PARTS OF ORDINANCES IN CONFLICT HEREWITH TO 3 THE EXTENT OF SUCH CONFLICT; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; AND ' .' PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1, Section 17-8, Schedule of Service Rates, of Chapter 17, Sewers, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby repealed in its entirety and the following new section is hereby enacted: Section 17-8. Schedule of•Service Rates There is hereby established a maximum uniform schedule of rates and charges for the use;.or availability for use of the utility as follows: (a) Residential: Single Family Residences, Duplexes, Multi-Family Residences, Apartments, Mobile Home Parks and Condominiums Each one bathroom unit $3. 00/month For units with more than one bathroom 3. 50/month Hotels, Motels and Travel Trailer Parks shall be billed at 1107c of the domestic monthly water charge, with a minimum charge of $3. 00. Nan-Residential; (Including commercial, office buildings and industrial buildings) The basic charge for all accounts shall be equal to 11076 of the monthly water bill in effect for that size meter. However, the minimum charge for non-residential accounts shall be $3. 00, (c) Service Outside of the Municipal Limits: Accounts outside of the corporate limits of the City of Clearwater shall be subject to a surcharge equal to the amount of the monthly sewer bill, Section 2. Section 17-22, Time for Making Connections, of Chapter 17, Sewers, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby amended to read as follows: Sec. 17-22. Time for making connections. All presently existing buildings designed or used for human habitation or occupancy shall be connected to the sanitary sewer system of the City within ninety (90) days after the effective date of this ordinance, if sewer mains were available at the time Of such passage. When future extensions and additions to the sewer system make additional existing buildings available to said sewers, connections shall be made within ninety (90) days after such mains become available. The same test of availability found in Section 17-21 shall apply thereto. Proper sewer charges shall be billed after the expiration of said ninety (90) days whether said connection has been made or not. Section 3. Section 24-128, Rate Schedule of Article III, Water, of Chapter 24, Utility System, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby repealed in its entirety and the following new section is hereby enacted: Section 24-28, Rate Schedule Water rates under the different schedules shall be as follows: (a) Domestic (stores, offices, hotels, motels, multiple and single family residential premises and general business establishments) rates shall be the following, based on monthly consumption: CONSUMPTION CHARGE: First 400 cu, ft. or less, a minimum of $2.75 per month. Next 1000 cu. ft. @ $0. 37 per 100 cu, ft. All over 1, 400 cu, ft, @ $0. 25 per 100 cu, ft. MINIMUM BILLS. (c) Lawn or sprinkling rates, applying to customers who have had a separate meter and piping installed for the sole purpose of supplying water for lawn sprinkling or irrigation purposes and where there is no connection between said lawn sprinkling system and the water pipng serving the building or buildings on the premises, shall be as follows based on month consumption: CONSUMPTION CHARGE: 200 per 100 cu, ft. for all water used, MINIMUM BILL: For each customer billed under the lawn or sprinkling rate there shall be a monthly minimum charge of $3. 25 regardless of the y size of the meter, which minimum charge will allow and include the use of up to 1700 cubic feet of water per month, but any excess over said 1700 ` cubic feet per month shall be billed for said excess at the rate of twenty cents ($0. 20) per 160 cubic feet. Separate meters and service lines installed for lawn sprinkling purposes shall be at the property owners' expense at standard fees for such items as are installed by City employees. If at any time a customer desires to discontinue such sprinkling service, the City will shut off the line and remove the meter (if so desired) and allow a reasonable salvage price on the meter, based on 101o depreciation per year on said meter for each year in service. F-???.' •T.i ,i.."t,:,#:Y , I;= 0 W M 4W I (d) Service Outside of Municipal'Limits Accounts outside of the corporate limits of the City of Clearwater shall be subject to a surcharge equal to the amount of the monthly water bill. All connections to City mains and meter and installation to be charged to proper owner, application fees to be the same as set forth in Section 24-20 of this Chapter. (e) Special fire protection service for any building to be made at property owner's expense, for tapping and connection to outside curb line. Connection to curb to be made by water department and charged for at cost of material and labor. This service to be used for fire protection only, no other. connection other than fire hose to be allowed on this service, This service to be installed by approval of superintendent of water department, and all valves on hose connection to be sealed by him.' Valves to be opened only for testing same, and in case of fire within building, the superintendent of water department must be immediately notified when seals are broken and reseal same. Failure to comply with above rules will be punished by a discontinuance of free service, and a meter must be installed at property owner's expense, before such service will be resumed. Metered rate under schedule (b). The water department will not be responsible for any damage on account of failure of water supply from any cause. MONTHLY CHARGE: A monthly charge of $12. 50 shall be made for each six-inch connection to a private sprinkler system. No other size of connection will usually be made to such systems and additional capacity, if installed, will be subject to special rate determination. No charge will be made for water used. (f) An allowance will be made for invisible underground leakage, if unknown to the consumer, but no further allowance will be made after consumer is notified of such leakage. The allowance will be one-half of amount above the maximum allowance of three hundred cubic feet. (g) MISCELLANEOUS CHARGES: New Accounts: Connection Charge The connection charge for new accounts using a meter smaller than one-inch shall be $50. 00 if a new connection to the main is not required and $75. 00 in the event that the main must be tapped. Connection charges for services using one-inch or larger meters shall be equal to twice the actual cost of the meter if the main does not have to be tapped and to three times the actual cost of the meter if a new connection to the main is required. i¦ Im .a ? Deposits Each 5/84+ x 3/411 meter service shall be secured by a customer deposit of $20. 00. The deposit for other sizes of service shall be equal to three times the monthly minimum charge. Deposits may be refunded to owner-occupants after one year of satisfactory experience with the account. Restoration of Service to Voluntary Turned Off Accounts Domestic and Industrial accounts will be turned off and back on at the request of the occupant upon payment of Eight Dollars and Twenty-five cents ($8. 25). Restoration of Service to Turned Off Delinquent Accounts The charge for restoration of servicr shall be Eight Dollars and Twenty-five Cents ($8. 25) and the posting or reposting of a deposit as required for new accounts. (h) FIRE HYDRANT CHARGES; The City shall pay to the Utility Account the sum of Seventy-five Dollars ($75. 00) per year for each fire hydrant located within the City of Clearwater. Section 4. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 5. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 6. The rates as hereinabove set out shall be charged on all service rendered on and after September 1, 1969. Section V. This ordinance shall become effective immediately upon its passage.
