BE IT OADAINED BY THE CITY COMMISSION OF THE CITY
OF CLEARWATEa, FLORIDA:
Section 1. This Ordinance may be citod as the „ Gity of Clearwaterx
Charitable Solicitations Ordinance".
Section 2. As used in this Ordinance -
(a) The term "board" means Charities Solcitations Board
as created and appointed an hereinafter provided.
(b) The term "registrant" means the holder of a valid per-
mit duly issued under the terms of this Ordinance.
(c) "Solicitation" and "Solicit" mean the request directly
or indirectly for any contribution on the plea or re-
pi-esentation that such contribution will or may be used
for any dharit'aable purpose, and also mean and include
airy of the following methods of securing contributions:
(I ? Oral or written roqua st ?
t 2 The distribution, circulation, mailing, posting or
puhlishing of any hnndbi ll, written advertisement
or publication.
(3) The making of any announcement to the press, over
the radio, by television, by telephone, or tele-
graph concerning an appeal, assemblage, athletic
or sports event, bxazaar, benefit, campaign, contest,
dance, drive, entertainment, exhibition, exposition,
party, performance, picnic, sale, or social gather-
ing, which the public is requested to patronize or
to which the public is requested to matte a contribu-
tion.
(1?) The sale of, offer, or attempt to sell,-any adver-
tisement, advertising space, books,card, magazine,
merchandise, subscription, ticket of admission, or
any other thing, or where the name of any charitable
person is used or referred to in any such appeal as
an inducement:' or reason for matting any such sale, or
when or where in connection with any such sale, any
statement is made that the whole or any part of the
proceeds from any such sale will go or be donated to
any charitable purpose.
A "solicitation" as defined herein shall be deemed
completed when made, whether or not the person making
the same receives any contribution or,makes any such
sale.

(b) The provisions of this Ordinance shall not apply to any
person making solicitations, including solicitations for
educational purposes, solely for a church or a religious
corporation or a corporation or any unincorporated asso-
ciation under the supervision and control of any such
church-or religious corporation; Provided, That such
church, religious corporation, corporation or unincorpora-
ted association is an organization which has been granted
exemption from taxation under the provisions of Section
501 of the Internal Revenue Code of 1954; Provided further,
That such exemption from the provisions of this Ordinance
shall be in- effect only so long as such church, religious
corporation, corporation or unincorporated association
shsl.l be exempt from taxation under the provisions of
Section 501 of the Internal Revenue Code of 1954
(c) The provisions of this Ordinance shall not apply to any
person making solicitations exclusively among the member-
shi. of the soliciting agency.
Section 41 CHARITY SOLICITATIONS BOARD CREATED. There is hereby
created for the - adtninistration of this Ordinance, a Charity Solicitations
Board which shall be composed of seven (7) members who shall serve without
remuneration for such'.sei4vices and who shall be appointed by the City Manager
and with the consent of the City Commission. Each member of said Board ap-
pointed by the City Manager shall hold office for a term of one (1) year and
five (5) of the appointees hereunder are to'be citizens of Clearwater from
the following organizations: Clearwater Merchants Association, Better Busi-
ness Bureau, Clearwater Ministerial Association; Cl.eart•rater Chamber of Com-
merce and Clearwater Junior Chamber of Commerce. The other members of the
Hoard shall consist of the Chief of Police and City Attorney of said Ciry or
members of. their staff appointed by said City Officials. Any vacancies oc-
curring shell be filled in the same manner as provided for in t:he original
appointment.
Section_ 5. BOARD ORGANIZATION. that the Board shall elect a chairman
and Secretary from its membership and ahall adopt rules and regulations for
the-conduct of its business and the times and places of its meetings. Four
(4) members of said Board shall constitute a quorum for the transaction of
business. '
Section 6. APPLICATION. Application for a permit to coli.cit as
herein described for any purposa for which a permit is i-equirQd by this
Ordinance shall be submitted on a form to be provided by the Board and sworn
to by the applicant or one member of applicant organization, and shall be
filed with the Clerk of the City of Clearwater, who shall refer it to the
Board for action. Said application shall be in substantially the following
form, and shall require the following information:
(a) Name of organization applying for a permit to solicit,
the address of its headquarters, and the names of con-
stituent organizations it represents, if any.

(d) That the applicant has not engaged in any fraudulent
transaction or enterprise.

(e) That the solicitation will not be a fraud on the public.
(f) That the solicitation is prompted solely by a desire
to finance the charitable cause described in the appli- 1'.i
cation, and will not be conducted primarily for private
profit.
(g) That the cost of raising the funds will be reasonable.
Any such cost in excess of 20%' of the an aunt collectod
shall be considered to be unreasonable unless special
facts are presented showing that peculiar reasons snake
a cost higher than 20% reasonable in the particular
case.
The Board shall file in the office of the City Clerk and shall
notify the applicant of its decision upon each application within a reason-
able time not to exceed fifteen (151 days.
Section 8. PERMIT ISSUANCE. Upon receipt of written notification
of approval from the Board as provided in Section 7 hereof, the City Cleek
shall issue a permit to such applicant for the period designated in such
notification.
Section 9. PERMIT DURATION AND RENEWAL. The Board shall determine
from the application and from such facts as may be developed in connection
with such application, the period for which such permit shall be approved
and granted; and whether said permit shall proliide separate periods for
different types of solicitation by applicant, and the Board shall certify
to the City Clerk the period or periods for which said permit shall be is-
sued, provided that no such permit shall be issued for a period in excess of
one year.
Section 10. REQUIRING REPORTS„ The Board may require from any per-
mittee hereunder any reports or information at any time and at such inter-
vals as in the discretion of the Board shii'.1 be necessary for the success-
ful administration of the provisionsof this Ordinance and the protection
of health, life and property of the citizens of the City of Clearwater.
Section 11. PERMIT NON-TRANSFERABLE, Any permit approved and issued
under this Ordinance shall be non-transferable; provided, however, that this
shall not prevent any permittee from using any number of solicitors and re-
presentatives as shall be reported to the Board.
Section 12. REVOCATION OF PERMIT. If, upon receipt of written infor-
mation, or upon its own investigation, the Board shall find that zany agent
or representative of the•permittee is misrepresenting or making untrue state-
ments in the application, or that in any other way the solicitation has been
conducted or is being conducted in a manner inimical to the protection of
health, 11fe and property of the citizens of the City of Clearwater and not
in conformity with the intent and purpose of this Ordinance, or represents
in anyway that any permit granted hereunder is an endorsement of such solicit
ation, then it shall be the duty of the Charity Solicitation Board to revoke
said permit. Provided, however, that before any permit is revoked the said
Board shall give the permittee twenty-four (24) hours notice in writing that
a hearing is to be had, and that at said hearing the Board shall ascertain
the facts.and if any reasons above set forth for revoking the permit are
found to exist the permit shall be revoked.
Section .12. APPEAL. An appeal may be taken from any act of said
Board in granting, refusing or revoking any permit to the City Commission
within ten (10) da-s after an act of the said Board concerning which the
appeal is to be taken.

Section 1k, AGENTS AND.50LICITORfS FOR CHARITABLE SOLICITATION PEAUT
HOLDERS. All persons to whom permits have been issued under thin Ordinance
shall furnish proper credentials to their agents and solicitors for such
solicitation. Such credentials shall include the nnme of the permit holder,
the date, a statement describing said holder's charitable activity, a des-
cription of the purpose of the solicitation, the signature of the permit
holder or of the holder's chief executive officer, and the name, address,
age, sex and signature of the solicitor to whom such' credentials are issued
and the specific period of time during which said solicitor is authorized
to solicit on behalf of the permit holder.
A copy of such credentials must be filed with the Board
at the time the application for a permit is filed and must be approved by it
as conforming to the requirements of this Section before such permit is is-
sued. No person shall solicit under any permit granted under this Ordinance
without the credentials required by this section and a gacsimile copy of
said permit in his possession. Said credentials and copy of the permit must
be shown, upon request, to all persons solicited and to any police officer
of the City of Clearwater.
No agent or solicitor shall solicit contributions for
any charitable purpose from any person in the City of Clearwater, unless
such person has been granted a permit under the provisions of this Ordinance.
Section 15, BOOKS AND RECORDS OF PERMIT HOLDERS. No person shall
solicit any contributions for any charitable purpo>.e without maintaining
a system of accounting whereby all donations to it and disbursements are en-
tered upon the books or records of such person's treasurer or other financial
officer.
Section 16. PENALTY. Any person, organization, society, association
or corporation, or any agent or representative thereof who shall violate any
provisions of this Ordinance shall be subject to the penalprovisions provided
in Section 8, Chapter 1 of the Code of the City of Clearwater, 1950. Each
day's continuance of any violation of this Ordinance shall constitute a
separate offense.
Section 17. If any part of this Ordinance or any rule, regulation or
requirement herein shall be held to be invalid by a court of competent juris-
diction, such invalidity shall not affect the validity of any other part or
' section or other rule, regulation or requirement herein.
Section 18. This Ordinance shall become effective upon its passage
a s required by law.
