AN ORDINANCE AMENDING CHAPTER 26, AS AMENDED,
PERTAINING TO ZONING, OF CODE OF ORDINANCES,
CITY OF CLEARWATER, FLORIDA, 1962, AND AMENDING
THE ZONING MAP OF THE CITY OF CLEARWATER,
FLORIDA, 1964, AS AMENDED, BY RECLASSIFYING AND
ZONING CERTAIN PROPERTIES AS DESCRIBED HEREIN;
BY REDESIGNATING SAID ZONING MAP, AS AMENDED,
AS "THE ZONING MAP OF THE CITY OF CLEARWATER,
FLORIDA, or 196611; BY DELETING FROM THE CRITERIA
FOR A DRIVE -IN THEATER THE REQUIREMENT THAT
SAID THEATER NOT BE WITHIN FIVE HUNDRED FEET
OF A RESIDENTIAL DISTRICT; PROVIDING FOR REPEAL
OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH TO THE EXTENT OF SUCH CONFLICT; PRO-
VIDING FOR THE SEPARABILITY OF THE PROVISIONS
HEREOF; PROVIDING PENALTIES FOR THE VIOLATION OF
THIS ORDINANCE AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
WHEREAS, on January 24, 1966, the City Commission of the City
of Clearwater, after proper public notice, held a public hearing on certain
proposed changes to the zoning ordinance and zoning map of the City of
Clearwater in accordance with procedure as established; and
WHEREAS, certain of the proposed changes and amendments to
the zoning ordinance and the zoning map were approved by the City
Commission after its evaluation of all evidence presented at the public
hearing;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. The following described properties in Clearwater,
Florida, are hereby classified and zoned as hereinafter indicated and
"The Zoning Map of the City of Clearwater, Florida of 196411, as amended,
is amended to indicate that fact as hereinafter set out:
(A) Zoned as R-2 - Duplex
The North 330 feet of the West 1/2 of SE-1/4 of
SW-1/4 of Section 14, Township 29 South, Range 15
East, less street right of way.

Chapter 26 of Code of Ordinances, City of Clearwater, Florida, the
City zoning ordinance and law, as amended, is hereby amended in each rA
instance in which a zoning map is referred to by providing that such zoning 'j
map shall be the zoning map of 1966. The City Engineer is hereby authorized }
and directed to prepare The Zoning Map of 1966 in separate sheets, each

date of this Ordinance.
Section 3. Section 26-17 (11), BOARD OF ADJUSTMENT AND
APPEAL, of Code of Ordinances, City of Clearwater, Florida, 1962, is
amended to read as follows:

(11) A drive-in theater in an HB, Heavy Business or
M, Manufacturing zone provided that the following
criteria for area, location, traffic and performance
be met;
Area shall not be less than six (6) acres, not located
on a major highway but on a secondary, road,, connecting
to a major highway. No part of such theater shall be
within 50 feet of a road right of way. Theater screen
shall not face a major highway.
Traffic. There shall be one (1) entrance for each
access road with one (1) ticket gate for each 250
capacity. There shall be acceleration and deceleration
lanes provided as well as separate entries for right
and left turns where arrival volume is equally divided
by direction. Separate storage of vehicles off access
road shall be provided in an amount equal to ten per
cent of theater capacity.
Development. Surface treatment, lighting and
drainage systems shall be approved by the office of
the city engineer.
Section 4. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 5. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not
affect the validity of the ordinance as a whole, or any part thereof other
than the part declared to be invalid.
Section 6. . Any person or persons, firm or corporation or association
of persons, who shall violate or fail to comply with any of the terms or
provisions of this ordinance shall, upon conviction in the Municipal Court,
be fined not exceeding the sum of Two Hundred Dollars ($200. 00), or
imprisonment in the City Jail for not exceeding sixty (60) days, or by
both such fine and imprisonment in the discretion of the Municipal Judge.
Each day that a violation is permitted to exist shall constitute a separate
offense.
