BE IT ORDAINED BY THE CITY COMMISSION Or THE CITY OF
CLEAR WATER, FLORIDA:
Section. 1. There is hereby enacted a new Section 14-44. 1, Hypodermic
Syringe; of Chapter 14, Offenses and Miscellaneous Provisions, of the Code
of Ordinances of the City of Clearwater, Florida, 1962, to read as follows:
Sec. 14-44. 1. Hypodermic Syringe.
No person, except a dealer in surgical instruments,
apothecary, physician, dentist, veterinarian or nurse,
attendant or interne of a hospital, sanatorium or in-
stitution in which persons are treated for disability or
disease, shall at any time have or possess a hypodermic
syringe or needle or opium pipe, or any instrument or
implement adapted for the use of cocaine or narcotic
drugs by subcutaneous injection and which is possessed
for that purpose, unless such possession its authorized
by the certificate of a physician issued within the period
of one year prior thereto. Further the sale of a hypodermic
syringe or needle is prohibited unless said purchase is
authorized by a prescription issued by a duly licensed
and practicing physician which is presented at the time
of the purchase.
, Section 2. Any person who shall violate the provisions of this Ordinance,
shall be, subject, upon conviction in the Municipal Court, to a fine not exceeding
the sum of Five Hundred Dollars ($500. 00), or imprisonment in the City Jail
for not exceeding sixty (60).days, or by both such fine and imprisonment in
the discretion of the Municipal Judge.

Section 3. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 4. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 5. This ordinance shall become effective immediately upon
its passage.
