PERTAINING TO ZONING, OF CODE OF ORDINANCES,
CITY OF CLEARWATER, FLORIDA, 1962, AND AMENDING
THE ZONING MAP OF THE CITY OF CLEARWATER,
t FLORIDA, 1968, AS AMENDED, BY RECLASSIFYING AND
ZONING CERTAIN PROPERTIES AS DESCRIBED HEREIN;
BY ESTABLISHING ON U. S. HIGHWAY 19 A MINIMUM
BUILDING SETBACK OF FORTY FEET FROM THE EXISTING
RIGHT OF WAY FOR ALL ABUTTING PROPERTIES PRE-
SENTLY'IN OR SUBSEQUENTLY ANNEXED INTO THE CITY
LIMITS; BY AMENDING OFF-STREET PARKING REQUIRE-
MENTS TO REQUIRE ALL OFF-STREET PARKING AREAS
FOR MORE THAN FIVE VEHICLES TO BE BEAUTIFIED AND
LANDSCAPED IN ACCORDANCE WITH ESTABLISHED

HEREOF; BY PROVIDING PENALTIES FOR THE VIOLATION
OF THIS ORDINANCE AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
WHEREAS, on July 22, 1968, the City Commission of the City of
Clearwater, after proper public notice, held a public hearing on certain
proposed changes to the zoning ordinance and zoning map of the City of
Clearwater in accordance with procedure as established; and
WHEREAS, certain of the proposed changes and amendments to
the zoning ordinance and the zoning map were approved by the City
Commission after its evaluation of all evidence presented at the public
hearing;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. The following described properties in Clearwater,
Florida, are hereby classified and zoned as hereinafter indicated and

Section 2. Section 26-11, Location, Height and Area Regulations—
Setbacks, Lot 3-ize, Height, Area, of Code of Ordinances, City of Clearwater,
Florida, 1962, is hereby amended by adding a new subparagraph (15) to
read as follows:
(15) Notwithstanding the zone classification there shall be
established on U. S. Highway 19 from the northernmost -;r
City limits to the southernmost City limits a minimum
building setback of forty (40) feet from the existing right
of way. Such setback shall also be established and required
on all properties hereafter annexed and which are abutting
U. S. Highway 19 right of way from the Clearwater City

paragraph (g) to read as follows:
(g) The plans shall provide for erection along the property
line or lines separating said automobile service station
site property from any adjacent residential zoned or
used properties, of an opaque fence at least six (6) feet
in height, of construction, design and material to be
approved by the Building Official of the City of Clear-
water, to serve as a screen between said properties.
Section 5. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 6. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same,shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 7, Any person or persona, firm or corporation or association
of persons, who shall violate or fail to comply with any of the terms or
provisions of this ordinance shall, upon conviction in the Municipal Court,
be fined not exceeding the sum of Five Hundred Dollars ($500. 00), or
imprisonment in the City Jail for not exceeding sixty (60) days, or by
both such fine and imprisonment in the discretion of the Municipal ,fudge.
Each day that a violation is permitted to exist shall constitute a separate
offense.
