ORDINANCE NO. 841
AN ORDINANCE OF THE CITY OF CLEARWATER DEFININING A.
CERTAIN AREA OF CLEARWATER BAY AND MAKING THE SAME OFF
LIMITS TO ALL MARINE VESSELS WHIdH EXCEED FIFTY (50)
FEET IN LENGTH OR EIGHTEEN (18) FEET IN BEAM; PROVID-
ING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE; PRO-
VIDING FOR SEVERABILITY; AND PROVIDING FOR THE EFFECT-
IVE DATE OF THIS ORDINANCE.
WHEREAS, Chapter 59-400 (House Bill 1792) of the General Laws
of the State of Florida declare that all motorboats, of whatever classi-
fication, shall be considered dangerous instrumentalities; and,
WHEREAS, it is found and determined in the public interest
navigational hazards and other public dangers exist which affect the
public safety and property generally in that part of Clearwater Bay
which is described as follows, to-wit:
All waters contained in Section 8 - 29S - 15E, Section 5-
29S - 15E, and Section 32 - 28S - 15E, East of Clearwater
Beach Island; North of Memorial Causeway and Memorial
Causeway West Bridge; and South of the Clearwater City
Limits.
The same-being wholly within the municipal limits of the City of Clear-
water; and,
WHEREAS, said area has been used for many years by the boat-
ing public for non-commercial recreational purposes;, and,
WHEREAS, the tremendous increase in recreational non-commercial
boating has now necessitated the regulation of boating traffic of all
types in and on the waters of Clearwater Bay within the jurisdiction ^_'
the City of Clearwater in order to promote and safeguard the public
safety and welfare; and,
WHEREAS, the vast majority of commercial boat traffic operates
in the waters of Clearwater Bay, South of Memorial Causeway, and thence.
by a regularly marked channel through Little Pass; and,

number of privately owned yachts, vessels and seawalls exist along
the Westerly boundary of the property above described, which are unpro-
tected from the elements as well as the backwash of large vessels
which use the foregoing body of water for commercial or private pur-

4 11k IN t'.,NOW THEREFORE BE IT ORDAINED BY THE CITY COMMISSION OF
THE?CITY OF CLFARWATER FLORIDA, IN SESSION DULY AND RE-
GULARLY ASSEMBLED, AS FOLLOWS.' Section 1, On account of the foregoing reasons and in order
to reserve and protect the public health welfare and safety, all mar-
` ins vessels exceeding fifty ( 50) feet in length (measured from end to
end over the deck excluding sheer) or exceeding eighten (18) feet in
beam, are hereby excluded from using the following described water
within the municipal limits of the City of Clearwater? Florida, to-wit:
All waters contained in Section 8 - 29S - 15E, Section
5 - 29S - 15E, and Section 32 - 28S - 15E East of
Clearwater Beach Island; North of Memoriaf Causeway
and Memorial Causeway West Bridge; and South of the
Clearwater City Limits-.
Section 2. Except in cases of emergency in order to protect
life and property from Acts of God or when a special permit has been ob-
tained from the City Commission allowing temporary exceptions only, any
owner or operator of any marine vessel, whether person, firm or corpora-
tion, who shall knowingly violate the terms of this Ordinance, shall be
punished by a fine not to exceed Two Hundred and Fifty Dollars ($250.00)
or by imprisonment for a period of not more than Sixty (60) days or by
both such fine and imprisonment, in the discretion of the Municipal Juda-
Each day any violation continues shall constitute a separate offense.
Section 3. Should any word, section, paragraph, sentence, phrase;
clause, or other part or provision of this Ordinance be declared by
