FLORIDA, AMENDING CHAPTER 7, BUILDINGS, ARTICLE
I, IN GENERAL, OF THE CODE OF ORDINANCES, CITY
OF CLEARWATER, FLORIDA, 1962, TO ADD A NEW
SECTION 7-6 THERETO TO REQUIRE ' THAT ALL LAND
THAT ABUTS A PUBLIC RIGHT OF WAY, WHICH IS TO '
HAVE NEW CONSTRUCTION ON ITo EITHER FOR
RESIDENTIAL, COMMERCIAL, INDUSTRIAL OR OTHER
PURPOSES, SHALL HAVE SIDEWALKS CONSTRUCTED
BY THE OWNER ON, ACROSS OR ADJACENT THERETO
AND SETTING FORTH THE REQUIREMENTS AND
PROCEDURES FOR THE ADMINISTRATION THEREOF;
PROVIDING FOR REPEAL OF ALL ORDINANCES OR
PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE
EXTENT OF SUCH CONFLICT; PROVIDING PENALTIES
FOR THE VIOLATION OF THIS ORDINANCE; PROVIDING
FOR THE SEPARABILITY OF THE PROVISIONS HEREOF;
AND PROVIDING FOR THE EFFECTIVE DATE OF THIS
ORDINANCE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Chapter 7, Buildings, Article I. In General, of the Code
of Ordinances, City of Clearwater, Florida, 1962, is amended to add a new
Section 7-6 to read as follows:
Section 7-6.
To secure safety from traffic and other dangers and to
promote the health, general welfare and safety of all
citizens, school children and other pedestrian traffic,
it is hereby required that all land within the corporate
limits of the City of Clearwater that abuts a public right
of way, which is to have new construction erected on it,
either for residential, commercial, industrial or other
purposes, shall have sidewalks constructed by the owner
on, across or adjacent thereto.
1. Plan Considerations.
Before any land in the City of Clearwater shall be
developed or structures of any type be erected thereon,
or building permit be issued by the Building Official,
there shall be submitted to the City Engineer a plan for
the construction of a sidewalk facility either upon the
property or the abutting public right of way. The City
Engineer shall approve such plan provided it shall meet
City construction specifications and shall adequately meet
the alignment for desirable, convenient and safe pedestrian
usage, including routes to existing schools or proposed
schools, the design and usage of abutting parking areas
and shall not adversely affect the proper drainage of
abutting properties.

2. Specifications and Construction.
The City Engineer shall review the plans and specifications
submitted and the sidewalk materials to be used, the design,
width and location shall all be in accordance with City :. %.
standards as established,

3. Schedule of Completion.
Such sidewalk construction shall be required to be completed
at the property ownerts expense before a certificate of occupancy ' ' :•
is issued for the building or structure on said property.
The certificate of occupancy may be issued if the sidewalk

4. Waiver of Re uirement.
The City Manager may in hie discretion determine that the
enforcement of the requirement for the installation of
sidewalks would be impracticable or would work an undue f '' !
hardship upon any property owner and may waive the require-
ment for the installation of sidewalks for a specific property
or properties.
Any person adversely affected by the decision of the City Manager
in waiving or not waiving the requirement for the installation of
sidewalks, may appeal such decision to the City Commission
of the City within ten (10) days after the decision of the City
Manager and the City Commission, if it determines that the
enforcement of the requirement for the installation of sidewalks
to be impracticable or would work an undue hardship, may
waive the said requirement for a specific property or properties.
Section 2. All ordinances or parts of ordinances in conflict Therewith
are to the extent of such conflict hereby repealed.
Section 3. Any person, organization, society, association or
corporation, or any agent or representative thereof who shall violate any
provisions of this ordinance shall, upon conviction in the Municipal Court,
be fined not exceeding the sum of Five Hundred Dollars ($500. 00) or imprisoned
in the City Jail for not exceeding sixty (60) days, or by both such fine and
imprisonment, in the discretion of the Municipal Judge,

Section 4. Should any sectionb paragraph, sentence or word of
this ordinance be declared for any reason to be invalid, the same shall not
affect the validity of the ordinance as a whole, or any part thereof other than
the part declared to be invalid.

Section 5, This ordinance shall become effective immediately
upon its passage.
