WHEREAS, the City Commission of the City of Clearwater, Flcarida,
received a sworn petition from Safeway Builders, Inc. regiiRsting tho City
to annex a certain parcel of real estate hereinafter described, owned by it,
into the corporate limits of the City of Clearwater, Florida; and
WHEREAS, the City Commission, after due consideration of said
request for annexation, at a regular meeting held on January 5, 1970, voted
unanimously to accept said request and authorized the proper officials to
set up a public hearing thereon for the determination and establishment
of zoning and fire district classifications and to prepare an ordinance to annex
said parcel of real estate into the corporate limits of the City of Clearwater
in accordance with the provisions of Section 6 (d) of the Municipal Charter
of the City of Clearwater and the Laws of Florida; and
WHEREAS, on February 2, 1970, the City Commission of the City
of Clearwater, after proper public notice, held a public hearing for the
determination and establishment of zoning and fire district classifications
for said real property;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF TIME CITY OF CLEARWATER, FLORIDA:

Section 1. After its evaluation of all evidence presented at a proper
public hearing, the City of Clearwater, acting by and through its City
Commission, by the authority and under the provisions of Section 6 (d) of
the Municipal Charter of said City of Clearwater and the Laws of Florida,
and redefines the boundary lines of said City so as to include the following
described parcel of real property in Pinellas County, Florida, and to
establish zoning and fire district classifications therefor:
The East IN feet of the South 323 feet of the West 3/4
of the North 1/2 of the Northwest 1/4 of Section 23,
Township 29 South, Range 15 East,, Pinellas County,
Florida, together with all abutting streets.
The above described property is hereby zoned "R-4D"
(Multi-Family) and designated as Fire District No. 2.
There is hereby established on said above described tract
a minimum building setback of seventy-fire feet (751) on
the East side of said described property. Said building
setback line, as established, shall be indicated upon the
official zoning map of the City of Clearwater, Florida.
Section 2. The City Commission hereby formally and according to law
accepts the dedication of all easements, streets, parks, plazas, places, rights
of way and other dedications to the public which have heretofore been made by
plat, deed or user within the area so annexed.
Section 3. The City Engineer, the City Clerk and the Planning Director
are directed to include and set out and show upon the official zoning reap and
other official maps and records of the City of Clearwater the foregoing property
and the zoning and fire district classifications therefor.
Section 4. This ordinance shall become effective immediately
upon its passage and enrollment in the City of Clearwater Ordinance Book
and a certified copy thereof being recorded in the Office of the Clerk of the
Circuit Court of Pinellas County, Florida.
