FL.,IORIDA, AMENDING CHAPTER 26a AS AMENDEDs
PERTAINING TO ZONINGS OF THE CODE OF
ORDINANCES. CITY OF CLEARWATER$ FLORIDA.
19620 AND AMENDING THE ZONING MAP OF THE
CITY OF CLEARWATER, FLORIDA, 1971, AS AMENDED,
BY RECLASSIFYING AND ZONING CERTAIN PROPERTY
AS DESCRIBED HEREIN; BY ESTABLISHING NEW
MINIMUM BUILDING SETBACK L4NES FOR "B" BUSI-
NESS ZONE CLASSIFICATION PROPERTIES; AND
PROVIDING FOR CERTAIN ALLOWABLE VARIATIONS FROM
SAID MINIMUM BUILDING SETBACKS IN THE "B"
BUSINESS ZONE CLASSIFICATION UPON APPEAL TO BE
GRANTED THROUGH PLAN REVIEW BY THE CITY
COMMISSION UPON RECOMMENDATION FROM
APPROPRIATE CITY OF CLEARWATER DEPART-
MENTS; BY PROVIDING FOR REPEAL OF ORDINANCES
OR PARTS OF ORDINANCES IN CONFLICT HEREWITH
TO THE EXTENT OF SUCH CONFLICT; BY PROVIDING
FOR THE SEPARABILITY OF THE PROVISIONS HEREOF;
BY PROVIDING PENALTIES FOR THE VIOLATION OF
THIS ORDINANCE AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
WHEREAS, on June 21, 1971, the City Commission of the City
of Clearwater, after proper public notice, held a public hearing on certain
proposed changes to the zoning ordinance and zoning map of the City of
Clearwater in accordance with procedure as established; and
WHEREAS, certain of the proposed changes and amendments
to the zoning ordinance and zoning map were approved by the City Commission
after its evaluation of all evidence presented at the public hearing;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. The following described property in Clearwater, Florida,
is hereby classified and zoned as hereinafter indicated and "The Zoning
Map of the City of Clearwater, Florida of 1971", as amended, is amended
to indicate that fact as herein set out:
, Zoned as R-313 _- Multi-family
Government Lot 2 in Section 16, Township 29 South, Range
16 East, LESS the North 800 feet thereof; and LESS the
South 100 feet of the West 600 feet of the North 900 feet
thereof; and LESS the South 205 feet of the East 930 feet
thereof; and LESS the triangle East of "Bayshore Boulevard;
a:nd LESS the East 360 feet of the South 140 feet of the North
1090 feet thereof; and LESS the South 221 feet; and LESS the
East 930 feet of said South 221 feet, and LESS road rights of
way, and LESS that portion lying North of a line lying 330 feet
' North of the "centerline of S. R4_ 60.

(16) to read as follows:

Section 4. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 5. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section b. Any person or peerons, firm or corporation or association
of persons, who shall violate or fail to comply with any of the terms or pro-
visions of this ordinance shall, upon conviction in the Municipal Court, be
fined not exceeding the sum of Five Hundred Dollars ($500.001, or imprieon-
ment in the City Jail for not exceeding sixty (60) days, or by both such fine
and imprisonment in the discretion of the Municipal Judge. Each day that
a violation is permitted to exist shall constitute a separate offense.
Section 7. The Planning Director is directed to include and set out
and show upon the official zoning map of the City of Clearwater the foregoing.

Section 8. The provisions of this ordinance shall take effect immediately
upon its passage.
