AN ORDINANCE OF THE CITY OF CLE.ARWATER
ESTABLISHING REQUIREMENTS FOR OBTAINING
PERMITS TO ENC,LAGE .IN ADVERTISING BY
MEANS OF "COUPON BOOKS"•AND GIFT CERTI-
FICATES"; MAKING IT UNLAWFUL TO ENGAGE
IN SAID BUSINESS WITHOUT OBTAINING A ,
PERMIT; PROVIDING FOR PRIALTIES FOR
THE VIOLATION OF THIS ORDINANCE; PRO-
VIDING FOR SEVERABILITY; AND PROVIDING w.
FOR THE EFFECTIVt DATE OF THIS ORDINANCE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA;
SECTION 1. It shall be unlawful to engage in the sale,
solicitation, or promotion of any advertising undertaking involving the
use of "gift certificates" or "coupon books", or any facsimile thereof
whereby the holder of such is entitled to receive merchandise or services G?
upon presentation to merchants utilizing this promotional method, by any
person, agent, agency, corporation, co-partnership or association, within
the City of Clearwater, other than individual merchants promoting their
business only, without first procuring a written permit from the City
Manager to do so.
SECTION 2. The applicant for such a permit shall, upon
so applying:
1. Supply a sworn statement as to:
(a) Name, local address and home office
address of firm;
(b)
List of names, addresses and descrip- .s:
tion of all salesmen to take part in
s
the.campalgn, together with photograph '
of applicant and each salesman or so-
licitor, taken within sixty (60) days
immediately prior to date of each ap-
plication, which picture shall be a
21"x 2" showing head and shoulders in

a clear and distinguishing manner; '

A statement as to whether or not the • ? p
applicant and/or each salesman or so- r
licitor, has been convicted of any
crime, misdemeanor or violation of
any municipal ordinance, the nature ;

or penalty assessed therefor; '
(d) Applicant shall file with his appli-
cation a statement by a reputable
physician of the City of Clearwater
dated not more than ten (10) days s

is free of infectious, contagious, or com-
municable disease.
2. Submit copy of coupon books to be used along with
application for permit;
(a)
3.
Coupon books shall have printed on the
front thereof (I) the expiration date
of the book and coupons contained there-
in; (II) the number of the book (each
coupon contained therein shall like-
wise bear a corresponding number);
(III) the name and address of the pro-
motional agency or agent; (IV) all of
the exceptions and/or limitations which
may be applicable thereto.
Applicant shall also submit copies of the contracts
with each merchant along with the application; said contracts shall speci-
fically set forth the number of coupon books to be issued by the promo-
tional agency or agent and the beginning date and expiration date of the
promotional undertaking. The expiration date contained therein shall
correspond to the expiration date printed on the outside cover of each
coupon book.
SECTION 3. Each salesman, agent, or employee of the
promotional agency or agent shall keep a record of the coupon books, by
number, sold or otherwise disposed of by him, which record shall be
signed by such salesman, agent or employee and filed with the office of
tha City Manager not later than five (5) days after the expiration date
of the promotional undertaking.
SECTION 4. Any permit obtained by complying with the
foregoing requirements shall be subject to revocation by the City Manager
upon proof of improper solicitation or sales practices (recognized as such
under the laws of the State of Florida) indulged in by the salesmen, agents
or employees of the advertising or promotional agency or agent operating
under the permit in question.

SECTION 5. It shall be unlawful to fail to honor any
coupon by the morchant whose name and offer appears thereon, presented
by the holder within the proper poriod of timo, within business hours
of.that business.
SECTION 6. Any person violating any provision of this
ordinance upon conviction thereof shall be subject to a fine not to ex-
ceed One Hundred Dollars ($100.00) or imprisonment for a period not to
exceed thirty (30) days, or both, in the discretion of the Judge of the
Municipal. Court. Each day a violation of this ordinance continues after
conviction hereof shall constitute a separate offense.
SECTION 7. This Ordinance shall become effective
immediately upon its passage, l
