CHARGES FOR GARBAGE AND/OR TRASH; PROVIDING FOR
THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINAN-
CES IN CONFLICT HEREWITH; AND PROVIDING FOR THE
EFFECTIVE DATE OF THIS ORDINANCE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA-
Seat ion 1.
Section 2 (8)1 of Ordinance No. 773, of the City of Clearwater,
Florida is amended to read as follows:
"Section 2 (8) 'Rubbish' or 'Trash' is nonputrescible solid
wastes (excluding ashes), consisting of both combustible
and non-combustible wastes, such-as paper, cardboard,-boxes,
crates, tin cans, yard clippings, leaves, wood, glass, bed-
ding, crockery and similar materials as ordinarily accumu-
lates about residential property."
Section 2.
Section 5 (2)
follows.
(d'), of Ordinance No. 773, is amended to read as
"Section 5 (2) (d) Rubbish and Trash Bins: No rubbish
or trash bins shall be constructed or used after the
effective date of this ordinance.
No such bin existing prior to the adoption of this or-
dinance shall continue to be used unless it is enclosed
entirely including a floor or bottom, water tight, ro-
dent proof and a tight fitting cover. Proof of any
such bin existing prior to the date of this ordinance
shall be by written notice only by the owner or user
filed with the refuse superintendent within 90 days
of the effective date of this ordinance. Such notice
shall give the exact size and location of this bin and
its date or approximate date of construction.
Fees for collecting contents from any such rubbish or
trash bin shall be set by the refuse superintendent
at triple the rate charged for the cubic yard con-
tainer nearest, but not smaller than, the size of the
bin or at the rate of $12.00 per hour (20¢ per minute)
whichever is the lesser amount.
Where neither containers or bins-are used, the charge
for collecting such loose refuse, other than that
placed for curbside collection, shall be at the rate
of $12.00 per hour (20¢ per minute). All such charges
of non-container collections shall be based on the
average daily time to be determined by the refuse

{superintendent. Said charges shall'not be construed
as a penalty but cost'of the delay upon the refuse
equipment and personnel having to pick or collect loose
refuse therefrom.
Only dry garbage shall be placed or kept in an exist-
ing rubbish or trash bin.
No charge will be made for any containers used ex-
clusively for trash located at single or duplex
residences."
"Section 7. Fees.
Section 3.
Section 7 (1), of Ordinance No. 7730 is amended to read as follows:
(1) Monthly Charges For Garbage and/or Trash,
(a) 2 Times Weekly:
1 or 2 cans $ 1.75 (minimum)
Each additional can 1.00
Commercial Containers,
1 cubic yard each 4.50
Daily:
1 can $ 2.90 (minimum)
Each additional can 2.90
Commercial containers,
1 cubic yard each 13.50
(b) That for each multiple dwelling unit accomo-
dating four (4) or more families, the owner
of the premises served shall be responsible
to the City for a monthly garbage collection
charge of Seven Dollars ($7.00) for the first
eight (8) garbage receptacles, and One Dollar
($1.00) per month for each such receptacle in
excess of eight (8). For the purposes of this
Ordinance, where garbage receptacles are cen-
trally located in one garbage collection point
thereat, trailer parks and hotels are classed
as multiple dwellings.
(c) That for each building containing four (g)
or more separate offices for physicians,•den-
tists, dental repair facilities, lawyers, real
estate brokers, insurance agents, clinics,
laboratories or other similar or related
businesses, the owner of the premises served
shall be responsible to the City for a monthly
garbage collection charge of Seven Dollars
($7.00) for the first eight (8) garbage re-
ceptacles and One Dollar ($1.00) per month for
each such receptacle in excess of eight (8).
(2) The refuse collection charges are applicable until all
municipal utilities including lawn.(water) meters are
disconnected permanently or discontinued temporarily.
(3) Accounts Payable: All refuse accounts are payable
monthly along with other payments for municipally
operated utilities. Delinquent accounts shall be
treated the,same as for other municipally operated
utilities."

Section 4.
All ordinances or parts of ordinances in conflict herewith are to
the extent of such conflict hereby repealed.
Section 5.
This ordinance shall take effect for garbage and/or trash, and
rubbish collection services furnished after July•18 , 1960.
