(a) Exce Sion for Actual Producera2 This Ordinance shall not prohibit the actual producers of refuse, or the owners of premises upon which refuse has accumulated, from personally collecting, conveying and disposing of such re- fuse, provided such producers or owners comply with the pro- visions of this ordinance and with allother governing laws and ordinances. (b) Exception for Outside Collectors. This Ordinance shall not prohibit collectors of refuse from outside of the city from hauling such refuse over city streets prescribed by the refuse superintendent, provided such collectors comply with the provisions of this ordinance and with all other gov- orning laws and ordinances. Section -A. Collection Superyi,sad by Refuse Superin- tendent. All refuse accumulated in the city shall be col- lected, conveyed and disposed of by the city under the super- vision of the refuse superintendent. The refuse superintendent shall have authority to make-regulations concerning the days ! of collection, type and location of waste container and such, other matters pertaining to the collection, conveyance and disposal as he shall find necessary, and to change and modify the same after notice as required by law, provided that such regulations are not contrary to the provisions hereof. f ` "5;1,5 ;? • . ' Section Precollection Practices. (I Pre aration of Refuse. (a) Garbage. All garbage before being placed ?'a• in garbage cans for collection shall have drained from it all free liquids and may be wrapped in paper.' (b) Rubbish. All rubbish shall be drained of liquid before being deposited for collection. .?' (-1) Leaves, Clippings and Tri.mmi Any leaves, yard or hedge clippings, tree trimmings or any other type of y,;y rubbish or trash which, after being compressed, mashed, bent, cut, sawed or broken, is placed inside a receptacle approved ' F by the city shall be collected regularly on scheduled garbage Y ` routes. Contents of weather- proof trash receptacles will be collected along with regu- larly-scheduled garbage collecti.onsv from the same place the occupant's garbage can is located, Trash receptacles with- out d cover as provided for garbage cans shall contain no type of moist garbage. Any type of trash also may be placed in a garbage can. (2) Refuse Containers. (a) Duty to Provide and Maintain in Sanitar Condition. Refuse containers shall be provided by the owner, tenant, lessee, or occupant of the premises. Refuse containers shall be maintained in good condition. Any container that does not conform to the provisions of this ordinance or that may have ragged or sharp edges or any other defect liable to hamper or injure the person collecting the contents thereofp shall be promptly replaced upon notice. The refuse superintendent shall have the authority to refuse collection service for failure to comply herewith. (b) Garbage. Garbage containers shall be made of metal, equipped with suitable handles and tight fitting covers, and shall be water tight. (b-1)Gapacity. Each garbage oontaineir shall have a capacity of not more than 20 gallons, and shall be of such weight when full or collected that it can be handled by one man without strain or possible injury. (b-Z) Sanitation. Garbage containers shall be of a type approved by the county health agency and shall be kept in a clean, neat and sanitary condition at all tunes. (c) -,Rubbish and. Trash. The refuse superintendent shall at all times keep a complete list of illustrations, specifications,diagrams and sizes of such containers acceptable to the city for refuse collection purposes. Each commercial container ;hall have the approval of the refuse superintendent before its contents are collected. (3) Storing of Refuse. (a) Public Places. No person shall place any refuse in any street, alley ob other public place, or upon any private property whether owned by such person or not, unless it is in proper containers for collection or under express approval granted by the refuse superintendent. No penson shall place any refuse at the curb for collection except on his property adjacent and directly in front of him, and said placement shall be behind the curb or where the curb would be. Any person having a corner lot may use the side of his property subject to the approval of the re- fuse superintendent. No person shall throw or deposit any refuse in any stream or other body of water. (a-1) Unauthorized Accumulation. Any unauthorized accumulation of refuse on any premises is herehy declared to be a nuisance and is prohibited. Failure to remove any ac- cumulation of refuse shall be deemed a violation of this ordinance. (a-2) Scattering of Refuse. The actual producers of refuse or the owners of premises upon which refuse is accumulated who desire personally to collect and j dispose of such refuse, persons who desire to dispose of waste material not included in the definition of refuse f and collectors of refuse from outside of the city who de- sire to haul over the streets of the city, shall use a water-tight vehicle provided with a tight cover and so op- erated as to prevent offensive odors escaping therefrom and refuse from being blown, dropped or spilled. (b) Disposal. Disposal of refuse by persons bo permitted ; under subsection (a) above shall be made out- side the city limits, unless otherwise specifically authorized by the refuse superintendent. (c) Rules and Regulations. The refuse superintendent shall have the authority to make such other reasonable regula- tions concerning individual collection and disposal and re- ., Ling to the hauling of refuse over city streets by outside collectors as he shall find necessary, subject to the right of appeal as set forth in Section 4 hereof. (d) Owners or lessees of premises desiring to in- cinerate their refuse on their respective premises shallbe permitted to do so subject to the incinerator and its operation meeting all city regulations and having the written approval of a city fire prevention inspector. A refuse incinerator to be operated within the city shall cause no smoke, no offensive odory? no sparks, and no nuisance. Section 7. Fees. (3) Accounts Payable. All refuse accounts are pay- able monthly along with other payments for municipally operated utilities. Delinquent accounts shall be treated the same as fbr other municipally operated utilities. Section 8. Unlawful Rractices generally. It is hereby declared unlawful and a violation of this chapter for any person to do or permit to be done any of the following acts or practices: (a) To deposit on or buxy int; or cause to be deposit- ed on or buried in, any land, public property, street, alley, vacant lot or area, unoccupied lot or area, the waters of Clearwater Bay, Stevenson Creek or any other creek, watercourse, or ditch within the corporate limits of the city, any garbage or other noxious, melodorous or offensive matter. (b) To fail or neglect to keep or cause to be kept clean, and sanitary or tightly covered and in good state of repair all containers and trash receptacles, (c) To place or allow to be placed upon the streets, alleys, curbings or sidewalks of the city any rubbish, sweepings, -Syr 4---------------- w -- 2. Each day a violation of this ordinance continues after conviction hereof shall constitute a separate offense. Section 14. Separability. Should any section, paragraph, sentence, phrase, clause or other part or provision of this ordinance be de- clared by any court to be invalid, the same shall not af- fect the validity of the Ordinance as a whole, or any part thereof, other than the part declared to be invalid. Section 15. Ordinances repealed, All ordinances or parts of ordinances in conflict herewith or inconsistent with the provisions of this Ordi- nance are hereby repealed to the ektent of their conflict.
