ORDINANCE NO. 1003
AN ORDINANCE OF THE CITY OF CLEARWATER,
FLORIDA, AMENDING SECTION 10-7, SUB-SECTIONS
1 AND 1A, OF THE CODE OF. ORDINANCES, CITY
OF CLEARWATER, FLORIDA, 1962, BY AMENDING
THE SCHEDULE OF FEES FOR GARBAGE AND/OR
--------: TRASH COLLECTION; PROVIDING FOR THE REPEAL
OF ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH AND PROVIDING FOR THE
EFFECTIVE DATE OF THIS ORDINANCE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Section 10-7, Sub-Sections I and IA of the Code of
Ordinances, City of Clearwater, Florida, 1962, relating to the schedule
of fees for garbage and/or trash collection, is amended to read as follows:
"Section 10-7. Collection Fees.
(1) Monthly charges for twice weekly collection of garbage
and/or trash in prescribed containers:
(a) For duplex dwellings and single family dwellings
including one additional apartment or living unit
as part of or detached from the single family
building and under one ownership......... $2.25
minimum for each living unit. Use of 2 garbage
and trash receptacles permitted per unit.
For the purposes of this section a living unit is
defined as any room or group of rooms equipped
with cooking facilities and designed for or used
by one or more persons as a separate household
establishment, including so-called mobile homes
or house trailers and motel rooms or suites so
equipped and used.
(b) For multiple family dwellings consisting of three
or more living units, which units may be a part of
or detached from the main building; all garbage
receptacles serving the premises to be centrally
located at one collection point.
First Unit . . . . . . . . . . . $2.25 minimum
Next nine units. . . . . . . . . 1. 05 per unit
All over ten units . . . . . . . - 80 per unit
Apartment houses and trailer courts or parks
containing three or more living units shall be
classed as multiple family dwellings; all garbage
receptacles serving the premises to be centrally
located at one collection point.
(c) For motels, apartLrnent motels, or apartments
renting by day or week:
First living unit .. . . . . $2.25 minimum
Next nine living units .80 per unit
All over ten living units. . . .55 per unit
Rooms for living and sleeping
purposes only without cooking
facilities. . . . . . . . . . .25 per room
All garbage receptacles serving the premises to
be centrally located at one collection point.

(d) Motels, apartment motels, or apartments renting
by day or week with commercial containers rigged
for mechanical lifting and approved by the refuse
superintendent and not exceeding one cubic yard in
capacity, shall receive a twenty per cent (20%)
discount from the regular charge as computed in
accordance with paragraph (c) above.
(e)For commercial buildings of all types such as stores;
hotels, factories, filling stations, service establish-
ments, and the like with separate water metering:
For twice weekly collection:
One or two cans. . . . . . - . . . $2. 25 minimum
Each additional can. . . . . . . . 1.39
Commercial containers not
exceeding one cubic yard. 6.00 each
(f) For each building containing four (4) or more sepa-
rate offices and one common water meter for
physicians, dentists, dental repair facilities, lawyers,
real estate brokers, insurance agents, clinics, labora-
tories or other similar or related businesses, the
owner of the premises served shall be responsible to
the city for a monthly garbage collection charge of
$9.25 for the first eight (8) garbage receptacles and
$1. 30 per month for each such receptacle in excess
of eight (8).
(g) Where an incinerator approved by the utilities man-
ager for the partial disposal or consumption of trash
an/or garbage is provided and consistently used on
any premises listed above under paragraphs (a) to
(f) inclusive, the monthly charges for twice weekly
collection of garbage and/or trash shall be one-half
(1/2) of the charges listed under said paragraphs (a)
to (f) inclusive.
(1-A) Monthly charges for daily commercial (except Sunday
and holidays) collection for garbage and/or trash in
prescribed containers:
One Can. . . . . . . . . . . . . . . $3.80 minimum
Each additional can. . . . . . . . . 3.80
Commercial containers not exceed-
ing one cubic yard. . . . . . . . . 18. 00 each
Except that where an incinerator approved by the
utilities manager for the partial disposal or consumption
of trash and/or garbage is provided and consistently
used on any premises subject to the charges provided
in said subsection (1-A) above, the monthly charges for
daily collection of garbage and/or trash shall be one-half
(1/2) of the charges listed under said subsection (l-A).
It shall be the responsibility of the owner of an incinerator
to remove the ashes and residue therefrom at regular in-
tervals, not less often than twice a week, and place same
in an approved container.
If, in the opinion of the refuse superintendent, any in-
cinerator fails to accomplish a substantial reduction in the
total volume of garbage and/or trash by reason of poor
design, inefficiency, careless operation, inadequate capacity,
failure to use-or other good reason,, he shall report the
facts to the utilities manager, who shall notify the owner in
writing that the condition must be corrected within 30 days,
otherwise the full collection fee will be charged. In the
event the superintendent makes a second report of the same
nature against the same premises within one year of the
first report, the Owner shall be notified that full collection
fee will be restored from then on regardless of whether an,
