OF THE PROVISIONS HEREOF: PROVIDING PENALTIES FOR THE'
VIOLATION OF THE TERMS OF THIS ORDINANCE AND PROVIDING
FOR THE EFFECTIVE DATE OF THIS ORDINANCE,
WHEREAS, the control and regulation of the construction and
erection of outdoor advertising display -- off premise (commercial
advertising) signs is a matter of vital interest and importance to the
safety, welfare and well-being of the citizens of the City of Clearwater;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF CLEARWATER, FLORIDA:
Section 1. That paragraph (5) Outdoor advertising display --
off-premise (commercial advertising), of Sub-Paragraph (C), Outdoor
Advertising Display Sign--Usage, of Section 18-6, Definitions, of
Chapter 18, Signs, of the Code of Ordinances of the City of Clearwater,
Florida, 1962, is hereby amended by adding thereto the following:
(C) Outdoor Advertising Display Sign--Usage,
(5) Outdoor advertising display -- off-premise (commercial
advertising). From the effective date of this Ordinance, no
permit shall be issued for the construction or erection of
any new outdoor advertising display -- off-premise (commercial
advertising) sign on any property presently within or
hereafter annexed into the corporate limits of the City
of Clearwater.

Section 2. Section 18.51 Outdoor advertising display; off premise, = v;`i
of Chapter 18, Signs, of the Code of Ordinances of the City of Clearwater,
Florida, 1962, is repealed in its entirety and a now Section 18-51 to
read as follows is enacted in place thereof:
Section. 18-51. Outdoor advertising display; off premise, }
(A) General Regulations.
(1) New construction. From the effective date of this Ordinance,
no permit shall be issued for the construction or erection of
any new outdoor advertising display -- off-premise (commercial
advertising) sign on any property presently within or here-

Clearwater.

(2) Permit for alteration of existing signs. No outdoor ?l

advertising display -- off-premise sign now existing shall
be altered or repaired unless a permit for said alteration
or repair is first obtained from the City Building Official.
(B) Outdoor advertising display -- off-premise sign identity : f
and directional only.
(1) Such sign shall advertise no product or specific service but
shall denote only identity of name and/or general business
activity which is located elsewhere than on the premises of
the sign.
(2) Such sign may be permitted in any business type zone
(includes PRS but not R-M or R-4). Applicati6n. shall
justify location in respect to logical route direction.
(3) Such sign if located in a PKB, PR.S, B, 1-iB or M Zone
shall conform to the following height and setback requirements:
(a) Ground sign Minimum setback: 3 feet from
existing or hereafter constructed building.
(b) Minimum setback from right of way: 15 feet in
B, HB, and M zones.
(c) Minimum setback from right of way: 40 feet in
PKB Zone on U. S. 19.
(d) Minimum setback from intersecting street curb
line: 50 feet.
(e) Minimum height to bottom: 3 feet.
(4) Such sign shall not exceed seventy-two (72) square feet in surface area. "

(5) Such sign, if located within one hundred (100) feet of a
corner right of way intersection shall not have any red or -;
green illuminated or luminescent portions. Also see Section
18-21 (a) and Section 18-31 (a) (6).

(2), -
(6) No outdoor advertising display -- off-premise identity and
directional sign shall be activated or flashing as defined.
(7) Outdoor advertising display off-premise identity and
directional signs shall be prhibited as a roof sign.
Section 3. All ordinances or parts of ordinances in conflict
herewith or inconsistent with the provisions of this ordinance are hereby
repealed to the extent of such conflict.
Section 4. Should any section, paragraph, sentence, phrase, clause
or other part or provision of this ordinance be declared by any court to be
invalid, the same shall not affect the validity of the ordinance as a whole,
or any part thereof, other than the part declared to be invalid.
Section 5. Any person or persons, firm or corporation or association
of persons who sha11 violate or fail to comply with any of the terms or
provisions of this ordinance shall, upon conviction in the Municipal Court,
be fined not exceeding the sum of Two Hundred Dollars ($200. 00), or im-
prisoned in the City Jail for not exceeding Sixty (60) days, or by both fine
and imprisonment in the discretion of the Municipal Judge. Each day that
a violation is permitted to exist shall constitute a separate offense.
Section 6. This ordinance shall take effect immediately upon its
passage. ,
