FLORIDA. PROVIDING FOR THE GRANTING OF A
TRIA L BY J URY F OR A LL OFFENSES TRIED IN
MUNICIPAL COURT UPON DEMAND THEREFOR;
PROVIDING FOR WAIVER; PROVIDING FOR NUMBER
OF JURORS AND QUALIFICATIONS, MANNER OF
SELECTION. COMPENSATION, EXEMPTIONS, AND
ALL PROCEDURES TO BE AS PROVIDED BY GENERAL
LAW FOR PETIT JURORS AND JURIES AND REQUIR-
ING JURORS TO BE RESIDENTS AND QUALIFIED
ELECTORS OF THE CITY; PROVIDING FOR THE
ADOPTION AND PROMULGATION OF RULES AND
PROCEDURES BY THE MUNICIPAL JUDGE;,PRO-
VIDING FOR THEIMPLEMENTATION OF THE
PROVISIONS OF THIS ORDINANCE AND THE INTENT
HEREIN EXPRESSED BY THE CITY MANAGER,
THE CITY ATTORNEY AND THE CITY PROSECUTOR;
PROVIDING FOR PROSPECTIVE APPLICATION ONLY,
PROVIDING FOR SEVER.ABILITY OF CONSTRUCTION
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Legislature at its 1970 Regular Session enacted
Chapter 70-279 which became effective when it was filed in the office of the
Secretary of State, which law changes some of the procedures regarding
chemical tests for persons charged with the offense of intoxication when
operating a motor vehicle and also requires that a jury trial be afforded
for offenses charged under said law; and
WHEREAS, the Legislature at the same Session enacted Chapter
1 70-372 which also became effective upon its filing with the Secretary of
State, which law requires a jury trial in Municipal Court for the trial of
a violation which "is also a state law"; and

WHEREAS. the implementation of the provisions of Chapter 70-372
will cause confusion, misunderstanding, and may result in discrimination
unless the right to a jury trial is extended to all offenses in Municipal
Court; and
WHEREAS, we believe that the extension of the right to a trial by
jury in Municipal Court will uphold and enhance the respect for said Court
and will aid in the overall desire for and administration of justice for all
without favor in our Municipal Court; and

NOW THEREFORE BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
AS FOLLOWS:
Section 1. Chapter 1 of the Code of Ordinances of the City of
Clearwater, Florida, 1962, is hereby amended by adding a new Section

Sec. 1-11. Surer Trial. L4 t 0 - _? 1??t
(al Demand and Waiver. Any person shall be entitled 3 to a trial by jury upon demand therefor made at or prior to `
the time of arraignment for any offense charged in Municipal ;?.
Court. Failure to make such demand not later than the time
of arraignment for such offense shall constitute a waiver of
such right to a jury trial, provided such person is advised of
his right to same and the consequences of his failure to make
demand therefor at the time of such arraignment by the Judge,
then presiding.
(b); Procedure. The number of jurors, their qualifications,
manner of selection, compensation, exemptions and all procedures
in connection therewith shall be the same as provided by general
law for petit jurors and juries in the trial of criminal offenses
against the State, provided, however, each such juror must
also be a resident of the City of Clearwater for at least six (6).
months and must be a qualified elector of the City of Clearwater.
Section 2. Provision shall, be made by the Municipal Judge for the
immediate implementation of this ordinance by the adoption and promulgation
of such rules and procedures as are determined appropriate to carry out
the intent and purposes of this ordinance.
Section 3. The City Manager, the City Attorney, and the City Prosecutor
shall assist in the implementation of the provisions of this ordinance and the
intent herein expressed including the development and implementation of
procedures necessary in the fulfillment of the purposes herein stated and of
the rules and procedures to be promulgated by the Municipal Judge.

Section 4. This ordinance is adopted under the power and authority
given the City under the provisions of Article VIII, Section 2 (b) of the
Florida Constitution of 1968 and laws implementing such provisions.
Section 5. This ordinance shall be liberally construed to carry out
the purposes and intentions herein stated. If any portion of this ordinance is
declared invalid, such declaration shall not affect the validity of any other
portion not thereby expressly also declared invalid.
Section 6. All ordinances, or parts of ordinances, in conflict
herewith are to the extent of such conflict hereby repealed.
Section 7. This ordinance shall be only prospective in its application
from its effective date and shall in no way affect the validity of any trial,
proceeding, or conviction before its effective date.
Section 8. This ordinance shall take effect immediately upon passage.
