BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER FLORIDA:
Section 1. Section 4-30 and Section 4-34 of P rticle II, Licenses,
of Chapter 4, pertaining to alcoholic beverages, of the Code of Ordinances,
City of Clearwater, Florida, 1962, are hereby amended to read as follows:
Sec. 4-30. Investigation of applicant; issuance,
All applications under Section 4-27 shall, upon
presentation of proper approval from the state and
county be investigated by the City Clerk as to the
qualifications and requirements set out in this chapter,
The City Clerk may, however, waive the investigation
if, in his opinion, proper investigation has been made by
the state. After any such application shall be approved
by the City Clerk, the: City Treasurer shall, upon receipt
of the specified fee, proceed to issue: any license classified
under Section 4-Z6 to which the applicant is entitled.
Sec. 4-34, Transfer,
No license issued under this chapter shall be transferable
either as to licensee or location. A licensee moving his
place of business to a new location shall, upon surrendering
his license to the City Treasurer and making a new application
in the same ..canner as for an original application for the new
location including approval by the City Clerk, be issued a new
license to run for the remainder of the license year without the
payment of any further fee or tax, providing that such licensee
shall then qualify under all the provisions of this chapter,
Section Z. All ordinances or parts of ordinances in conflict here-
with are to the extent of such conflict hereby repealed.
Section 3, Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
