AN ORDINANCE OF THE CITY OF CLEARWATER,
FLORIDA, ANNEXING PORTIONS OF SECTION 9,
TOWNS141P 29 SOUTH, RANGE 16 EAST, PINELLAS
COUNTY, FLORIDA, AND CERTAIN LOTS IN DEL
ORO GARDENS SUBDIVISION, TOGETHER WITH ALL
ABUTTING STREETS, INTO THE CORPORATE LIMITS
OF THE CITY OF CLEARWATER, FLORIDA, AND
REDEFINING THE BOUNDARY LINES OF THE CITY
TO INCLUDE SAID ADDITION, ACCORDING TO THE
PROVISIONS OF THE CHARTER OF THE CITY OF
CLEARWATER, FLORIDA, AND THE LAWS OF
FLORIDA; AFTER PROPER PUBLIC NOTICE AND
PUBLIC HEARING THEREON, ESTABLISHING THE
ZONING USE DISTRICT CLASSIFICATION AND THE
FIRE DISTRICT CLASSIFICATION FOR SAID PROPERTY;
AND PROVIDING FOR THE EFFECTIVE DATE OF
THIS ORDINANCE.
WHEREAS, the City Commission of the City of Clearwater, Florida,
received a sworn petition from Kapok Tree Inn., Inc. and Baumgardner
Realty, Inc. requesting the City to annex certain parcels of real estate
hereinafter described, owned by them, into the corporate limits of the
City of Clearwater, Florida; and
WHEREAS, after due consideration of said request for annexation
the City Commission at a regular meeting held on September 18, 1967,
voted unanimously to accept said request and authorized the proper officials to
set up a public hearing thereon for the determination and establishment of
zoning and fire district classification and to prepare an ordinance to annex
said parcels of real estate into the corporate limits of the City of Clearwater
11 in accordance with the provisions of Section 6 (d) of the Municipal Charter
of the City of Clearwater and the laws of Florida; and
WHEREAS, on January 22, 1968, the City Commission of the City
of Clearwater, after proper public notice, held a public hearing for the
determination and establishment of zoning and fire district classification for
said real property;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:

Section 1. After its evaluation of all evidence prosented at a proper
public hearing, the City of Clearwater, acting by and through its City
Commission, by the authority and under the provisions of Section 6 (d) of
the Municipal Charter of said City of 'Clearwater and the Laws of Florida,
hereby annexes into the corporate limits of the City of Clearwater, Florida,
and redefines the boundary lines of said City so as to include the following
described parcels of real property in Pinellas County, Florida, and to establish
zoning and fire district classification therefor:
Parcel 1 - The East 333. 82 feet of the West 667. 64 feet
of the South 200 feet of the South-1/2 of the Southeast-1/4
of the Northwest-1/4 of Section 9, Township 29 South,
Range 16 East, Pinellas County, Florida, together with
all abutting streets.
The above described property is hereby zoned PUD-R (Planned Unit
Development Residential) and designated as
Fire District No. 2
AND
Parcel 2 - The West 333. 82 feet of the South 200 feet of
the South-1/2 of the Southeast-1/4 of the Northwest-1/4
of Section 9, Township 29 South, Range 16 East, Pinellas
County, Florida, together with all abutting streets.
The above described property is hereby zoned B
(Business) and designated as
Fire District No. 1
AND
Parcel 3 - Lots 17, 18, 31, 32 and 37, Del Oro Gardens
Subdivision according to the map or plat thereof as
recorded in Plat Book 45, page 74 of the Public Records
of Pinellas County, Florida, together with all abutting
streets.
The above described property is hereby zoned R-4 (multi-
Family) and designated as Fire District No. 2 except all of
Lot 37 is hereby zoned R-1-D (Single Family) and designated
as Fire District No. 2

ship 29 South, Range 16 East, less the North 150 feet
thereof (also known as Lot 53, Dal Oro Gardens Sub-
division), and also the South 593 feet of the North 603
feet of the East 275 feet of the Northwest- 1/4 of the
Southwest-1/4 of Section 9, Township 29 South, Range
16 East, Pinellas County, Florida; and also Lots 33, 34,
X35, 36 and 53 Del Oro Gardens Subdivsion according to
the map or plat thereof as recorded in Plat Book 45,
page 74 of the Public Records of Pinellas County, Florida,
together with all abutting streets.
The above described property is hereby zoned B
(Business) and designated as Fire District No, 1
Section 2, The City Engineer and the City Clerk are directed to
include and set out and show upon the official zoning map and other official
maps of the City of Clearwater the foregoing property and the zoning and
fire district classification therefor.
Section 3. This Ordinance shall become effective immediately
upon its passage and enrollment in the City of Clearwater Ordinance Book
and a certified copy thereof being recorded in the Office of the Clerk of the
Circuit Court of Pinellas County, Florida.

the City Commission at a regular meeting bold on September 18, 1967.
voted unanimously to accept said request and authorised the proper officials to
set up a public.bearing thereon for the determination and establishment of
