ORDINANCE.
WHEREAS, trees provide a setting with a variety of color unsurpassed
in shade and hue; and
WHEREAS, trees are an invaluable psychological counterpoint to
the man-made urban setting; and
WHEREAS, trees give shade and cool the land; and
WHEREAS, trees absorb a high per cent of carbon dioxide and
return oxygen, a vital ingredient to life; and
WHEREAS, trees are a valuable property asset that can affect an
area economically; and
WHEREAS, removal of trees impairs benefits to existing property
owners in the suxrounding area and impairs economic stability and the
value of unproved and unimproved real property; and

WHEREAS, removal of trees causes increased surface drainage and
soil erosion, causing increased municipal costs; and
WHEREAS, a shade tree ordinance is hereby promulgated for the
purpose of promoting community welfare through regulating removal and
destruction of-trace prior to, during construction and during occupancy;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That it shall be unlawful to remove or effectively remove
through damaging more than twenty-five per cent (25%) of the trees with a
four inch (411) diameter or greater, measure three feet (31) above grade,
on any one parcel of real property within the City, within any five (5) year
period prior to issuance of a building permit or subdivision approval.
Trees are defined as self-supporting woody plants of species which normally
grow to an overall height of a minimum of fifteen feet (15'). in the Clearwater
area,
Section Z. That the restrictions of this ordinance shall apply to
all properties requiring building permits and that a site plan shall be
required noting trees to be removed in relation to survey stakes. The above
information shall be field checked by the Parks Division Superintendent,
so noted on the site plan, with the recommendation for approval or denial
sent with it in writing.
A topographic survey and/or a site plan is required and shall include
the following:
(a). Location of proposed driveways and other planned areas
(b)• All trees over four inches (411) in diameter (and identified)
(c)" Diseased trees, trees endangering the right of way, and other
r(d). Trees to be removed and trees to be retained --also,locate
protective barriers (see Section 3j
(e). Grade changes which might adversely affect or endanger
the trees with specifications on how to maintain the trees

Section 3.? That it shall be unlawful to place material, achinery

or temporary soil deposits within six fact (61) of the above dimensioned
tree trunk or stem; except that during construction, the builder shall
erect suitable protective barriers around all trees to be preserved, each
case to be determined on its separate merits by the Parks Division
Superintendent and within which nothing is to be stored except as necessary
for limited time if no other storage is available.
Section 4. That the City Engineering Offi'.:e, during informal review
prior to development application, determine through drainage and utility
study, if changes will occur to topographic features, vegetation and
therefore runoff, and shall so note such findings on the development
application.
Section 5. That where construction necessitates removal of trees,
the same shall be relocated, or replaced wherever practical (to be determined
by the Parks Division Superintendent or the City Manager), in an approved
and satisfactory manner within the setback lines (minimum diameter
one and one-half inches (1-1/211) measured three feet (31),'above grade),.
Section 6. That a permit shall be obtained for removing a tree
above four inch (4'). diameter--particularly those in front setback areas
or within fifteen feet (151) of front property line--whichever is greater.
Further, that exceptions to this requirement shall cover citrus, punk and
Australian pine trees. No trees shall be removed from public right of way
without a permit. (See Sec. 19-Z3 et seq. of the Code)

Section 7. That during construction no attachments or wires
(other than protective guy wires) or signs to trees are permitted.

Section 8. That exemptions to all provisions of this ordinance are
one. (11 and two (2)' lot developments in single family or duplex districts except
when more than two (2) lots are being developed at one time.

Section 9. That this,ordinance shall apply to all parcels prior to
plan review and, upon development, to the setback areas and, with some
discrimination, to courts and common open areas.
Section 10. That the City Manager may waive established standards
due to hardship caused by closeness to building line, problems with cut
and fill, and others of a variance nature.
Section 11. Any person adversely affected by a decision of the
City Manager or Parks Division Superintendent in the enforcement or
interpretation of any of the terms or provisions of this ordinance may appeal
such decision to the City Commission. Such appeal shall be taken by filing
written notice thereof with the City Manager with a copy to the City Clerk
within ten (10) days after the decision of the City Manager or the Parks
Division Superintendent. Each such appeal shall be accompanied by a
payment in sufficient amount to cover the cost of publishing and mailing
notices of hearing or hearings.
Section 12. Any person, organization, society, association or
corporation, or any agent or representative thereof, who shall violate the
provisions of this ordinance shall be subject, upon conviction in the Municipal
Court, to a fine not exceeding the sum of Five Hundred Dollars ($500. 00), or
imprisonment in the City Jail for not exceeding sixty (601'days, or by both
such fine and imprisonment in the discretion of the Municipal Judge.
Section 13. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 14. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
