WHEREAS, the City Commission of the City of Clearwater, Florida,
has caused its ordinances of a general and permanent nature relating to gas
to be compiled and revised and the same are embodied in a compilation,
addition and revision thereof, known as "The Gas Code of the City of Clearwater,
Florida, 1965".
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
ORDINANCE NO. 1070
AN ORDINANCE OF THE CITY OF CLEARWATER, ADOPTING
"THE GAS CODE OF THE CITY OF CLEARWATER, FLORIDA,
196511, PROVIDING FOR THE REPEAL OF ORDINANCE NO.
666 OF THE CITY OF CLEARWATER, INCLUDING THE GAS
CODE OF THE CITY OF CLEARWATER, FLORIDA, 1960;
?..,.1 PROVIDING FOR THE REGULATION, ADMINISTRATION
AND ENFORCEMENT OF THE LAWS OF THE CITY OF
CLEARWATER RELATING TO GAS; REPEALING ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH; PROVIDING FOR THE REPEAL OF ALL PRO-
VISIONS OR PARTS OF PROVISIONS OTHERWISE CONTAINED
IN "THE CODE OF ORDINANCES, CITY OF CLEARWATER,
FLORIDA, 196211 IN CONFLICT HEREWITH; PROVIDING FOR
PENALTIES FOR THE VIOLATION OF THIS ORDINANCE;
PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS
HEREOF AND PROVIDING THAT THIS ORDINANCE, TO-
GETHER WITH SAID GAS CODE, TAKE EFFECT IMMEDIATELY
UPON ITS PASSAGE,
Section 1. That Section 1 through Section 11 of the Gas Code of the
City of Clearwater, Florida, 1965, being Pages 1 through 12 inclusive, are
ordained, adopted and incorporated by reference as fully as if set out at length
herein as "The Gas Code of the City of Clearwater, Florida, 1965", and shall
be cited as such. That from and after the adoption of this Ordinance, all
installations of gas, pipes, fixtures, appliances and other equipment or
appurtenances shall be installed only in accordance with the standards and
specifications as set forth in "The Gas Code of the City of Clearwater,
Florida, 1965.11
Section 2. That all provisions of "The Gas Code of the City of
Clearwater, Florida, 196511 shall be in force and effect on and after
December 6, 1965, and all ordinances of a general and permanent nature
relating to Gas which are not contained in "The Gas Code of the City of

I Clearwater, Florida,-1965", in conflict herewith are hereby repealed from

+x { and after December 6, 1965, Ordinance No 866 of the City of Clearwater

Section 3, That the repeal provided for in the preceding section,
of this Ordinance shall not affect any offense or act committed or done or
any penalty or forfeiture incurred or any contract or right established or
accruing- before December 6, 1965, nor shall such repeal affect any ordinance
or resolution promising or guaranteeing the payment of money for the City

or resolution of the Commission on any person,' firm or corporation; nor
shall it affect the Building Code, the Electrical Code nor the Plumbing Code;

nor shall it affect any prosecution, suit or other proceeding pending or any
judgment rendered on or prior to December 6, 1965.
Section 4. Any person, organization, society, association or
corporation, or any agent or representative thereof who"shall violate any
provision'of this Ordinance shall be subject, upon conviction in the Municipal
Court; to a fine hot exceeding the sum of Five Hundred Dollars ($500. 001,.
or imprisonment in the City Jail for not exceeding sixty (60) days, or by
both such fine and imprisonment in the discretion of the Municipal Judge.
Any violation of the provisions of this Ordinance may also be grounds for the
City of Clearwater to suspend or revoke the offending party's contractor's or
sub-contractor's license issued by the City of Clearwater. Each day's
continuance of any violation of this Ordinance shall constitute a separate
offense. The imposition of one penalty for any violation shall not excuse
the violation or permit it to continue; and all such persons shall be required '
to correct or remedy such violations or defects within a reasonable time.

Section 5` Sha?al$ any section, paragraph, sentence, phrase, clause,
or other part or provision of this Ordinance or "The Gas Code of the City
of Clearwater, Florida, 196510 be declared by any court to be invalid, the same
shall not affect the validity of this Ordinance or 'The Gas Code of the City
of Clearwater, Florida, 196511 as a whole, or any part thereof, other than
the part declared to be invalid.
Section 6. Three copies of "The Gas Code of the City of Clearwater,
Florida, 196511, having been kept on file not less than ten (10) days prior to
passage hereof in accordance with Florida Statutes, Section 165. 191, shall
be retained in the office of the City Clerk and be made available to persons
desiring to examine the same, .
Section 7. This Ordinance shall take effect immediately upon its
passage.
