AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING ARTICLE II, PERTAINING TO OPERATION OF
VEHICLES, OF CHAPTER 22, PERTAINING TO TRAFFIC,
OF THE CODE OF ORDINANCES, CITY OF CLEARWATER,
FLORIDA, 1962, BY ADDING ANEW SECTION 22-42.1
SPECIFICALLY DEFINING AND SETTING FORTH THE OFFENSE
OF CARELESS DRIVING, AND REPEALING SECTION 22-73,
SLOWLY MOVING VEHICLES, IN LTS ENTIRETY AND EN-

CLEARWATER, FLORIDA:
Section 1. Article 11, pertaining to Operation of Vehicles, of r ; y

Chapter 22, pertaining to Traffic, of the Code of Ordinances, City of
Clearwater, Florida, 1962, is hereby amended by adding thereto new
Section, 22-42. 1 to read as follows:
Sec. 22-42. 1 - Careless driving.
Every person operating a vehicle upon the streets within this
municipality shall drive the same in a careful and prudent
manner, having regard for the width, grade, curves, corners,
traffic and use of these streets and all other attendant cir-
cumstances, so as not to endanger the life, limb-.or property
of any person. Failure to drive in such manner shall constitute
careless driving and a violation of this ordinance.
Section 2. Article II, pertaining to operation of Vehicles, of
Chapter 22, pertaining to Traffic, of the Code of Ordinances, City of
Clearwater, Florida, 1962, is hereby further amended by repealing
Section 22-73, Slowly Moving Vehicles, in its entirety, and enacting a
new Section 22-73 to read as follows:
Sec. 22-73 - Minimum speed regulation; obstructing traffic.
(1) No person shall drive a motor vehicle on any street at such
a slow speed as to impede or block the normal and reasonable
forward movement of traffid, except when a reduced speed shall
be necessary for safe operation of such vehicle or in compliance
with law.
(2) If any person shall drive a motor vehicle at a speed so slow
as to impede the forward movement of traffic proceeding immediately
behind such vehicle, on any street whereon a higher speed shall
be lawful, then said person shall, when the width of the roadway
permits, drive to the extreme right side of the street until such
impeded traffic shall have passed by.

Section 3. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 4. Any person who shall violate any provision of this
Ordinance shall be subject, upon conviction in the Municipal Court, to a
fine not exceeding the sum of Five Hundred Dollars ($500. 00), or imprison-
ment in the City Jail for not exceeding sixty (60) days, or by both such fine
and imprisonment in the discretion of the Municipal Judge.
Section 5. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 6. This ordinance shall become effective immediately upon
its passage.
