ORDINANCE. _
WHEREAS, on July 26, 1971, the City Commission of the City of
Clearwater, after proper public notice, held a public hearing on certain
proposed changes to the zoning ordinance and zoning map of the City of
Clearwater in accordance with procedure as established and certain items
were continued until August 16, 1971, and thereupon completed; and
WHEREAS, certain of the proposed changes and amendments to the
zoning ordinance and zoning map were approved by the City Commission
after its evaluation of all evidence presented at the public hearing and the
continuation thereof;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. The following described properties in Clearwater,
Florida, are hereby classified and zoned as hereinafter indicated and
"The Zoning Map of the City of Clearwater, Florida of 197111, as amended,
is amended to indicate that fact as herein set out.
(A) Zoned as PRS Professional and Related Services
1. Lots 13 through 24, inclusive, Midway Subdivision,
according to the map or plat thereof as recorded

Pinellas County, Florida.

Section Z. Section Z6-2, Definitions, of Code of Ordinances of the
City of Clearwater, Florida, 1962, is hereby amended to to re-number sub-
paragraph (17b) as (17c), to eract a new sub-paragraph (17b) and to enact a
new sub-paragraph (24b) to read as follows:
(17b) GROSS LAND AREA - That area, either in square feet or
acreage, within a contiguous parcel(s) of ownership inclusive
of existing or proposed public and private roadways, rights
of way and easements of access.
(17c) HEIGHT - As applied to a building, means the vertical
distance from the building grade to the highest finished roof
surface in the case of a building with a flat roof, or the
vertical distance from the building grade to a point at the average
height of the roof or a building having a pitched roof.
(24b) NET ACRE - That gross land area, in acres, less existing
or proposed public and private roadways, rights of way and
easements of access.

Section 3. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 4. Shoub3 any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 5. Any person or persons, firm or corporation or association
of persons, who shall violate or fail to comply with any of the terms or
provisions of this ordinance shall, upon conviction in the Municipal Court,
be fined not exceeding the sum of Five Hundred Dollars ($500. 00), or
imprisonment in the City Jail for not exceeding sixty (60),'daye, or by
both such fine and imprisonment in the discretion of the Municipal Judge.
Each day that a violation is permitted to exist shall constitute a separate
offense. `
Section 6. The Planning Director is directed to include and set out
and show upon the official zoning map of the City of Clearwater the foregoing
amendments as hereinabove set out.

Section 7. The provisions of this ordinance shall take effect
immediately upon its passage.
