ORDINANCE; PROVIDING FOR THE REPEAL OF ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT <.
HEREWITH AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER,
FLORIDA;
Section 1. Section 1 of Ordinance No. 632, also being Section 20-1
of the Code of Ordinances, City of Clearwater, Florida, 1962, is amended
to read as follows:
"The city manager is designated as supervisor of plats.
The written approval of said supervisor of plats shall be
endorsed on the plats of all new subdivisions, extensions
and revisions of existing subdivisions within and immediately
adjacent to the city, before said plats shall be entitled to
record in the office of the clerk of the circuit court of Pinellas
County, Florida, and before sales of lots or parcels in said
subdivisions, extensions or revisions may be made, and
before any building whatsoever may be constructed or
occupied on any lot or parcel of land in all such subdivisions,
extensions or revisions thereof. This section shall also
apply to any development(s) requiring a subdivision of
property into lots below minimum standards of width or area
so platted for resale purposes, or such development,
extension (s) or revision(s) thereof. 11
Section Z. Section 2 -of Ordinance No. 632, also being Section
20-Z of the Code of Ordinances, City of Clearwater, Florida, 1962, is
amended to read as follows;

"The provisions of section 20-1 are in addition to and not
in lieu of the power and authority of the city commission
to regulate subdivisions as to the amount, kind, type and
specifications of public improvements. Approval of the
city commission must be duly voted at a public meeting of
said city commission before said plats shall be entitled to
record in the office of the c1crk of the circuit court of
Pinellas County, Florida, and before sales of lots or parcels
in said subdivisions, extensions or revisions thure:of, may
be made, and before any building whatsoever may be con-
structbd or occupied on any lot or parcel of land in all such
subdivisions, extensions or revisions thereof. This section
shall also apply to any development(s) requiring a subdivision
of property into lots below minimum standards of width or
area so platted for resale purposes, or such development,
extension(s) or revision(s) thereof. 11
Section 3. The first paragraph of Section 3 of Ordinance No. 632,
also being the first paragraph of Section 20-5 of the Code: of Ordinances,
City of Clearwater, Florida, 1962, is amended to read as follows:
'Before the plat of any subdivision or any extension or
revision thereof and any development requiring a sub-
division of property into lots below minimum residential
standards of width or area, so platted for resale purposes,
or such development extension or revision thereof shall be
approved by the Supervisor of Plats or the City Commission,
the owners or developers of said subdivisions or`developments,
or extensions or revisions thereof shall first accomplish at
their own expense the following public improvements in the
following manner in said subdivisions or said developments,
extensions or revisions thereof, or in the alternative, at the
option of the Supervisor of Plats and the City Commission,
the owners or developers shall agree to accomplish said
improvements in said manner and shall guarantee the
accomplishment of said improvements in said manner by
performance bond, indenture of mortgage, or any other means
which may, from time to time, be designated by the Super-
visor of Plats and the City Commission, both of whom are
hereby authorized and empowered to establish such methods
of guarantee. "
Section 4. Section 3-H of Ordinance No. 632, being also Section
20-5 (8) of the Code of Ordinances, City of Clearwater, Florida, 1962, is
amended to read as follows:
"SIDEWALKS. Sidewalks arc required, Location and
width shall be as determined by the City Engineer and
sidewalks shall bu constructed four (4) inches in thickness,
and shall be of concrete, the strength of which shall be a
minimum of 2500 p. s, i. in 28 days, "

Section 5, Section 3-J of Ordinance No, 632, being also Section
20-5 (10) of the Code of Ordinances, City of Clearwater, Florida, 1462, is
arnended to read as follows:
"STORM SEWERS AND DRAINAGE. Construct storm
sewers having a minimum diameter of 12 inches together
with then necessary manholes, catch basins and other
appurtenances and do all other things to accomplish
satisfactory drainage, according to the re:quiremento of
the City Engineer of the City of Clearwater. "
Section 6. Section 3-K of Ordinance No, 632, being also Section
20-5 (11) of the Code of Ordinances, City of Clearwater, Florida, 1962, is
amended to read an follows:
"SANITARY SEWERS. Construct sanitary sewers having
a minimum diameter of 8 inchen or such minimum diameter
as may be required by the City Engineer of the City of Clear-
water; and shall construct with said sanitary sewers the
necessary manholes and other appurtenances as may be re-
quired or designated by the City Engineer of the City of
Clearwater and the Health Department of or serving the
City of Clearwater, in the event that the City Commission
or the Supervisor of Plats deems connection of said sub-
division, extension or revision thereof with a sanitary sower
impracticable and provided the land and topography of the sub-
division is such that the use of individual septic tanks and
drain fields might be expected to provide a satisfactory
means of sewage disposal, then in that event, the owner
or developer shall comply with Chapter V of the Florida State
Sanitary Code, which is hereby adopted by the: City of Clear-
water as a part of the Sanitary Code of the City of Clearwater,
together with amendments which may be made to said Chapter
V from time to time. "
Section 7• Any parson or persons, firm or corporation or association
of persons, who shall violate or fail to comply with any of the terms or pro-
visions of this ordinance shall, upon conviction in the Municipal Court, be
fined not exceeding the sum of Two Hundred Dollars ($200. 00), or imprisoned
in the City Jail for not exceeding sixty (60) days, or by both such fine and
imprisonment in the discretion of the Municipal Judge, Each day that a
violation is permitted to exist shall constitute a separate offense.
Section 8. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
