AN ORDINANCE OF THE CITY OF CLEARWATER
AUTHORIZING CONDEMNATION OF A CERTAIN
STORM DRAINAGE EASEMENT IN SKYCREST
i WITHIN THE CORPORATE LIMITS OF THE CITY OF
CLEARWATER; SAID EASEMENT TO BE ACQUIRED
FOR STORM DRAINAGE PURPOSES; DIRECTING
THE PROPER OFFICIALS TO FORTHWITH INSTITUTE
SUCH PROCEEDINGS; AUTHORIZING EXECUTION OF
NECESSARY DOCUMENTS, CHECKS FOR PAYMENT
OF MONEY, BONDS, PLEADINGS, OR OTHER PAPERS
INCIDENTAL OR REQUIRED IN ORDER TO COMPLETE
THE ACQUISITION OF SAID EASEMENT BY CONDEMNA-
TION; AND PROVIDING THAT THIS ORDINANCE SHALL
TAKE EFFECT IMMEDIATELY UPON ITS PASSAGE.
WHEREAS, the City of Clearwater has determined that an easement
is required for the storm drainage system in Skycrest within the City limits
of the City of Clearwater; and
WHEREAS, the Commission has been unable to acquire said
storm drainage easement; and
WHEREAS, the City's only means of completing said project is
by acquisition of said easement for said necessary storm drainage purposes,
by means of condemnation proceedings;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
1. That the appropriate officials of the City of Clearwater- are
hereby instructed and directed to obtain all necessary surveys and execute
all necessary instruments, documents, checks for payment of money,
bonds, pleadings and other papers which are incidental and necessary to the
institution of condemnation proceedings to acquire a permanent easement
from William J. Solomon and Margaret M. Solomon, his wife, 400 S. Arcturus
Avenue, Clearwater, Florida, which said permanent easement is described
as follows:
The South 5 feet of Lot Four (4) in Block "All of Skycrest
Unit 111311, according to the map or plat thereof as recorded
in Plat Book ZS, page 52 of the Public Records of Pinellas
County, Florida.

2. The City Attorney is hereby instructed to institute condemnation
proceedings in the Circuit Court of the Sixth Judicial Circuit of the State of
Florida for the purpose of acquiring said easement at the earliest possible
moment for storm drainage purposes.
3. Any and all irregularities in procedure, description or other
matters which may have occured to date of this Ordinance are hereby
corrected, ratified and confirmed.
14. This Ordinance shall take effect imtnediately upon its
passage.
