980 B: l/ ORDINANCE NO. 980 % AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, ADOPTING PORTIONS OF THE GENERAL f LAWS OF FLORIDA PERTAINING TO MUNICIPAL ZONING; APPROVING, RATIFYING AND CONFIRMING CHAPTER 26, PERTAINING TO ZONING, AS AMENDED, OF THE CODE OF ORDINANCES OF THE CITY OF CLEARWATER, FLORIDA, TOGETHER WITH THE ZONING MAP OF TIME CITY OF CLEARWATER, FLORIDA, 1962, AS AMENDED; GRANTING TO THE CITY COMMISSION THE POWER AND AUTHORITY TO ZONE WITHOUT FIRST CONDUCTING A PUBLIC HEARING CERTAIN PROPERTIES; ESTABLISHING THE PROCEDURE FOR AMENDING, SUPPLEMENTING, OR CHANGING THE ZONING ORDINANCE OR ZONING MAP OF THE CITY OF CLEARWATER; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SAID CONFLICT; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS THEREOF AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, Senate Bill No. 526, Laws of Florida, Regular Session, 1963, became a law on May 10, 1963, and it amended Section 79, pertaining to planning and zoning, of the Charter of the City of Clearwater; and WHEREAS, said law provided, among other things, as follows: The City Commission of the City of Clearwater is authorized and empowered to adopt and follow the General Laws of Florida, or portions thereof, per- taining to Municipal Zoning, now existing or which may hereafter be enacted, and which are not in conflict with the provisions of this Act or the ordinances or resolutions now in force or here- after enacted by the City Commission; and WHEREAS, Chapter 176 of the Florida Statutes, 1961, pertains to Municipal Zoning; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section I. M E' J • Y quq f' 4a•.` .. fA;. i 176.04 PURPOSES IN VIEW IN MAKING REGULATIONS. Regulations shall be made in accordance with a comprehensive plan and designed to lessen con- gestion in the streets, to secure safety from fire, panic, and other dangers; to promote health and the general welfare; to provide adequate light and air; to prevent the overcrowding of land; to avoid undue concentration of population; to facilitate the adequate provision of transportation, water, sewerage, schools, parks, and other public requirements. Such regulations shall be made with reasonable consideration, among other things, to the character of the district and its peculiar suitability for particular uses, and with a view to conserving the value, of buildings and encouraging the most appropriate use of land throughout said municipalities. 176.05 MUNICIPALITY TO PROVIDE PROCEDURE; REGULATION, RESTRIC'T'ION OR BOUNDARY NOT EFFECTIVE UNTIL AFTER PUBLIC HEARING THEREON; PUBLICATION OF NOTICE OF HEARING REQUIRED. The governing body of the said municipality shall provide for the manner in which such regulations and restrictions and the boundaries of such districts shall be determined, established and enforced, and from time to time amended, supplemented, or changed. However, no such regulations, re- strictions, or boundary shall become effective until after a public hearing in relation thereto, , at which parties in interest and citizens shall have an opportunity to be heard. At least fifteen days' notice of the time and place of such hearing shall' be published in a newspaper of general circulation in said municipality and if there be no newspaper published within the municipality then three notices shall be published in at least three conspicuous places within the municipality including the city or town hall, as the case may be. 176.06 REGULATION, RESTRICTION AND BOUNDARY SUBJECT TO CHANGE OR REPEAL; PROTEST OF CHANGE, VOTE REQUIRED TO EFFECT CHANGE OVER PROTEST; PUBLICATION OF NOTICE OF CHANGE REQUIRED. Regulations, restrictions, and boundaries may, from time to time, be amended, supplemented, changed or repealed. In case, however, of a protest against such change signed by the owners of twenty per cent or more either of the area of the lots included in such proposed change, or of those immediately adjacent in the rear thereof extending five hundred feet therefrom, or of those directly opposite thereto extending five hundred feet from the street frontage of such opposite lots, such amendments shall not become effective except by a favorable vote of three-fourths of the governing body of said municipality. Chapter Twenty-six (26) pertaining to Zoning, as amended, of the Code of Ordinances, City of Clearwater, Florida, together with The 4 Zoning Map of the City of Clearwater, Florida, of 1962, as amended, are hereby approved, ratified and confirmed in every respect. i Section 3. The City Commission of the City of Clearwater, anything herein to the contrary notwithstanding, be and it is hereby granted the power s < and authority to zone without first conducting a public hearing any and all r. . h additions of whatever nature annexed to and incorporated into the City limits of the City of Clearwater, all new land areas created by filling or otherwise, and all other lands included within the City limits of the City of Clearwater from time to time, which lands have not been formerly zoned by the Zoning Ordinance of the City of Clearwater. Section 4. Pursuant to the authority granted under Chapter 176 of the Florida Statutes, 1961, the following procedure for amending, supplementing or changing the Zoning Ordinance or Zoning Map of the City of Clearwater is hereby established: A. Any person, firm, corporation, board, or official B. C. of the City of Clearwater may file a written application requesting a proposed amendment, supplement, change or modification of the Zoning Ordinance or Zoning Map of the City of Clearwater. Applications shall be filed in triplicate with the City Clerk and shall set forth the reasons and grounds for said request. Each application by anyone, other than a Board or official of the City of Clearwater, shall be filed by the owner or his duly authorized representative and shall be accompanied at the time of filing by a fee of $35.'00 to cover the approximate cost of the procedure. Under no condition shall such sum, or any part thereof, be refunded for failure of such change to be adopted by the City Commission. The City Clerk shall forthwith transmit a copy of each application to the Planning and Zoning Board of the City of Clearwater for study and recommendation to the City Commission. D. The Planning and Zoning Board of the City of Clearwater may, in its discretion, hold a public hearing in arriving at its recommendation on a proposed change to the City Commission. The recommendation of the Planning and Zoning Board shall be based upon consideration of the following, but shall not be limited thereto: (1) Existing conditions including land use, lot area, building height and yards. (2) The proposed change shall be in accordance with a comprehensive plan. E. The Planning and Zoning Board shall make its recom- mendation to the City Commission within sixty (60) days from the date of filing of the application, or such extended period as may have been allowed by the Commission. If the Board submits no report by the end of the required period, this will constitute its approval of the application. F. PUBLIC NOTICE AND PUBLIC HEARING (1) If the Planning and Zoning Board makes no report within sixty (60) days from the date of the filing of the application , or such other period as may have been agreed upon, or upon the filling of the recommendation of the Planning and Zoning Board, the City Commission shall fix a date, time and place for a public hearing on the proposed amendment. (2) - The office of the City Clerk shall publish notice Of said public hearing once, at least fifteen (15) days, but not more than thirty (30) days, in advance of the hearing, in a newspaper of general circulation in the City of Clearwater. (3) If the proposed amendment concerns a change of zoning classification of real property, the City, through its Engineering Department, shall also post a notice of the proposed change on the subject real property involved for a period of at least,five (5) days in advance of the scheduled public hearing. yr}r r• ,?a . (4) If the proposed amendment concerns a change of zoning classification of real property, the City I Clerk shall mail a notice of the scheduled hearing to the owner of the subject real property and the owners of all properties within two hundred feet (2000 of the subject property. All such notices shall'be sent by mail to the last known names and addresses as indicated on the tax rolls of Pinellas County, Florida. ' (6) The City Commission shall hold such public hearings quarter-annually if necessary, and more often if in its discretion it fools public convenience and necessity require. G. All proposed changes and amendments to the Zoning Ordinance or the Zoning Map as approved by the City Commission after its evaluation of all evidence pre- sented at the public hearing, shall be incorporated in an ordinance or the Zoning Map of the City of Clearwater which shall become effective immediately upon its passage. f Section 5. All ordinances or parts of ordinances in conflict herewith r• i ! i are to the extent of such conflict hereby repealed. Section 6. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 7. The provisions of this ordinance shall take effect immediately upon its passage.
