ORDINANCE NO. 1089
AN ORDINANCE AMENDING SUB-SECTION (B), EARLY
RETIREMENT OF SECTION Z-24, SUPPLEMENTARY
POLICE PENSIONS AND RETIREMENT, OF CODE OF
ORDINANCES, CITY OF CLEARWATER, FLORIDA, 1962,
TO PROVIDE THAT A POLICE OFFICER MAY, IF
REQUIRED BY OTHER APPLICABLE PENSION LAWS
AND REGULATIONS OF THE CITY, RETIRE AT AGE
SIXTY-FIVE BUT PRIOR TO COMPLETING TEN YEARS
OF CONTRIBUTING SERVICE UNDER THE SUPPLEMENTARY
POLICE PENSION PLAN; REPEALING ALL ORDINANCES OR
PARTS OF ORDINANCES IN CONFLICT HEREWITH; PRO-
VIDING FOR THE SEPARABILITY OF THE PROVISIONS
THEREOF AND PROVIDING AN EFFECTIVE DATE.

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER. FLORIDA:
Section 1. That Sub-Section (B), Early Retirement, of Section
2-24 of the Code of Ordinances, City of Clearwater, Florida, 1962, be
amended to read as follows;
Sec. 2-24. Supplementary Police Pensions and Retirement—
Normal, early and disability retirement; effect of
re-employment by City
(B) Early retirement
(1) A police officer may retire prior to attaining age 65
in accordance with the provisions of Chapter 185 of
the Florida Statutes.
(2)A police officer may also retire upon attaining age 65,
but prior to completing 10 years of contributing service
under said plan, if required to retire at age 65 by other
applicable pension laws and regulations of the City of
Clearwater.
(3)Appropriate discount percentages and procedures are
provided in the master insurance contracts to reduce the
amount of retirement income available at retirement
ages younger than 65 or earlier than the normal retirement
date for said participant.
Section 2. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 3. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
