AN ORDINANCE REPEALING SECTION 22-50 OF CHAPTER 22 OF THE CODE OF ORDINANCES, CITY OF CLEARWATER, FLORIDA, 19621 AND ENACTING A NEW SECTION 22-50 PROHIBITING THE USE OF DRIVEWAYS OF CORNER PREMISES FOR MAKING A TURN AT THE INTERSECTION; PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS THEREOF AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. That Section 22-50 of Chapter 22 of the Code of Ordinances, City of Clearwater, Florida, 1962, be repealed in its entirety and a new Section 22-50 is hereby enacted to read as follows: Sec. 22-50. Use of Driveways of Corner Premises. It shall be unlawful for the driver of any vehicle to use the driveway of any premises located on any corner in the City of Clearwater for the purpose of making a turn at said intersection. Section 2. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 3. Any person who shall violate any provision of this Ordinance shall be subject, upon conviction in the Municipal Court, to a fine not exceeding the sum of Five Hundred Dollars ($500. 00), or imprisonment in the City Jail for not exceeding sixty (60) days, or by both such fine and imprisonment in the discretion of the Municipal Judge. Section 4. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 5. This ordinance shall become effective immediately upon its passage.
