ORDINANCE NO. 833
AN ORDINANCE OF THE CITY OF CLEARWATER ADOPTING "THE
GAS CODE OF THE CITY OF CLEARWATER FLORIDA 1959";
PROVIDING FOR THE REPEAL OF ARTICU 2 SECTIONS 24
TO 68, INCLUSIVE AND FOR THE REPEAL bF ARTICLE 3,
SECTIONS 59 TO 75, INCLUSIVE; AND PROVIDING FOR THE
REPEAL OF ARTICLE 4, SECTION 74 OF THE "CODE OF THE
CITY OF CLEARWATER, FLORIDA, 1950"; PROVIDING FOR
THE REPEAL OF ORDINANCE NO. 829 OF THE CITY OF CLEAR-
WATER; PROVIDING FURTHER FOR THE REGULATION, ADMINIS-
TRATION AND ENFORCEMENT OF THE LAWS OF THE CITY OF
CLEARWATER RELATING TO GAS; REPEALING ALL ORDINANCES
OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING
FOR THE REPEAL OF ALL PROVISIONS OR PARTS OF PROVISIONS
OTHERWISE CONTAINED IN "THE CODE OF THE CITY OF CLEAR-
WATER, FLORIDA, 1950" IN CONFLICT HEREWITH; PROVIDING
PENALTIES FOR THE VIOLATION OF THIS ORDINANCE; EXCLUD-
ING THE REGULATION OF DESIGN, FABRICATION, INSTALLATION,
TESTS AND OPERATION OF SYSTEMS UTILIZING UNDILUTED LIQUI-
FIED PETROLEUM GAS; PROVIDING FOR SEPARABILITY; AND
PROVIDING THAT THIS ORDINANCE, TOGETHER WITH SAID GAS
CODE, TAKE EFFECT IMMEDIATELY UPON ITS PASSAGE.
WHEREAS, the City Commission of the City of Clearwater, Flor-
ida has caused its ordinances of a general and permanent nature relating
to gas, to be compiled and revised and the sane are embodied in a com-
pilation, addition and revision thereof, known as "The Gas Code of the
City of Clearwater, Florida, 1959";
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF CLEARWATER, FLORIDA:
Section 1. That Section 1 through Section 9 of the Gas Code
of the City of Clearwater, Florida, 1959, being Pages 1 through 67, in-
clusive, are ordained as "The Gas Code of the City of Clearwater, Flor-
ida, 195911, and shall be cited as such. That from and after-the adopt-
ion of this Ordinance, all installations of gas, pipes, fixtures, ap-
pliances and other equipment or appurtenances shall be installed only
in accordance with the standards and specifications a set forth in
Ord. 833

any evidence of said City's indebtedness or any contract or obligation
assumed by said City; nor shall the repeal affect the administrative -
ordinances, lice nse ordinances or resolutions of the City of Clearwater
not in conflict with the provisions of this Code; nor shall it affect " any right or franchise conferred by any ordinance or resolution of the
Commission on any person, firm or corporation; nor shall it affect the
Building Code, the Electrical Code nor the Plumbing Code; nor shall it
affect any ordinance concerning Taxation; nor shall it affect any prose-
cution, suit or other proceeding pending or any judgment rendered on or
prior to October 5, 1959.
Section 4. This Ordinance expressly excludes and is not in-
tended to cover the design, fabrication, installation, tests and opera-
tion of systems utilizing undiluted liquified petroleum gas.
Section 5„ Any person, firm or corporation who shall violate
the provisions of this Ordinance shall, upon conviction thereof in the
municipal Court of the City of Clearwater, be punished by a fine not
exceeding Two Hundred Dollars ($200.00) or by imprisonment in the City

Jail for a period not exceeding Ninety (90) days, or by both such fine
and imprisonment in the discretion of the Municipal Judge..
Section 6. Should any section, paragraph, sentence, phrase,
clause or other part or provision of this Ordinance or "The Gas Code
of the City of Clearwater, Florida, 1959" be declared by any court to
be invalid, the same shall not affect the validity of the Ordinance or
"The Gas Code of the City of Clearwater, Florida, 1959" as a whole, or
any part thereof, other than the part declared to be invalid.
Section 7. A copy of "The Gas Code of the City of Clear-
water, Florida, 1959" shall be in the office of the City Clerk and be
made available to persons desiring to examine the same.
Section B. This Ordinance shall take effect immediately upon
its passage.
