AN ORDINANCE OF THE CITY OF CLEARWATER,
FLORIDA, AMENDING CHAPTER 26, AS AMENDED,
PERTAINING TO ZONING, OF THE CODE OF ORDI-
NANCES, CITY OF CLEARWATER, FLORIDA, 1962s
AND AMENDING THE ZONING MAP OF THE CITY OF
CLEARWATER, FLORIDA, 1971, AS AMENDEDo BY
RECLASSIFYING AND ZONING CERTAIN PROPERTIES
AS DESCRIBED HEREIN; BY REQUIRING IN BUSINESS
DISTRICTS A SPECIAL PERMIT FOR TEMPORARY
USE OF PARKING OR OPEN AREAS FOR TENT SALES
AREA OR DISPLAY AREA; BY PROVIDING FOR REPEAL
OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH TO THE EXTENT OF SUCH CONFLICT; BY
PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS
HEREOF; BY PROVIDING PENALTIES FOR THE VIOLATION
OF THIS ORDINANCE AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
WHEREAS, on March 22, 1971, the City Commission of the City
of Clearwater, after proper public notice, held a public hearing on certain
proposed changes to the zoning ordinance and zoning map of the City of
Clearwater in accordance with procedure as established; and
WHEREAS, certain of the proposed changes and amendments to the
zoning ordinance and zoning map were approved by the City Commission
after its evaluation of all evidence presented at the public hearing;
NOW O THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. The following described properties in Clearwater,
Florida, are hereby classified and zoned as hereinafter indicated and
"The Zoning Map of the City of Clearwater, Florida of 1971", as amended,
is amended to indicate that fact as herein set out:

Section 2. Sub-section (3), Prohibited Uses, of Section 26-6A, Use
Regulations, "B" Business Districts, of Code of Ordinances, of the City of
Clearwater, Florida, 1962, is hereby amended to add a new Sub-paragraph
C) to read as follows:
Temporary usage of parking lots and/or open areas for tent'
sales area or for fenced area for exhibit of special products
for sale, or for trailer display and sales, or any commercial

use or display, other than automobile parking, Ehall be prohibited
except by permit issued by the Building Official, after approval
by the City Manager. Authorization may be required by the City
Commission in such instances that such activity may be considered
to cause excessive traffic congestion, a hazardous condition to r"r#
exist, or may appear not to be in the interest of the public welfare. }
(Such request shall not reduce the number of parking spaces below r
the ordinance requirement needed to serve the principal building.).
Section 3. All ordinances or parts of ordinances in conflict herewith
to the extent of such conflict are hereby repealed.
Section 4. Should any part or provision of this ordinance be declared
by. a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.

Section 5. Any person or persons, firm or corporation or association
of persons, who shall violate or fail to comply with any of the terms or
provisions of this ordinance shall, upon conviction in the Municipal Court,
be fined not exceeding the sum of Five Hundred Dollars ($500.00), or
imprisonment in the City Jail for not exceeding sixty (60). days, or by
both such fine and imprisonment in the discretion of the Municipal Judge.
Each day that a violation is permitted to exist shall constitute a separate
offense.
Section 6. The Planning Director is directed to include and set out
and show upon the official zoning map of the City of Clearwater the foregoing
amendments as hereinabove set out.
Section 7. The provisions of this ordinance shall take effect
immediately upon its passage.
