER; PROVIDING FOR A PROCEDURE FOR CONCILIATION OF SAID MATTER BY THE COMMUNITY RELATIONS COORDI- NATOR OF THE CITY OF CLEARWATER ; PROVIDING FOR ADDITIONAL PROCEDURE TO BE FOLLOWED BY AND ON BEHALF OF THE COMPLAINING PARTY IN SAID MATTER; PROVIDING A PENALTY FOR FAILURE TO COI4IPLY HERE- WITH; PROVIDING FOR REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF AND PROVIDING FOR THE EFFECTIVE DATE OF 'THIS ORDINANCE. WHEREAS, Title II of Public Law 88-352, Civil Rights Act of 1964, provides that all persons shall be entitled to the full and equal enjoyment of the goods, services, facilities, privileges, advantages and accommodations of any place of public accommodation without discrimination or segregation on the ground of race, color, religion or national origin; and WHEREAS, the Constitution of the State of Florida in Section 2 of Article I thereof states that no person shall be deprived of any right because of race or religion; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. ';•y ?;?57' 4 ? , a ,w ty e? •tt ?, or indirectly relating to race, color, religion or national origin of such person, any of the accommodations, advantages, facilities or services of such public accommodation or public recreational facility; provided, how- ever, service may be refused to any person or persons if the said person requesting service has his normal faculties impaired to the point of inebriation or if the person requesting the service is disturbing the peace and tranquillity of the establishment. Section 2. A place of public accommodation and a public recrea- tional facility, within the meaning, intent and purpose of this ordinance, shall be deemed to include inns, lounges, taverns, road houses, hotels, apartment hotels, whether conducted for the entertainment of transient guests or for the accommodation of those seeking health, recreation or rest, and restaurants, or eating houses, or any place where food is sold for consumption on the premises; buffets, saloons, bar-rooms, lounges or any store, park or enclosure where spirituous or malt liquors are sold; or where beverages of any kind are retailed for consumption on the premises; any-motion picture house, theater, concert hall, sports arena, stadium, golf course or other place of exhibition, entertainment or public recreation. Section 3. Any person claiming to be aggrieved by a discriminatory practice prohibited by this ordinance may make, sign and file with the Community Relations Board of the City of Clearwater a complaint in writing under oath which shall state the name and address of the public accommodation or public recreational facility alleged to have committed the discriminatory practice and-which shall set forth the particulars thereof and contain such other information as may be required. Such complaints shall be filed within thirty (30) days after the alleged discriminatory practice is committed. At the conclusion of its investigation the Community Relations Board shall make a written determination as to whether there has been a violation of this ordinance and the complaining party's rights and whether the charges are well founded. If the Community Relations Board determines that there has been a violation of this ordinance and of the complaining party's rights, a written report shall be forwarded to the Community Relations Coordinator of the City of Clearwater. The coordinator shall then have a thirty (30) day conciliation period during which he shall attempt to work out an amicable solution to the problem between the parties inYOlved. If the coordinator is unsuccessful in resolving the problem, then he shall forward a copy of the file of the case to the complaining party who may then file a civil action on his behalf in the appropriate court. However, if in the opinion of the Community Relations Coordinator, such action is warranted, the matter shall be turned over to the City Prosecutor for further investigation with a view towards filing charges against the offending party in the municipal court of the City of Clearwater. Section 4. Any person who shall violate the provisions of this ordinal ce shall be subject, upon conviction in the municipal court, to a fine not exceeding the sum of Five Hundred Dollars ($500.00), or imprisonment in the City Jail for not exceeding sixty (60) days, or by both such fine and imprisonment in the discretion of the Municipal Judge. Section 5. All ordinances or parts of ordinances in conflict herewith to the extent of such conflict are hereby repealed. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof, other than the part declared to be invalid.
