OF THIS ORDINANCE. "
WHEREAS. Section 23. 103, Florida Statutes, 1969, provides as
follows:
23. 103. Assessment of additional court costs in
criminal proceedings; disposition. --Every court
created by the state constitution or by legislative
act shall assess $1.00 as a court cost against every
person convicted for violation of a state penal or
criminal statute or convicted for violation of a
municipal or county ordinance. In addition $ 1. 00
from every bond estreature or forfeited bail bond
related to such penal statutes or penal ordinances
shall be forwarded to the state treasurer as herein-
after described. However, no such assessment shall
be made against any person convicted for violation
of any state statute, municipal ordinance or county
ordinance relating to the parking of vehicles. All
such costs collected by the aforesaid courts shall be
deposited in the state treasury to the credit of the
general revenue fund in the manner prescribed by
rules promulgated by the head of the department
of .law enforcement upon recommendation of the
executive director;

expenditures for their respective law enforcement

WHEREAS, the City Commission has determined that it would be

for the beat interest of the City of Clearwater and its citizens to enact an
ordinance in accordance with said enabling legislation requiring the
assessment of an additional $1. 00 as a court cost against every person
convicted for violation of a state penal or criminal statute or convicted
for violation of a municipal or county ordinance, except for violations relating
to parking of vehicles, in the Municipal Court of the City of Clearwater; and
in addition to deduct $1.00 from every bond estreature or forfeited bail
bond related to such penal statutes or penal ordinances for any offense,
except that relating to parking of vehicles, in the Municipal Court of the City
of Clearwater, such funds to be exclusively used for law enforcement
education expenditures for the law enforcement officers of the City of Clearwater;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER. FLORIDA:
Section 1. There is hereby assessed by the City of Clearwater, in
compliance with Section 23. 105, Florida Statutes, 1969, an additional $1. 00
as court cost against every person convicted for violation of a state penal or
criminal statute or convicted for violation of a municipal or county ordinance
in any proceedings, except for violations relating to parking of vehicles, in
the Muzicipal Court of the City of Clearwater. Further, $1. 00 shall be deducted
from every bond estreature or forfeited bail bond related to such penal
statutes or penal ordinancea for any offense, except that relating to parking of
vehiclc;a, in-the Municipal Court of the City of Clearwater. Said funds as levied

Section 3. All ordinances or parts thereof conflicting or inconsistent
with the provisions of this ordinance are hereby repealed.
Section 4. Should any section, paragraph, sentence or word of
this ordinance be declared for any reason to be invalid, the same shall not
affect the validity of the ordinance as a whole, or any part thereof other
than the part declared to be-invalid.
Section 5. This ordinance shall become effective immediately
