REFUSE SERVICE, OF CHAPTER 10, QARBALIE , TRASH
OF THE CODE OF ORDINANCES, CITY OF
AND WEEDS

IN THE CITY; PROVIDING PENALTIES FOR THE VIOLATION '
OF THIS ORDINANCE; REPEALING ALL ORDINANCES OR
PARTS OF ORDINANCES IN CONFLICT HEREWITH;
PROVIDING FOR THE SEPARABILITY OF THE PRO-
VISIONS HEREOF AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDAt
Section 1. That Section 10-3 of Article I, Refuse Service, of
Chapter 10, Garbage, Trash and Weeds, of the Code of Ordinances,
City of Clearwater, Florida, 1962, is hereby amended to read as follows:
Sec. 10-3. Collectors, authorized.
(1) Collection by City. All refuse accumulated in the city
shall be collected, conveyed and disposed of by the city govern-
ment. No person shall collect, convey over any of the streets
or alleys of the city, or dispose of, any refuse accumulated
in the city without a written contract or permit.
(2) Exception for actual producers. This article shall not
prohibit the actual producers of refuse, or the owners of
premises upon which refuse has accumulated, from personally
collecting, conveying and disposing of such refuse, pro-
vided such producers or owners comply with the provisions
of this article and with all other governing laws and ordinances.
(3) Exce Lion far outside collectors. This article shall not
prohibit collectors of refuse from outside of the city from
hauliiag such refuse over city streets prescribed by the refuse
superintendent, provided such collectors comply with the
provisions of this article and with all other governing laws
and ordinances.
Section 2. Any person violating any provision of this ordinance
upon conviction thereof shall be subject to a fine not to exceed One Hundred
Dollars ($100. 00) or imprisonment for a period not to exceed thirty (30)
days or both, in the discretion of the Judge of the Municipal Court. Each
day a violation of this ordinance continues after conviction hereof shall
constitute a separate offense.

Section 3. All ordinances or parts of ordinances in conflict herewith
or inconsistent with the provisions of this Ordinance are hereby repealed to
the extent of their conflict, specifically Ordinance No., 773, as amended.
r Section 4. Should any section, paragraph, sentence, phrase,' clause
or other part or provision of this ordinance be declared by any court to be
invalid, the same shall not affect the validity of the ordinance as a whole, or
any part thereof, other than the part declared to be invalid. '
Section S. This ordinance shall become effective immediately upon
its passage.
