Plumbing Code--Adopted. ri,,>YE?'?df,' There' is hereby adopted by the City of Clearwater, Florida, that certain code known as the Southern Standard Plumbing Code 1971 Edition, together with Appendix A and B of said 1971 Edition, as adopted by the Southern Building Code Congress, and the whole thereof' save and except'such portions as are hereinafter deleted, modified or amended by Section 3 of this ordinance, of which code three (3) copies thereof are now and have been for the last preceding ten (10) days on file in the office of the City Clerk of the City of Clearwater, and the same are hereby adopted and incorporated by reference as fully as if set out at length herein as authorized by Chapter 165. 191, Florida Statutes, and from the effective date `. " of this ordinance shall take effect, the provisions thereof shall be controlling within the limits of the City of Clearwater, Florida. Section 3. There is hereby enacted a new Section 7-88, Plumbing Code--Amendments, of Article VI, Plumbing, of Chapter 7, Buildings, of the Code of. Ordinances, City of Clearwater, Florida, 1962, to read as follows: _ r Sec. 7-88. Plumbing Code--Amendments. k i} The Southern Standard Plumbing Code, 1971 Edition, together with w, Appendix A and B of said 1971 Edition, as adopted by the Southern ?t f Building Code Congress, is amended and changed in the following respects: 1 t-. JA) Section 102. 1, Plumbing Official, is amended to read: The City Manager shall employ and appoint a plun•o.ing inspector ?19 f and such assistant plumbing inspectors as are necessary. Said 1% inspector and assistant inspectors shall be experienced plumbers f? of at least ten (10) years practical experience; said inspector shall hold or have held a Master Plumber's Certificate or license, and said assistants shall hold or have held a Journeyman w ., Plumber's Certificate or a Master Plumbers Certificate. ?{ (B) Delete Section 103, Powers and Duties of Plumbing Official, and enact the following: V .q (a)Plumbing Inspector. When the words "Plumbing Inspector" are used, it means any person charged with the enforcement r r of the provisions of this Code. (b) Control and Supervision. The Plumbing Inspector shall; have control and supervision of the methods and materials used in any part of the building plumbing or drainage system. .i (c)Duties. The duties of a Plumbing Inspector shall be: 1. The examination and approval of plans and specifications. 2. The issuance of permits. 3. The collection of fees. 4. The inspection of building plumbing, drainage and sanitation. 5. The conduct of tests. 6. The issuance of certificates of inspection and approval. 7. The arrest and prosecution of offenders., 8. The inspector shall not be directly or f1' i indirectly engaged in any way with any firm or corporation engaged in the business of contracting'or installing plumbing within the corporate limits of the City of Clearwater. (e)Authority to Enter Buildings. The Plumbing Inspector is empowered and authorized to enter into or upon any public or private building or premises within, the City of Clearwater for the purpose of examining, inspecting or testing the plumbing, drainage, sewerage or ventilation within such building or premises. (f) Investigation of Complaints. The Plumbing Inspector l shall examine all premises, about which a complaint of the plumbing or drainage is made, and he shall, upon . ` evidence of the unsanitary or unfinished condition ?3E'-rJ • •?in?i'4?.:1.l.?rtie?1'.vtiGT'?tM thereof, condemn same and notify owner or agent of ?.;:' ?? tr• -? such premises to arrange the plumbing or drainage thereof according to the requirements of this Code. ` . Such notice shall be in writing. Any person or ' persons failing to place the plumbing of such :.! premises or buildings in a proper and sanitary condition, as instructed by the Plumbing Inspector within the time fixed bk the Plumbing Inspector shall be subject to prosecution. S ? (g) Working Drawings. The applicant for apermit shall file Jt all plans and specifications and any other information r? required by this Code or by the Plumbing Inspector. + Such plans shall state the name and address of the owner, agent, master plumber, or journeyman plumber, the builder, contractor and architect, and the location of the work. Permission shall be obtained from the Plumbing Inspector before any change or alteration is made from approved - plans or specifications, (b)Approval of Plans. The Plumbing Inspector shall examine all plans and specifications.filed in his office for his approval. He shall also issue and sign all notices, certificates, plumbing and sewer permits. (i) Placard. ' r ., , im 1 Occupancy of Placarded Building Prohibited. Such placards or placard shall remain on said building until the required repairs or improvements are made. The owner or agent of such building so placarded shall be responsible for the maintaining of such placards or placard until removal by the Plumbing Inspector, and it shall be unlawful for any person to reside in or occupy such building for any purpose or to let, rent, or hire the same or any part thereof, or to collect,' receive or to pay any rental therefor, whether as owner, agent, tenant or otherwise, while so condemned. _(k)Records of Office. The Plumbing Inspector shall keep a record of all inspections made, or complaints received and investigated, plans and specifications examined, notices served, permits issued, fees collected, applicants for certificates and all other services performed by this department. (1) The City Manager is hereby authorized and directed to enforce all of the provisions of this Code through the City Plumbing Inspector. (C) Section 105, Permits, is amended by adding Paragraph 105. 3 to read as follows: (a)-Permits Required. No person or persons shall excavate or obstruct any public or private street, alley or thoroughfare, for the purpose of installing plumbing, sewer or drainage work or connect to any private or public sewer or appurtenance thereof, commence the construction, re-construction, alteration or repair of any plumbing, sewer or drainage work or system of excavation, construction, cleaning or repair of any septic tank without first obtaining a permit to do so from the Plumbing Inspector, providing that no permit will be necessary for the repair of leaks, unstopping of sewers or waste pipes, or replacing of broken fixtures, provided further that all work shall be done under the direction of a Master Plumber. All such permits shall be subject to the provisions of this Code. After obtaining the permit from the Plumbing Inspector, a permit for "Work in Street Right of Way" must be applied for and obtained from the City Engineering Department. (b)-To Secure Permit. Permits for all excavation work for plumbing, on or in public streets or thoroughfares, and all sewer, drain, soil, waste or vent work shall be issued only to a person having in his possession a Master Plumberls certificate issued by the Board of Plumbing Examiners for the City of Clearwater, State of Florida, and an occupational license, as required by the City of Clearwater, State of Florida, and no person shall do or manage or have charge of any work hereinbefore mentioned without being in possession of said certificate, license and bond. -4- 4 ,. 0rd.01346 1 , r i apa? ;,;;.,7771,.,'•yA,,rV».:;;F,,',?"s:f '.s^: •.,. -.kt . The Plumbing Inspector shall charge and collect . ; .. °?€,•";°,,:•??? ?, for plumbing permits at the following rates to wit: 1. $1.50 for each plumbing installation permit issued' •S .. for each building and $1. 50 for each fixture, up to and including the first 8 fixtures and $ 1. 00 for each fixture thereafter. $5.00 for each lawn sprinkler system, irrigation system installation permit issued for each building. Septic tanks, floor drains, garbage disposals, dishwashers and i water heaters and replacement of same shall be charged f ; Y ':::'? S •.., r?' -r.. fi Y?'.: Building sewer permit shall be $2.00 for the first 100 feet and each additional 100 feet or portion thereof 2. For the purpose of this code the words "roughed c-, f t in for" shall mean any opening placed in a plumbing system for the purpose of receiving the discharge yF° from a plumbing fixture. 3. No fee shall be charged in case of removal of stoppage, repair of leaks, repairs or replacing broken fixtures, but the Plumbing Inspector must be notified and all jobs inspected and approval secured wherever any soil, waste, vent or sewer is changed for any purpose whatsoever. 4. A fee of $2. 00 shall be charged by the Plumbing Inspector for each re-inspection made due to the work being condemned or not being ready at the time specified in the application for inspection. 5. Plumbing inspection shall be made within a reasonable time after the Inspector is notified that the job is ready for inspection. (E) Section 109, Licensing and Bonding of Plumbers, is amended to read as follows: (a)Section 109. 1. General. 1. No permit shall be issued to any person, firm or corpora- tion to do, or cause to be done any construction or work regulated by this Code except to a person, firm or corporation holding a valid, unexpired and unrevoked Master Plumber's License as required by this Code, except when and as otherwise hereinafter provided in this Section. 2. arl% , r ? ?I FS !•T.L i.Y `, 45 ?!??,'?y?nN?w .?+[: ..^•St: '•3. Any permit required by this Code may be issued to any person to do construction or work regulated by this Code in a single family dwelling used exclusively for living purposes, including the usual accessory buildings and quarters in connection with such buildings in the event that any such person is the bona fide owner of any such dwelling and accessory buildings and quarters and that the same are occupied by or designed to be occupied by said owner, provided that said owner shall personally purchase all nuterial, shall personally perform all labor ix connection therewith and shall conform to all requirements-of this chapter, and in such installation ,;the word "owner" shad be substituted for the word "plumber". ?wrwr•?w.?+?n}}+• :Ct•Z.frv+r?w???r'? ???'a tS . When evidence is produced to the effect that the applicant is a graduate, or is attending a recognized trade school, proper credit will be given the applicant, but not to exceed one year of the required five years of practical experience as an apprentice. In the event the applicant is unable to comply with any of the above requirements, he may, upon written request, appear before a quorum of the City Plumbing Examining Board to present evidence as to his eligibility for examination. a fsOrd;, 1346-.,', 2. Requirements of Applicants for Journeyman and Master Plumber's Examination. Application for examination for a Journeymants Certificate of Competency, or for examination for a Master Plumber's Certificate of Competency, shall be made with proper application blank which shall be furnished by the City Plumbing Examining Board. The application for examination shall be made to the City Plumbing Examining Board at the City Plumbing Inspector's Office, and must be accompanied with the fee of $ 10. 00 for each Journeyman Plumberts examination and $25. 00 for each Master Plumber's examination. 3. Qualifications of Applicants for a Journeyman Plumber's Examination. To qualify for examination for a Journeyman Plumber's Certificate of Competency, the applicant must furnish, either on or with his application, a notarized state- ment from his present or former employers to the effect that he has had at least five years experience as an Apprentice in the practical installation of plumbing under the supervision of a Master Plumber. 4. Qualifications of Applicants for a Master Plumber's Examination. To qualify for examination for a Master Plumber's Certificate of Competency, the applicant must submit evidence satisfactory to the Plumbing Examining Board that he has had at least five years experience as a licensed Journeyman Plumber immediately preceding the date of his application. In the event the applicant is unable to comply with any of the above requirements as a licensed Journeyman Plumber, he shall be required to present evidence satisfactory to the Plumbing Examining Board that he has been actively engaged as an established Master Plumber for at least five years immediately preceding the date of his application in a state, city, village or township not under the jurisdiction of the City Plumbing Examining Board. ,? ?! No plumbing or drainage work for which a permit is required shall be commenced in any building or premises until a permit to do such work shall first have been obtained. (b)Section 109.2. Qualification of Plumbers. 1. Qualifications (General). Any person 19 years of age, or over, who possesses the necessary qualifications and can read and write English, may apply for examination for a Journeyman Plumberts Certificate of Competency. Any person 21 years of age, or over, who possesses the necessary qualifications and can read and write English, may apply for examination for a Master Plumber's Certificate of Competency. 38? •+"'i der w ;` .Jn,,=if`i I r` { M? := IM .? W r • In all cases the applicant must furnish at least three references by persons personally acquainted with him for not less than five years and a current financial statement showing financial responsibility. In the event the applicant is unable to comply with any of the above requirements, he may, upon written request, appear before a quorum of the City Plumbing Examining Board to present evidence as to his eligibility for examination. 5. Certification--Certificate Required. It shall be mandatory that all persons doing plumbing work in the City shall have in their possession an unexpired certificate of competency, issued by the Board of Plumbing 'Examiners of the City, or as otherwise provided, by the Plumbing Inspector, as herein provided, as a recognition of their having passed a plumbing examination before such Board of Plumbing Examiners, or having qualified for such certificate as otherwise provided in this division. 6. Certification--Definition, Issuing. a. A certificate of competency is defined as a certified written or printed recognition of the qualifications and plumber's rating of an applicant who has passed a plumbing examination before the Board of Plumbing Examiners, or who has received such certificate as otherwise provided herein. b. It shall set forth the name and address of the owners, together with the date of issuance, and date of expiration, and shall be signed by the secretary of the Board of Plumbing Examiners or by the Plumbing Inspector of the City. c. The word "certificate" as used within this article shall mean certificate of competency. d. The Board of Plumbing Examiners shall issue certificates to all applicants who have passed plumbing examinations before said Board. ,.. Ord: #13+6 e. The Plumbing Inspector of the City shall have issued master plumber certificates of competency to all plumbing contractors established in business in the City prior to the effective date of this ordinance, and holding an occupational license on said date, as such, without examination, providing application for such a certificate was made within sixty days from said effective date. If application was not made within said sixty day period, an examination will be required prior to issuance of certificate as herein provided. f. The Plumbing Inspector shall have issued journeyman plumber certificates of competency to all plumbers who were employed in the City of Clearwater as journeyman plumbers prior to the effective date of this ordinance and who possessed the necessary qualifications of a journeyman plumber, pro- viding application for such a certificate was made within sixty days from said effective date. Certification--Renewal Procedure. a. All certificates issued by the Board of Plumbing Examiners shall expire on the last day of September of each year, unless sooner revoked. b. Every master, journeyman or maintenance plumber holding a certificate of competency may, during the month of September of each year, make application, either by mail or in person, at the office of the chief plumbing inspector for renewal of such certificate for an additional year. c. Each plumbing contractor must exhibit a certificate of competency of master plumber at the time of application for an occupational license as such plumbing contractor. d. It shall be unlawful for any journeyman plumber who has failed to make application for renewal of a certificate by September thirtieth of any year, to do any plumbing work in said City without passing another examination and paying the full fee as herein provided. 8. Certification--Renewal Fees. a. The fee for renewal of a master plumberss certificate shall be Ten Dollars ($10. 00). b. The fee for renewal of a journeyman or maintenance plumber's certificate shall be Five Dollars ($5. 00). 9. Requirements for Certificate by Firm or Corporation. Any firm or corporation now or hereafter engaged in or working in the business of plumbing, or placing or installing any plumbing fixtures or material within the City of Clearwater, shall have at least one responsible officer or partner of the firm who has complied with all the requirements for a Master Plumber, but has no interest in any other firm or corporation doing plumbing in the City of Clearwater. Such responsible officer or partner shall be actively engaged in supervising the plumbing work of said corporation or firm in the City of Clearwater. No person shall allow his license to be used by any person or party, firm or corporation, directly or indirectly, either for the purpose of obtaining apermit or to do any work under his license in violation of the terms of this code. .(c)Add new Section 109.7. Creation of Board of Plumbing Examiners. 1. In compliance with Chapter 469, Florida Statutes, there is hereby created a Board of Plumbing Examiners which shall have three (3) Master Plumbers and two (Z) Journey- man Plumbers. All members shall be appointed by the City Manager and shall serve for a term of one (1) year or until their successors are appointed and qualified unless otherwise provided. -8" f Qrd.#1.346 f .? The Plumbing Inspector shall serve ex-officio. He shall attend all meetings and serve as secretary. Said Board of Plumbing Examiners shall have the power to make and adopt such by-laws, rules and regulations governing it as it may deem necessary, providing the same do not conflict with the laws of the City of Clearwater and the State of Florida. .3 3. The Board of Plumbing Examiners is hereby authorized to accept, in lieu of written examination, an affidavit, a'. for the purpose of reciprocity, from the Chief Plumbing Inspector of any municipality or jurisdiction therein in ; the State of Florida, stating that the Journeyman Plumber or Master Plumber has satisfactorily completed a written examination in his jurisdiction comparable in scope and content with the examination given by the Board of Plumbing 7 g Examiners in the City of Clearwater. Said affidavit shall ? s ?` # designate the restrictions set forth in the certificate of the " applicant and other pertinent facts concerning applicant's =.;,?h ; r:,• business activities, provided, however, that the Board of ?i, Plumbing Examiners is authorized to accept said affidavit n in lieu of written examination only when a similar cooperative, j reciprocal agreement is in effect in the particular juris- diction from which the applicant is seeking reciprocity. Applicant shall make an application of the standard application ; form provided by the Board of Examiners of the City of = } Clearwater which shall contain such information as the Board deems necessary to prove the competency of the applicant. The application fee shall be the same as if applying for an examination and shall accompany the application. 4. The Plumbing Inspector shall keep a record of all pro- ceedings of the Board of Plumbing Examiners, together ? with the necessary application of applicants and certifi- catee, showing all pertinent information. Upon receipt - of an application for examination said Board of Plumbing Examiners shall cause such applicants to be notified in writing of the date and place where the examination will be held. Each applicant shall be examined by said Board of ` R. Examiners by isometric drawings, written and practical ' tests as to his knowledge of plumbing, house drainage and plumbing ventilation. The passing grade of any examination is 751a which shall be weighted as follows: one-third (1/3) written, one-third (1/3) isometric drawings and one-third (1/3) practical. Every person passing the examination shall s . be issued either a Master Plumber's certificate or a Journey- man Plumber's certificate depending upon the examination .' applied for and passed. Any person taking an examination and ` failing may not make application for re-examination until the expiration of three (3) months. Any person examined and having :. been advised that he has failed on the examination may appeal from the Board of Examiners to the City Commission, provided, . .44 however, such appeal shall be taken to the City Commission ,€'• within fifteen (15) days after having been notified in writing of w !: such failure. The Board shall obtain advice and approval of Director of Building prior to permitting the use or installation of any new materials or methods. (e)Add new Section 109. 9, Saving Clause. All Master Plumbers and Journeyman Plumbers who are now engaged in the City of Clearwater as such, and are legally qualified and currently licensed so to do shall not be required to take the examination hereinabove referred to. (F) Section 111, Violations and Penalties, is hereby repealed and the following enacted in lieu thereof: Any person, organization, society, association or corporation, or any agent or representative thereof who shall violate any provisions of this Ordinance or the Code hereby adopted or fail to comply therewith, or who shall violate or fail to comply with any order made thereunder, or who shall build in violation of any detailed statement of specifications or plans submitted and Approved thereunder, shall, upon conviction in the Municipal Court, be fined not exceeding the sum of Five Hundred Dollars ($500.00), or imprisoned in the City Jail for not exceeding sixty (60) days, or by both fine and imprisonment in the discretion of the Municipal Judge. Any violation of the provisions of this Ordinance or the Code hereby adopted may also be grounds for the City of Clearwater to suspend or revoke the offending party's contractor's or sub- contractor's license issued by the City of Clearwater. Each day's continuance of any violation of any provisions of this Ordinance or the Code hereby adopted shall constitute a separate offense. The imposition of one penalty for any violation shall not excuse the violation or permit it to continue; and all such persons shall be required to correct or remedy such violations or defects within a reasonable time. There is hereby created a Plumbing Advisory Board which shall have three (3) members, each of whom shall be licensed Master Plumbers of the City of Clearwater. z. All members of the Plumbing Advisory Board shall be appointed by the City Manager. The first Board shall be appointed within thirty (30) days of the passage of this Code and thereafter on January 1 of each calendar year. The City Manager shall annually appoint all members, who shall serve for a term of one (1) year or until their successors are appointed and qualified. 3. Procedure of Plumbing Advisory Board. The three (3) members of the Plumbing Advisory Board shall elect one member as Chairman, whose duties shall be to preside at all the meetings of said Board and to call meetings of said Board when requested by the City Plumbing Inspector or any licensed Master Plumber in the City of Clearwater. Fraud or deceit in obtaining certificate or license; 2. Willful, deliberate, or negligent disregard and violation of the City Plumbing Code, any City Ordinance, the City Code, or the regulations of the State Hotel Commission or the State Board of Health; 3. Conviction of a criminal charge involving fraud relating to plumbing work or contracting, by any Court of competent jurisdiction, or the entry of a final decree or judgment by any Court of competent jurisdiction finding and holding such certificate holder to be guilty of fraud in connection therewith; 4. The filing of a petition in voluntary bankruptcy by any contractor holding a certificate and license under this Code shall automatically serve to revoke his certificate and license; 5. Allow his name to be used by any person or party, directly or indirectly, either for the purpose of obtaining a permit or to do any work under his license in violation of the terms of this Code; shall be subject to having his certificate revoked or suspended by the City Manager upon the recommendation of the Plumbing Advisory Board.
