PERTAINING TO ZONING, OF THE CODE OF ORDINANCES,
CITY OF CLEARWATER, FLORIDA,+ 1962s AND AMENDING
THE ZONING MAP OF THE CITY OF CLEARWATER&
FLORIDA, 1970, AS AMENDED, BY RECLASSIFYING
AND ZONING CERTAIN PROPERTIES A DESCRIBED
HEREIN; BY CLARIFYING PERMITTED USES FOR HEAVY
BUSINESS DISTRICT; BY CLARIFYING PERMITTED USES
IN A 11P11 PUBLIC DISTRICT; BY AMENDING LOCATION,
HEIGHT AND AREA REGULATIONS TO CONTROL SET-
BACK AND DENSITY OF APARTMENTS BUILT IN
PROFESSIONAL AND RELATED SERVICES DISTRICT;
PROVIDING FOR REPEAL OF ORDINANCES OR PARTS
OF ORDINANCES IN CONFLICT HEREWITH TO THE
EXTENT OF SUCH CONFLICT; PROVIDING FOR THE
SEPARABILITY OF THE PROVISIONS HEREOF;
PROVIDING PENALTIES FOR THE VIOLATION OF THIS
ORDINANCE AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
WHEREAS, on November 9, 1970, the City Commission of the City
of Clearwater, Florida, after proper public notice, held a public hearing on
certain proposed changes to the zoning ordinance and zoning map of the City
of Clearwater in accordance with procedure as established; and

WHEREAS, certain of the proposed changes and amendments to the
zoning ordinance and zoning map were approved by the City Commission
after its evaluation of all evidence presented at the public hearing;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. The following described properties in Clearwater,
Florida, are hereby classified and zoned as hereinafter indicated and
"The Zoning Map of the City of Clearwater, Florida of 197011, as amended,
is amended to indicate that fact as herein set out:
(A) Zoned as R-1C - Single Family
Lots 1 through 6, inclusive, Oak Acres, Unit S,
according to the map or plat thereof as recorded in

Section 2. Sub-paragraphs 4a),and (b) of Sub-sectiong2), Permitted
Uses of Section 26-6B, Use Regulations--"HB" Heavy Business District, of
Code of Ordinances, City of Clearwater, Florida, 1962, are hereby amended
to read as follows:
(a) The permitted uses of the "B" Business zone as listed
below are permitted uses of the "HB" zone.
R-3 uses as per section 26-5A (1), less (a) and (b)
R-4 uses as per section 26- 11 (7), (9) (a)
R-4D as per section 26-5AA (D), less (1), and (Z)
RM uses less (11 and (Z) of section 26-5B
PRS uses
Townhouses when established in a B zone or HB zone
shall comply with requirements set out in section
26-IIB, Planned Unit Developments, and in addition
shall meet Townhouse off-street parking requirements.
Retail Business
Operations involving wholesaling, supply and distribution
with or without warehousing, service, renovation and
repair establishments including automotive, business '
service establishments, including printing (when
entirely within enclosed building).
Professional Business and Trade Schools
Research Design and Development Activities and accessory
laboratory where there is no heavy equipment used, no

(b) Special exceptions of the B zone as listed below
are permitted uses of the HB zone.
Storage yards - when shielded from view from any
public way (wall, solid fence and/or screen planting).
Transfer and Storage establishments
Certain fabricating and manufacturing conducted under
following conditions:. such uses shall be constructed,
maintained and operated as not to be injurious or
offensive to the occupants of adjacent premises by
reason of the emission or creation of noise, vibration,
smoke, dust or other particular matter, toxic or
noxious waste materials, odors, fire and explosive
hazard or glare. All processes and storage, except
storage for vehicles, shall be in completely closed
buildings.
Section 3. Section 26-9, Use Regulations--"P'1 Districts, of Code
of Ordinances, City of Clearwater, Florida, 1962, is hereby amended to
read as follows:
Sec. 26-9. Use Regulations--"P'l Districts.
In the 11P11 Public District all premises and buildings shall be
used exclusively for the following purposes, to wit:
(1) Public streets, places, alleys, public highways,
public parks, public buildings, public works facilities
and similar public uses, public recreation grounds,
public aviation fields, golf courses, baseball fields,
other athletic fields, bathing beaches, amusement parks,
recreational centers, railway (other than street railway),
places of scenic beauty calculated to attract visitors
and tourists.
Section 4. Sub-section (9) of Section 26-11, Location, Height and
Area Regulations--Setbacks, lot size, height, area, of Code of Ordinances,
City of Clearwater, Florida, 1962, is hereby amended to read as follows:
(9) Any multi-family structure when built in a PRS
(Professional and Related Services) zone shall
conform to the requirements of the R-4A zone
classification.
Section 5. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.

Section 6. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be Invalid. r
Section 7. Any person or persons, firm or corporation or association
of persons, who shall violate or fail to comply with any of the terms or
provisions of this ordinance shall, upon conviction in the Municipal Court,
be fined not exceeding the sum of Five Hundred Dollars ($500.00); or
imprisonment in the City Jail for not exceeding sixty (60) days, or by
both such fine and imprisonment in the discretion of the Municipal Judge.
Each day that a violation is permitted to exist shall constitute a separate
offense.
Section 8. The Planning Director is directed to include and set out
and show upon the official zoning map of the City of Clearwater the foregoing
amendments as hereinabove set out.
Section 9. The provisions of this ordinance shall take effect
immediately upon its passage.
