ORDINANCE NO. 1341
AN ORDINANCE OF TIME CITY OF CLEARWATER,
FLORIDA, AMENDING SECTION 1-9, JURY TRIAL,
OF THE CODE OF ORDINANCES OF THE CITY OF
CLEARWATER, FLORIDA, 1962. TO PROVIDE THAT
ANY PERSON SHALL BE ENTITLED TO A TRIAL BY
JURY UPON DEMAND THEREFOR FOR ANY OFFENSE
CHARGED IN MUNICIPAL COURT WHEN SUCH AN

ORDINANCE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER. FLORIDA:
Section 1. Sub-paragraph (a) of Section 1-9. Jury Trial, of the Code
of Ordinances of the City of Clearwater, Florida, 1962, is amended to read
as follows:
Sec. 1-9. Jury Trial.
(a) Demand and Waiver. Any person shall be entitled to a
trial by jury upon demand therefor made at or prior to the
time of arraignment for any offense charged in Municipal
Court when such an offense is also a violation of a State Law.
Failure to make such demand not later than the time of
arraignment for such offense shall constitute a waiver of
such right to a jury trial, provided such person is advised of
his right to same and the consequences of his failure to make
demand therefor at the time of such arraignment by the Judge
then presiding.
Section 2. Any person who shall violate the provisions of this
ordinance shall be subject, upon conviction in the Municipal Court, to a
fine not exceeding the sum of Five Hundred Dollars ($500. 00), or imprisonment
in the City Jail for not exceeding sixty (60) days, or by both such fine and
imprisonment in the discretion of the Municipal Judge.
Section 3. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.

Section 4. Should any part or. provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect 3 wfi

its passage.
