AN ORDINANCE OF THE CITY OF CLEARWATER#
FLORIDAO AMENDING, CHAPTER 26, AS AMENDED,
PERTAINING TO ZONING. OF THE CODE OF ORDI-
NANCES* CITY OF CLEARWATER, FLORIDAO 1962,
BY AUTHORIZING THE CITY COMMISSION TO SET
AND ESTABLISH BY RESOLUTION FEES AND CHARGES
FOR APPEALS TO THE BOARD OF ADJUSTMENT AND
........ APPEAL ON ZONING AND TO THE CITY COMMISSION;
BY AUTHORIZING THE CITY COMMISSION TO SET
AND ESTABLISH BY RESOLUTION FEES AND CHARGES
FOR APPLICATIONS FOR REZONING; BY PROVIDING
FOR REPEAL OF ORDINANCES OR PARTS OF ORDI-
NANCES IN CONFLICT HEREWITH TO THE EXTENT
OF SUCH CONFLICT; BY PROVIDING FOR THE
SEPARABILITY OF THE PROVISIONS HEREOF; BY
PROVIDING PENALTIES FOR THE VIOLATION OF
THIS ORDINANCE AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
WHEREAS, on June 7, 1971, the City Commission of the City
.
of Clearwater, after proper public notice, held a public hearing on certain
proposed changes to the zoning ordinance of the City of Clearwater in
accordance with procedure as established; and
WHEREAS, certain of the proposed changes and amendments to the
zoning ordinance were approved by the City Commission after its evaluation
of all evidence presented at the public hearing;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. Sub-sections (3) and (6) of Section 26-17, Board of
Adjustment and Appeal, of Code of Ordinances, of the City of Clearwater,
Florida, 1962, are hereby amended to read as follows:

(3) The board shall hear appeals from any decision or action
of the building inspector (official) and determine the rights
of the applicant. Appeal to the board may be taken by any
person, firm or corporation aggrieved. provided notice
thereof together with grounds thereof, are filed in triplicate,
in writing, with the board within twenty (20) days after such
action of the building inspector (official). The board shall
forthwith transmit one copy thereof to the City building
inspector (official), who shall then forthwith transmit to the
board all the papers constituting the record upon which the
action appealed from is taken. Each appeal shall be accompanied
by a payment sufficient in amount to cover the coots of
processing the application, which charges shall be set and
established by resolution, passed by the City Commission.

(6) Any person adversely affected by a decision of the board
or any officer, department head, board or bureau of the
city may appeal such decision to the City Commission.
Such appeal shall be taken by filing written notice thereof,
in duplicate, with the City'Clerk within ton (10) days
after the decision of the board. The City Clerk shall
forthwith transmit one copy thereof to the Secretary of
the Board, who shall then forthwith transmit to the Clerk
for the use of the City Commission, all the papers
constituting the record upon which the action appealed
from is taken. Each such appeal shall be accompanied
by a payment sufficient in amount to cover the costs of
processing the application, which charges shall be set
and established by resolution passed by the City
Commission.
Section 2. Sub-section (b) of Section 26-33, Procedure for Amending
Zoning Provisions, of Code of Ordinances, of the City of Clearwater,
Florida, 1962, is hereby amended to read as follows:
(b) Applications shall be filed in triplicate with the City Clerk
and shall set forth the reasons and grounds for said request.
Each application by anyone, other than a board or official of
the City of Clearwater, shall be filed by the owner or his
• duly authorized representative and shall be accompanied at
the time of filing by a fee to cover the approximate cost of
the procedure, which charges shall be set and established
by resolution passed by the City Commission. Under no
condition shall such sum, or any part thereof, be refunded
for failure of such change to be adopted by the City Commission.
Section 3. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 4. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 5. Any person or persons, firm or corporation or association
of persons, who shall violate or fail to comply with any of the terms or
provisions of this ordinance shall, upon conviction in the Municipal Court,
be fined not exceeding the sum of Five Hundred Dollars ($500. 00), or
imprisonment in the City Jail for not exceeding sixty (60) days, or by both
such fine and imprisonment in the discretion of the Municipal Judge. Each
day that a violation is permitted to exist shall constitute a separate Offense.
