AN ORDINANCE OF THE CI'T'Y OF CLEARWATER,
FLORIDA, EZM. CTING A NEW SECTION 11-60 LAND
FILLS, OF CHAPTER 11, HEALTH AND SANITATION.
OF THE CODE OF ORDINANCES OF THE CITY OF
CLEARWATER, FLORIDA, 1962, TO SET FORTH
CRITERIA FOR ISSUANCE OF LAND FILL PERMITS
BY CITY ENGINEER AND TO PROVIDE FOR APPEAL
FROM ANY SUCH DECISION; PROVIDING A PENALTY
FOR FAILURE TO COMPLY HEREWITH; PROVIDING
FOR REPEAL OF ORDINANCES OR PARTS OF ORDI-
NANCES IN CONFLICT HEREWITH TO THE EXTENT
OF SUCH CONFLICT; PROVIDING FOR THE SEPARA-
BILITY OF THE PROVISIONS HEREOF AND PROVIDING
FOR THE EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, there has been continual indiscriminate filling of natural
and man-made storm water storage areas in the City of Clearwater; and
WHEREAS, it is felt that this indiscriminate filling must be controlled
for the health and welfare of the citizens of the City of Clearwater;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section. 1. There is hereby enacted a new Section 11-6, Land Fills,
of Chapter 11, Health and Sanitation, of the Code of Ordinances of the City
of Clearwater, Florida, 1962, to read as follows:
Sec. 11-6. Land Fills.
All applications for land fill permits shall be filed with the
City Engineer who shall be in charge of issuing or denying
said permits. Land fills shall be permitted only after
analysis and review of said application by the City Engineering
Department. Said analysis shall determine whether the pro-
posed finished grade will be compatible with the surrounding
area and ultimate City drainage plan or existing drainage
patterns. No permits will be issued in such instances where
the City Engineering Department finds the plan incompatible
with the ultimate City drainage plan. Any person adversely
.affected by a decision of the City Engineer in granting or
denying'a land fill permit may appeal such decision to the
City Commission. Such appeal shall be taken by filing
written notice thereof with the City Manager, with a copy
to the City Engineer, within ten (10) days after the decision
of the City Engineer. The City Engineer shall forthwith
transmit his files and records, or copies thereof, in
connection with said application to the City Manager for
information in connection with said appeal. Each such
appeal shall be accompanied by a payment sufficient in
amount to cover the cost of publishing and mailing notices
of hearing or hearings.

are to the extent of such conflict hereby repealed.
Section 4. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the

part declared to be invalid.

its passage.
