AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING CHAPTER 18, PERTAINING TO SIGNS, OF THE
CODE OF ORDINANCES, CITY OF CLEARWATER, FLORIDA,
1962. BY CLARIFYING DEFINITION OF SURFACE AREA;
BY SETTING FORTH DATE OF EXPIRATION OF A SIGN
PERMIT APPLICATION; BY SETTING FORTH REQUIRE -
IVIENTS FOR CHANGES IN APPLICATION FOR A PERMIT;
BY ESTABLISHING REQUIRED VERTICAL DISTANCE
FOR A PERMANENT LADDER ATTACHED TO A SIGN
STRUCTURE; BY SETTING FORTH REQUIREMENTS FOR

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Sub-section (A) (5), Surface area, of Section 18-6,
Definitions, of the Code of Ordinances, City of Clearwater, Florida, 1962,
is amended to read as follows:
(A) GENERAL TERMS
(5) Surface area shall mean the area of the surface of
the sign upon, against or through which the message
is displayed or illustrated on the sign. Such area
shall be that total surface of one common sign structure
which may be viewed from one direction of approach.
Such surface area is exclusive of frame embellishment
considered as border and not for the purpose of transmission
of message, which additional frame surface shall not he
greater than 307c of total gross area.
Section 2. Section 18-7, Permits, all signs, of the Code of Ordinances,

City of Clearwater, Florida, 1962, is amended by adding thereto a new
Sub-section (5) under Sub-section (a), Procedures, to read as follows:
(a) Procedures
(5) Any sign application shall become void 180 calendar
days after the date of approval of such application. One
90 day extension may be granted by the Building Official
provided substantial evidence is shown that such extension
should be granted.
and said Section 18-7, Permits, all signs, is further amended by repealing
Sub-section (b) thereof, Liability insurance, and enacting a new Sub-section
(b) to read as follows:

(b) Validity of Permit - changes in application;;
(1) Any change of location of an Off Premise Sign on the property
or to abutting property or properties as shown in an applica-
tion
shall make invalid that application, and shall require
submission of a new application and s4'

submission.

(2) Any change in design or structural elements submitted shall
be considered as an amendment to an existing application
and shall not void eligibility status of said existing applica-
tion or permit on record. Such permit shall therefore s
retain its original eligibility date.
Section 3. Sub-section (a) (2), Interference with public, of
Section 18-21, Regulations Governing Signs' Generally, of the Code of
Ordinances, City of Clearwater, Florida, 1962, is amended to read
as follows:
(a) Interference with Public
(2) Safety Requirements
(a) No sign shall be erected or maintained at any location
in such a manner as to obstruct free and clear vision
at the intersection of any streets or other public ways.
No sign shall be erected or maintained at any location
where by reason of the position, illumination, shape
or color it may interfere with, obstruct the view of
or be confused with any authorized traffic sign, signal
or device, nor shall it snake use of the words "STOP",
"LOOK"s InANGER", or any other word, phrase,
symbol or character in such a manner as to interfere
with, mislead, or confuse traffic.
(b) The lowest rung of any permanent ladder attached to
any sign structure shall be located a minimum of 10
feet vertical distance above existing grade.
Section 4. Sub-section (h) (2), Service Station, Products and
Services Sign, of Section 18-41, Outdoor Advertising Display; On Premise,
of the Code of Ordinances, City of Clearwater, Florida, 1962, is hereby
repealed and a new Sub-section (2) is enacted in lieu thereof to rmd as
follows:

(2) IDENTIFICATION, PRODUCT AND/OR SERVICES SIGN
Ground sign, roof, wall or projecting sign.
Maximum number of signs - 2 - of which the total
combined surface area shall not exceed 150 square feet.
25 feet from right of way
Height Maximum 40 feet (top)
Section 5. All ordinances or parts of ordinances in conflict herewith
are to the extent of said conflict hereby repealed.
Section 6. Should any section, paragraph, sentence, phrase, clause
or other part or provision of this Ordinance be declared by any Court to be
invalid, the same shall not affect the validity of the Ordinance as a whole,
or any part thereof, other than the part declared to be invalid.
Section 7. Any person or persons, firm or corporation or association
of persons who shall violate or fail to comply with any of the terms or

provisions of this Ordinance shall, upon conviction in the Municipal Court,
be fined not exceeding the sum of Two Hundred Dollars ($200. 00), or
imprisoned in the City Jail for not exceeding Sixty (60) days, or by both
fine and imprisonment in the discretion of the Municipal Judge. Each
day that a violation is permitted to exist shall constitute a separate offense.
Section 8. This Ordinance shall take effect immediately upon
its passage.
