ORDINANCE NO.. 1128
AN ORDINANCE PROVIDING FOR A SPECIAL ELECTION
ON NOVEMBER 21, 1967, FOR THE PURPOSE OF DE-
TERMINING WHETHER OR NOT CHAPTER 67-1216,
SPECIAL ACTS OF FLORIDA OF. 1967, RELATING TO THE
EXTENSION OF THE TERMS OF OFFICE FOR THE
MAYOR-COMMISSIONER AND THE COMMISSIONERS
OF THE CITY OF CLEARWATER FROM TWO TO FOUR
YEARS, SHALL BE RATIFIED; AND ALSO FOR THE
PURPOSE OF DETERMINING WHETHER CERTAIN
DESCRIBED UNINCORPORATED PROPERTY SHALL BE
ANNEXED INTO THE CORPORATE LIMITS OF THE CITY
OF CLEARWATER, FLORIDA, PURSUANT TO CHAPTER
171, 04, FLORIDA STATUTES, 1965; PROVIDING FOR
REGISTRATION AND QUALIFICATION OF ELECTORS;
PROVIDING FOR THE MANNER AND CONDUCT OF SAID
ELECTION; PROVIDING FOR THE DESIGNATION OF
POLLING PLACES AND OFFICIALS IN CONNECTION WITH
SAID ELECTION; PROVIDING FOR PUBLICATION OF NOTICE
OF THE PURPOSE OF SAID ELECTION, THE POLLING
PLACES AND THE CLASS OF PERSONS ELIGIBLE TO VOTE
THEREIN; PROVIDING FOR DETERMINING THE RESULTS
OF SAID ELECTION AND CERTIFYING SAID RESULTS TO
THE SECRETARY OF STATE AND PROVIDING FOR THE
EFFECTIVE DATE OF THIS ORDINANCE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. That a special election,ahall be held in the manner herein
provided and according to appropriate ordinances and laws of the City of
Clearwater and State of Florida, on Tuesday, November 21, 1967, for
the purpose of determining whether or not Chapter 67-1216, Special Acts
of Florida of 1967, shall be ratified, said Act relating to the extension of
the terms of office for the Mayor-Commissioner and the Commissioners
of the City of Clearwater from two to four years, and also for the purpose
of determining whether certain described unincorporated property shall be
annexed into the corporate limits of the City of Clearwater, Florida, pursuant
to Chapter 171. 04, Florida Statutes, 1965,
Section 2. At said special election, Chapter 67-1216, Special
Acts of Florida, 1967, pertaining to the extension of the terms of office

. election. Registration books for the purpose of said election shall be

Section 3. At said special election, the proposed annexation of

certain described unincorporated property into the corporate limits of the
City of Clearwater shall be submitted to a separate vote of the qualified
electors residing in the City of Clearwater, as presently constituted, and
of the qualified electors residing in each separate area which would be
annexed into the City of Clearwater after referendum approval of said
annexation. To be qualified, said electors shall be registered as such
according to law as evidenced by the records of the Supervisor of Registration
of Pinellas County, Florida, and as shown on the certified list thereof or
as shown by the books of said Supervisor fifteen (15) days prior to said
election. Registration books for the purpose of said election shall be closed
thirty (30) days prior to and exclusive of the election date. Separate polling
places shall be provided for the registered electors voting in the City and
for the registered electors voting in the areas proposed to be annexed, and
the vote in the City and in the areas proposed to be annexed shall be
independently counted.
Section 4. The list so certified and/or the books submitted by the
County Supervisor of Registration shall be open to public inspection at the
office of the City Clerk or office of said Supervisor; and it shall not be
necessary to otherwise publish the names listed thereon,

Fy?i Section 5. The City Commission shall cause to be published in a
newspaper of general circulation in the City once a week for two (2) con-
secutive weeks a notice stating the purpose of the election, the polling places,
and the class of persons eligible to vote therein, the first publication to be
at least ten (10) days before the date of the election. N
Section 6. Absentee voting shall be allowed and where practicable
the provisions of Section 101. 62 - 101. 70 inclusive, Florida Statutes, 1965,
as amended, shall be followed in connection therewith.
Section 7. Votes in such election shall be cast at polls as hereafter
designated by the City Commission, with notice thereof being given as
hereinabove provided. The polls shall open at 7 o'clock A. 14. Eastern
Standard Time and close at 7 o'clock P. M. Eastern Standard Time, on the
date of such election.
Section 8. Inspectors and Clerks of the election shall be appointed
by the City Commission, except that if the Commission shall fail to appoint
the same at least seven (7) days before the date of the election, the Mayor-
Commissioner of the City of Clearwater shall appoint them. Where
possible, Inspectors and Clerks shall be residents of the precinct in which
they are serving.
Section 9. Voting machhies shall be used and on all voting machines
for those voting within the corporate limits of the City of Clearwater, as
presently constituted, the ballot shall contain the following questions and be
in the following form:

Clearwater, Florida, one time at least ten (10) days prior to said election.
Section 12. The results of the voting shall be certified by returns
in duplicate signed by the Clerk and amajority of the election inspectors.
k Yiy One copy of such return shall be delivered to the Mayor-Commissioner and
r the other copy to the City Clerk, both of whom shall transmit such returns
sk ?S' to the City Commission at a meeting to be held at 12 otclock noon Eastern
Standard Time on the day following the election. At such meeting the City

Commission shall canvass the returns and shall independently total the
vote for and against the passage of said Special Act and the proposed
annexation into the City of Clearwater of each of said separate areas. Said
Special Act shall be effective upon its ratification by a majority of those
persons qualified as aforesaid and actually voting thereon. If said proposed
annexation is approved by a majority of those persons qualified as afore-
said and actually voting both (1) in said City and (2) in the separate areas
to be annexed, the City shall proceed to formally annex the property in
said separate areas as approved into the corporate limits of the City of
Clearwater pursuant to Chapter 171. 04, Florida Statutes.
