BE IT ORDAINED BY THE CITY COMMISSION OF TI-E CITY OF
CLEARWATER, FLORIDA:
Section 1. Section 9-10. 2, Fire Prevention Code, Amendments, of
the Code of Ordinances of the City of Clearwater, Florida, 1962, further amends
Section 28. 1, Bonfires and Outdoor Rubbish Fires, of the Fire Prevention
Code, 1965 Edition, to read as follows:
Section 28. 1. Bonfires and Outdoor Rubbish Fires.
a. Permit Required. No person shall kindle or maintain
any bonfire or rubbish fire or authorize any such fire to be
kindled or maintained on or in any public street, alley, road
or other public or private property within the corporate limits
of the City of Clearwater without first obtaining a permit or
other proper authorization from the Clearwater Fire Department.
During construction or demolition of buildings or structures
no waste materials or rubbish shall be disposed of by burning
on the premises or in the immediate vicinity without having
obtained a permit or other proper authorization.
b. Location Restricted. No person shall kindle or maintain
any bonfire or rubbish fire or authorize any such fire to be
kindled or maintained on any private land unless (11 the location
is not lees than 50 feet or some other distance approved by the
Clearwater Fire Department from any structure and (2)
adequate provision is made to prevent fire from spreading to t
any structure.

c. Attendance of Open Fires. Bonfires and rubbish fires
shall be constantly attended by a competent person until such
fire is extinguished. This person shall have a garden hose
connected to the water supply, or other fire extinguishing
equipment readily available for use.
d. Chief May Prohibit. The Chief of the Fire Department
may in his discretion prohibit any or all bonfires and outdoor
rubbish fires when atmospheric conditions or local circumstances
make such fires hazardous or constitute a public nuisance.
Section 2. Section 14-5, Bonfires, of the Code of Ordinances of the
City of Clearwater, Florida, 1962, is hereby repealed in its entirety.
Section 3. Any person, organization, society, association or
