ORDINANCE NO. 1.298
AN ORDINANCE OF THE CITY OF CLEARWATER,
FLORIDA, AMENDING CHAPTER 26, AS AMENDED,
PERTAINING TO ZONING, OF THE CODE OF ORDI-
NANCES, CITY OF CLEARWATER$ FLORIDA, 1962,
PROVIDING FOR THE EXPANSION OF CHURCHES
ESTABLISHED PRIOR TO MARCH 16, 1970, IN-
CLUDING CHURCH ACCESSORY USES AS DEFINED;
PROVIDING FOR REPEAL OF ORDINANCES OR PARTS
OF ORDINANCES IN CONFLICT HEREWITH TO THE
EXTENT OF SUCH CONFLICT; PROVIDING FOR THE
SEPARABILITY OF THE PROVISIONS HEREOF; PRO-
VIDING PENALTIES FOR THE VIOLATION OF THIS
ORDINANCE AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
WHEREAS, on December 3, 1970, the City Commission of the City
of Clearwater, Florida, after proper public notice, held a public hearing on
certain proposed changes to the zoning ordinance of the City of Clearwater
in accordance with procedure as established; and
, WHEREAS, certain of the proposed changes and amendments to the
zoning ordinance were approved by the City Commission after its evaluation
of all evidence presented at the public hearing,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. Sub-paragraph (1) of Sub-section (A), Use Regulations—
11R-4A11 Motel and Apartment, of Section 26-5AA, Use Regulations, "R-4"
Districts, of Code of Ordinances, City of Clearwater, Florida, 1962, is
hereby amended by adding a new sub-paragraph (g) to read as follows:
(g) Churches - conditional uses, see Sec. 26-8A.
Section 2. Sub-paragraph (D), Use Regulations--"R-4D", Multiple
Dwelling, Hotel, Motel, Apartment House, of Section 26-5AA, Use Regulations,
11R-41f Districts, of Code of Ordinances, City of Clearwater, Florida, 1962,
is hereby amended by adding a new sub-paragraph (10)' to read as follows:

Section 6. Chapter 26, pertaining to Zoning, of the Code of Ordinances,
City of Clearwater, Florida, 1962, is hereby amended to add a new Section
26-8A, Churches —Conditional Uses, to read as follows;
Sec. 26-BA. Churches--Conditional Uses,
(1) Churches established prior to March 16, 1970, may
expand on existing ownership and subsequent abutting
property, for church and accessory uses only,
(2) Off-street parking use may be .extended to existing'
ownership and new lots within 500 feet of the assembly
building and shall meet the requirements of Sec. 26-11A.
(3) Accessory church uses shall include but not be limited to
the following:
(a) Parsonage
(b) Educational building
(c) Recreational building and play area
(d) Day nursery school, not operated for profit
(e) Non-commercial off-street parking
(4) In no case shall church use be extended into R-1, R-2, R-3A,
R-3B, R-3C, R-4B and R-4C zones, except that churches
established in a 1°B" zone may extend non-commercial parking
into residential zones as defined by special exception, refer
to Sec. 26-17 (5) (a)-(I), (16).
(5) All church site usage upon termination and before reuse
shall be rezoned to an appropriate compatible zone
classification following proper public hearing.
(6) New churches, to be initially established, shall require
ISP (Institutional and Semi-Public) zoning.
Section 7. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 8. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 9. Any person or persons, firm or corporation or association
of persons, who shall violate or fail to comply with any of the terms or
provisions of this ordinance shall, upon conviction in the Municipal Court,

be fined not exceeding the sum of Five Hundred Dolllars ($500.00), or
imprisonment in the City Jail for not exceeding sixty (b0) days, or by
both such fine and imprrisonment in the discretion of the Municipal Judge.
Each day that a violation is permitted to exist shall constitute a separate
offense.
Section 10. The Planning Director is directed to include and set out
and show upon the official zoning map of the City of Clearwater the foregoing
amendments as hereinabuve set out.
Section 11. The provisions of this ordinance shall take effect
immediately upon its passage.
