AN ORDINANCE OF THE CITY OF CLEARWATER
AUTHORIZING CONDEMNATION OF NECESSARY RIGHT
OF WAY FOR MYRTLE AVENUE AND RAILROAD
AVENUE WITHIN THE CORPORATE LIMITS OF THE
CITY OF CLEARWATER; SAID PROPERTY TO BE ACQUIRED
FOR STREET RIGHT OF WAY, AS WELL AS ALL OTHER
INCIDENTAL MUNICIPAL PURPOSES NECESSARY OR
PERTAINING THERETO; DIRECTING THE PROPER
OFFICIALS TO FORTHWITH INSTITUTE SUCH PRO-
CEEDINGS; AUTHORIZING EXECUTION OF NECESSARY
DOCUMENTS, CHECKS FOR PAYMENT OF MONEY,
BONDS, PLEADINGS, OR OTHER PAPERS INCIDENTAL
OR REQUIRED IN ORDER TO COMPLETE THE ACQUISITION
OF SAID PROPERTY BY CONDEMNATION; AND PRO-
VIDING THAT THIS ORDINANCE SHALL TAKE EFFECT
IMMEDIATELY UPON ITS PASSAGE.
WHEREAS, the City of Clearwater has determined that the right
of way for Myrtle Avenue and Railroad Avenue within the corporate limits
of the City of Clearwater is necessary in order to expedite and facilitate
movement oftraffic; and
WHEREAS, the Commission has been unable to acquire the
necessary right of way for said streets; and
WHEREAS, the City's only means of completing said project is
by acquisition of property in fee simple for said necessary right of
way, by means of condemnation proceedings;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
1. That the appropriate officials of the City of Clearwater are
hereby instructed and directed to obtain all necessary surveys and execute
all necessary instruments, documents, checks for payment of money,
bonds, pleadings and other papers which are incidental and necessary to the
institution of condemnation proceedings to acquire the property in fee
simple, described as follows:

Lot 12 of an unnumbered Block in Palm Park Addition to
Clearwater, according to the map or plat thereof as recorded
in'Plat Book 4, page 86 of the Public Records of Hillsborough
County, Florida, of which Pinellas County was formerly
a part, LESS: Begin at the Southeast corner of said Lot 12;
thence North 50 feet along the East lot line; thence West 66.7
feet along the North lot line; thence Southerly 52. 97 feet to
a point on the South lot line which is 85 feat West of the P. 0. B. ;
thence East 85 feet to P. O. B.; ALSO LESS: Begin at the
Southwest corner of NW-1/4 of Section 10, Township 29 South,
Range 15 East and run thence N 0010104" E, along the West
line of said Section 10, 505. 0 feet for the P. O. B. ; thence
continue N 001010411 E, along said West Section line, 8.41
feet; thence N 18'042'591' E, along the East right of way line
of the Atlantic Coast Line R. R. , 43. 79 feet; thence S 890
3213011 E, 16. 07 feet; thence S 001010411 W, 42. 0 feet; thence
S44 041t0811 E, 11. 34 feet; thence N 89032130'1 W, along the
North line of Palm Bluff Street, 38. 0 feet to the P. O. B.
Containing 3, 800 square feet more or less,
which said land belongs to Isabell Brown, a widow.
2. The City Attorney is hereby instructed to institute condemnation
proceedings in the Circuit Court of the Sixth Judicial Circuit of the State of
Florida for the purpose of acquiring said parcel at the earliest possible
moment for street right of way and other municipal purposes.
3. Any and all irregularities in procedure, description or other
matters which may have occured to date of this Ordinance are hereby
corrected, ratified and confirmed.
4. This Ordinance shall take effect immediately upon its
passage.
