WHEREAS; on April 26, 1965, the City Commission of the
City of Clearwater, after proper public notice, held a public hearing
on certain. proposed changes to the zoning ordinance and zoning map
of the City of Clearwater in accordance with procedure as established;
and
WHEREAS, certain of the proposed cbanges and amendments
to the zoning ordinance and the zoning map were approved by the City
Commission after, its evaluation of all evidence presented at the
public hearing;

COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. The following described properties in Clearwater,
,Florida, are hereby classified and zoned as hereinafter indicated and

amended, is amended to indicate that fact as hereinafter set out:

Section 4. Section 26-6A (3), USE REGULATIONS--1'1311
BUSINESS DISTRICT--PROHIBITED USES, of Code of Ordinances,
City of Clearwater, Florida, 1962, is amended to read as follows:
(3) Prohibited uses
(a) All types of occupancies from which are emitted smokes,
fumes, gases or odors detrimental to the comfort, enjoy-
ment and health of surrounding persons or occupants
(b) New or used automobile parts sales from vacant lots
(c) Creosote treatment or manufacture
(d) Distillation of bones, coal or wood
(e) Fertilizer manufacture
(f) Fish houses, wholesale, also fish smoking, curing or
processing plants
(g) Gasoline filling or service stations, except where special
permit has been procured from City Commission. When
an approved service station site abuts a residential district,
a visual barrier of at least six (6) feet high shall be con-
structed of permanent materials such as a wooden, metal
or masonry fence or wall, and such barrier shall be properly
erected and maintained within a distance not to exceed two
(2) feet from the property line abutting said residential
district.
(h) Lumber yard or mill work
(i) Mobile home parks are prohibited, except where a special
permit has been procured from the City Commission,
following a consideration and recommendation, either
favorable or unfavorable, by the Planning and Zoning Board.
(j) Carnivals, tent shows, exhibits and other temporary amuse-
ment projects, except where special permit has been pro-
cured from the City Commission.
Section 5. Section 26-6B (3), USE REGULATIONS --11HB11 HEAVY
BUSINESS DISTRICT--SPECIAL EXCEPTIONS, of Code of Ordinances,
City of Clearwater, Florida, 1962, is amended to read as follows:
Sec. 26-6B. Use Regulations -111-011 heavy business district.

Section 6. Section 26-6B (4), USE REGULATIONS--ISB1r HEAVY
BUSINESS DISTRICT--PROHIBITED USES, of Code of Ordinances, City
of Clearwater, Florida, 1962, is amended to read as follows:
Sec. 26-6B. Use Regulations--11HB11 heavy business district.
(4)Prohibited uses
(a)Prohibited uses as listed in B Zone in Sec. 26-6A sub-
paragraph (3), except lumber yard or mill work.
(b)Automobile wrecking yards, junk yards, scrap and
salvage yards for second-hand building materials.
(c) No privately owned access roads to any use in this
district shall be permitted through any property in a
residential zoned district.
Section 7. Section 26-7, USE REGULATIONS-_,?M'r DISTRICTS,
of Code of Ordinances, City of Clearwater, Florida, 1962, is amended
by adding thereto a third paragraph unnumbered or lettered to read
as follows:
Drive-in Theater may be permitted as a special exception
by the Board of Adjustment and Appealls approval-See
Sec. 26-17.
Section 8. Section 26-11 (14) LOCATION, HEIGHT AND AREA
REGULATIONS--SETBACKS, LOT SIZE, HEIGHT, AREA, of Code of
Ordinances, City of Clearwater, Florida, 1962, is amended to read
as follows:
Sec. 26-11. Location, height and area regulations--
Setbacks, lot size, height, area.
(14) Notwithstanding the zone classification there shall-be
established on the following streets a minimum building
setback of ten (10) feet from the existing right of way or
forty (40) feet from the center line of the right of way,
whichever is the greater. In cases where the zone
classification has a greater setback, such zone district
setback shall prevail.

Greenwood Avenue--Turner Street to Marshall Street
Missouri Avenue--Belleair Road to Drew Street
Highland Avenue--South City limit line North to Union Street

(5) (a) 01)
A drive'-in theater in an HB, Heavy Business or M, Manufacturing,
zone provided that the following criteria for area, location,
traffic and performance be met:
Area shall not be less than six (6) acres, not located on a
major highway but on a secondary road connecting to a major
highway. No part of such theater shall be within 500 feet of a
residential district nor within 50 feet of a road right of way.
Theater screen shall not face a major highway.
Traffic: There shall be one entrance for each access road with
one ticket gate for each 250 capacity. There shall be acceleration
and deceleration lanes provided as well as separate entries for
right and left turns where arrival volume is equally divided by
direction. Separate storage of vehicles off access road shall
be provided in an amount equal to 10016 of theater capacity.
Development: Surface treatment, lighting and drainage systems
shall be approved by the office of the City Engineer.
Section 10. All ordinances or parts of ordinances in conflict
herewith are to the extent of such conflict hereby repealed.
Section 11. . Should any part or provisions of this ordinance be
declared by a court of competent jurisdiction to be invalid, the same
shall not affect the validity of the ordinance as a whole, or any part
thereof other than the part declared to be invalid.
Section 12. Any person or persons, firm or corporation
s
or association of persons, who shall violate or fail to comply with any
of the terms or provisions of this ordinance shall, upon conviction•in
the Municipal Court, be fined not exceeding the sum of Two Hundred
Dollars ($200.00), or imprisonment in the City Jail for not exceeding
sixty (60) days, or by both such fine and imprisonment in the discretion
of the Municipal Judge. Each day that a violation is permitted to exist
shall constitute a separate offense.
