FLORIDA, AMENDING CHAPTER 14, OFFENSES AND
MISCELLANEOUS PROVISIONS, SECTION 14-44, PER
TAINING TO HANDBILLS, OF THE CODE OF ORDINANCES
OF THE CITY OF CLEARWATER, FLORIDA, 1962, BY
CLARIFYING WHERE THE DISTRIBUTION OF HANDBILLS
OR OTHER ADVERTISING AND COMMERCIAL MATTER
IS NOT PERMITTED, BY REQUIRING A DISTRIBUTORIS
PERMIT TO BE ISSUED BY THE CHIEF OF POLICE
FOR THE DISTRIBUTION OF SAME AT ANY PRIVATE
RESIDENCE, APARTMENT OR PREMISES AND SETTING
FORTH THE REQUIREMENTS AND REGULWWIONS FOR THE
ISSUANCE OF SUCH PERMIT; PROVIDING A PENALTY FOR
FAILURE TO COMPLY HEREWITH; PROVIDING FOR REPEAL
OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH TO THE EXTENT OF SUCH CONFLICT; PRO-
VIDING FOR THE SEPARABILITY OF THE PROVISIONS
HEREOF AND PROVIDING FOR THE EFFECTIVE DATE
OF THIS ORDINANCE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEAR WATER, FLORIDA:

Miscellaneous Provisions, of the Code of Ordinances of the City of Clearwater,
Florida, 1962, is hereby amended to read as follows:
Section 1. Section 14-44, Handbills, of Chapter 14, Offenses and
Sec. 1444. Handbills.
A. Distribution Prohibited on Public Street, Etc.
It shall be unlawful for any person to throw, c ast, affix, or
distribute any handbill, circular, card, booklet,, placard or
other advertising and commercial matter whatsoever, in or
upon any public street or other public place of the City or in
or upon any motor vehicle located thereon.
Nothing contained in this section shall be deemed to prohibit
or otherwise regulate the distribution or sale of newspapers
regularly sold by the copy or by annual subscription or to
prevent the lawful distribution of religious or political matter
or of anything other than commercial and business advertising
matter.
B. Permit - Required.
It shall be unlawful for any person not holding a distributor=s
permit in the City to go in, on or upon any private residence,
apartment or premises in the City for the purpose of distributing,
any handbill, circular, card, booklet, placard or other '
advertising and commercial matter whatsoever, without first
having applied for and received from the Chief of Police a
distributor's permit so to do.

(b) The personal description of, the applicant.
Such appliation shall be accompanied by the photograph of the
applicant and such credentials and other evidence of the good moral

character and identity of the applicant, as may be reasonably
required by the Chief of Police
D. _Permit - Issuance, expiration.
If the Chief of Police shall determine after reasonable investi-
gation that the applicant is of good moral character, and
proposes to engage in a lawful and legitimate commercial or
professional enterprise, and that said enterprise is not in any
manner prejudicial to the public health, safety, morals, or
general welfare and is not of such nature as to be offensive
to the public, or to be likely to cause or contribute to disturbances
of any nature, he is then within his discretion to issue the permit
applied for, which permit shall expire on the 30th day of
September next following the date of issuance of the permit.
E.• _Permit - Car rying,exhibiting.
Such permit shall be carried at all times by the applicant to
whom issued, when distributing any handbill or other advertising
and commercial matter whatsoever in the City, and shall be
exhibited by any such applicant whenever he shall be requested
so to do by any police officer or any person to whom such matter
is being distributed.
F. Permit - Revocation.
Any such permit may be revoked by the Chief of Police for
violation by the holder thereof of any of the ordinances of the
City, or of any State or Federal law, or whenever the holder
of such permit shall in the judgment of the Chief of Police cease *? R
to possess the character and.quaiifications required for the issuance a'.

Section Z. Any person, organization, society, association or
corporation, or any agent or representative thereof, who shall violate the
provisions of this ordinance shall be subject, upon conviction in the Municipal
Court, to a fine not exceeding the sum of Five Hundred Dollars ($500. 00),
or imprisonment in the City Jail for not exceeding sixty (60) days, or by

are to the extent of such conflict hereby repealed.
