ORDINANCE NO. 1265
AN ORDINANCE OF THE CITY OF CLEARWATER,
FLORIDA, REPEALING SECTION 10-13, DUTY TO
KEEP PREMISES CLEAN. OF C14APTER 10, GARBAGE,
'T'RASH AND WEEDS, OF THE CODE OF ORDINANCES,
CITY OF CLEARWATER, FLORIDA, 1962, AND
ENACTING A NEW SECTION 10-13 LISTING ITEMS
WHICH IT SHALL BE UNLAWFUL TO STORE IN THE
OPEN AND SETTING FORTH THE DUTY AND
RESPONSIBILITY OF EVERY OWNER OR OCCUPANT
OF COMMERCIAL OR RESIDENTIAL BUILDING, STRUCTURE
OR VACANT PROPERTY TO KEEP THE PREMISES
CLEAN AND TO REMOVE ALL ABANDONED ITEMS
LISTED, INCLUDING WEEDS, DEAD TREES, TRASH,
GARBAGE, ETC. UPON NOTICE FROM THE SUPER-
INTENDENT OF THE SANITATION DIVISION; PRO-
VIDING PENALTIES FOR THE VIOLATION OF THIS
ORDINANCE; REPEALING ALL ORDINANCES OR PARTS
OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING
FOR THE SEPARABILITY OF THE PROVISIONS HEREOF
AND PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA.
Section 1. That Section 10-13, Duty to Keep Premises Clean,
of Chapter 10, Garbage, Trash and Weeds, of the Code of Ordinances,
City of Clearwater, Florida, 1962, is hereby repealed in, its entirety
and a new Section 10-13 is hereby enacted to read as follows:
Sec, 10-13. Duty to keep premises clean.
{a) It shall be unlawful for the owner or occupant of a
commercial or residential building, structure or vacant
property to utilize the premises of such property for the
open storage of any abandoned motor vehicle, ice box,
refrigerator, stove, glass, building material, building
rubbish or similar items. It shall be the duty and
responsibility of every such owner or occupant to keep
the premises of such property clean and to remove from
the premises all such abandoned items as. listed above, in-
cluding but not limited to weeds, dead trees, trash,
garbage, etc. upon notice from the Superintendent of the
Sanitation Division or his duly authorized representative.
(b). For the purpose of this section, an abandoned motor
vehicle is defined as one that is in a state of disrepair and
incapable of being moved under its o,%m power.

r Section 2. All ordinances or parts of ordinances in conflict herewith
• are to the extent of such conflict hereby repealed.
Section 3. Any person who shall violate any provision of this ordinance
shall be subject, upon conviction in the Municipal Court, to a fine not
exceeding the sum of Five Hundred Dollars ($500. 00), or imprisonment in
the City Jail for not exceeding sixty (60) days, or by both such finer and
imprisonment in the discretion of the Municipal Judge,
Section 4. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 5. This ordinance shall become effective immediately upon
its passage.
