AN ORDINANCE OF THE CITY 0 1 F CLEAR WATER,,
FLORIDA, AMENDING CHAPTER 26, AS AMENDED,
PERTAINING TO ZONING, OF THE CODE OF
ORDINANCES, CITY OF CLEARWATER, FLORIDA,
1962, REQUIRING THE SCREENING OF SALVAGE
OR JUNK OPERATIONS AS AN ACCESSORY AND/OR
SECONDARY USE IN ANY B, HB AND M ZONED
PROPERTY; PROVIDING FOR REPEAL OF ORDI-
NANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH TO THE EXTENT OF SUCH CONFLICT;
PROVIDING FOR THE SEPARABILITY OF THE PRO-
VISIONS HEREOF; PROVIDING PENALTIES FOR THE
VIOLA'T'ION OF THIS ORDINANCE AND PROVIDING
FOR THE EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, on July 7.7, 1970, the City Commission of the City of
Clearwater, after proper public notice, held a public hearing on certain
proposed changes to the zoning ordinance and zoning map of the City of
Clearwater in accordance with procedure as established; and
WHEREAS, the public hearing on certain proposed changes to the
zoning ordinance was continued until October 5, 1970; and
WHEREAS, certain of the proposed changes to the zoning ordinance
were approved by the City Commission after its evaluation of all evidence
presented at the continued public hearing,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. Sub-Paragraph (1), Permitted Uses, of Section 26-6A,
Use Regulations, "B1" Business Districts, of Code of Ordinances, City of
Clearwater, Florida, 1962, is amended to add a new sub-paragraph ,(I?)to
read as follows.
(L)Salvage or junk operation as an accessory and/or secondary
use (Refer to Sec.' 26-11161 (c).):
Section 'L. Sub-Paragraph (Z), Permitted Uses, of Section Z6-6B;
Use Regulations, 11HB11 Heavy Business Districts, of Code of Ordinances,
city of Clearwater, Florida, 1962, is amended to add a new sub-paragraph

Salvage or junk operations as an accessory and/or secondary
(c)"

use. For secondary uses which meet junk yard--salvage yard
definition the following conditions shall be met: On any B, HB
and M coned property, the entire area occupied by a secondary
salvage or junk operation shall be screened by a continuous, ' r>?. +
attractive, 75016 opaque masonry, metal (not corrugated sheet
metal or other roofing material;, wood fence or wall, at a
minimum of eight feet ($')' in height. Such fence or wall shall
be without openings, except for entrance and exit, which
opening shall be equipped with opaque gates, Supplemental r
planting shall be required along the fence or wall on that
portion abutting any street right of way. Reasonable care
and maintenance shall be the responsibility of the property
owner.
Section 4. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 5. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 6. Any person or persons, firm or corporation or association
of persons, who shall violate or fail to comply with any of the terms or
provisions of this ordinance shall, upon conviction in the Municipal Court,
be fined not exceeding the sum of Five Hundred Dollars ($500. 00), or
imprisonment in the City Jail for not exceeding sixty (60)' days, or by
both such fine and imprisonment in the discretion of the Municipal Judge.
Each day that a violation is permitted to exist shall constitute a separate
offense.
