BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Sub-Paragraph (12), Utility Lines, of Section 20-5,
Improvements Required, of Chapter 20, Subdivisions, of the Code of
Ordinances of the City of Clearwater, Florida, 1962, is amended to read
as follows :
Y. .(121 Utility lines. Indicate the locations of all gas,
water, electrical, telephone and other utility lines
to be installed, and shall install said lines in accordance
with said locations and under the supervision of the
City Engineer, or such other person as may be appointed
by the City Manager to supervise such installations.
.?' All utilities, including power, cable television and
all communication lines, must be located underground
according to plans approved by the City Engineering
Department; except in special instances where, because
of hardship the City Commission determines that such
requirement would be unreasonable, in which event
said power, cable television and communication lines
may be set aboveground for an agreed stipulated length
of time. For the purpose of this paragraph, surface
mounted transformers, pedestal mounted terminal
boxes and meter cabinets, street lighting or signal
control cabinets, and other associated equipment in
an underground system may be placed aboveground.
Plans for building sites for such associated equipment
shall be submitted for approval to the City Engineering
Department. Structures under three (3) feet in height
shall be totally screened by a continuous permanent

evergreen planting. Structures over three (3) feet
high shall have a minimum: of 4016 of the height of
the exposed wall surface screened by a continuous
permanent evergreen planting (or equivalent).. The
owner or developer is responsible for complying with
the requirements of this section and shall make all
the necessary arrangements as required by the serving
utilities for the installation of such facilities. Con-
flicts between this regulation and applications on
State or County rights of way or easements shall be
resolved by the utility owner with the City Engineer.
