705 E ?. a :• .. 1 i i ORDINANCE NO. 705 AN ORDINANCE REQUIRING A PERMIT FOR CONSTRUCTION, RECON- STRUCTION, REPAIR ALTERATION PAVING, OR GRADING OF ANY SIDEWALK CURB, 06RB-CUT DRI?EWAY, PARKWAY OR STREET; PROVIDING FOR APPLICATION FEES AND BONDS PERTAINING TO SAID PERMIT; PROVIDING STANDARDS FOR ISSUANCE OF SUCH PERMITS; REQUIRING RECONSTRUCTION OF SIDEWALKS AND CON- STRUCTION OF DRAINAGE STRUCTURES: PROVIDING THAT THE CITY 1 1 . S ENGINEER SHALL HAVE THE AUTHORITY TO ALTER CURB-CUTS AND TO REQUIRE COMPLIANCE WITH SAID ORDER; PROVIDING REGULA- TIONS FOR CUTTING DRIVEWAYS; PROVIDING PENALTIES FOR VIOLATION HEREOF; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF THEIR CONFLICT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARP?ATER, FLORIDA: Section 1. DEFINITIONS. For the purposes of this Ordinance, the following terms, phrases, words, and their derivations shall have the meaning given herein. When not inconsistent with the context, words used in the present tense include the future, words in the plural number include 'the singular number, and words in the singular number include the plural number. The word "shall" is always manda- tory and not merely directory. (1) "City" is the City of Clearwater, Florida. (2) "City Building Inspector" is the City Building Inspector of the City of Clearwater. (3) "City Engineer" is the City Engineer of the City of Clearwater. (4) "Person" is any person, firm, partnership, association, corporation, company or organization of any kind. Section 2. PEW4IT REQUIRED. No person shall begin to con- struct, reconstruct, repair, alter, pave, or grade any sidewalk, curb, curb-cut, driveway, parkway, or street on the public streets without first obtaining a permit from the City Building Inspector as provided by this ordinance. Section 3. APPLICATION. (5) Estimated coat of the alteration; .4 (6) Such other information as the City Building Inspector shall find reasonably necessary to the determination of whether a permit should issue hereunder. Section 4. FEES, Each Application shall be accompanied by a fee of Five Dollars 05.00), which shall be for fixing, engineering, and inspection. Section 5• .BONDS. The following bonds shall accompany an F; application for a permit hereunder: (1) Construction and Maintenance. In cases where the eati- mated cost of the project shall exceed Two hundred fifty Dollars ($250.,00), the City Building Inspector shall require a maintenance i.. .. ',r . and construction bond to be filed with the application for a permit : hereunder in an amount equal to one-half of the estimated cost of the project and conditioned that such work shall be done in accordance with the Cityts Standard Specifications and guaranteeing the same f 1•^ for a period of six (6) months. (a) Failure oCompliance by Permittee. In any case where a permittee hereunder shall be in default or shall fail to comply with the requirements of this Ordinance, the City Building " Inspector shall order the completion of the work by the City and shall recover the cost from permittee as required by law,; (2) Indemnity. The City J?xilding Inspector shall have the ! i authority, to require an applicant hereunder to file a bond conditioned :. to protect and'save harmless the City from all claims for damages or injury to other persons by reason of damages or injury sustained during the actual course of such alteration work. Section 6. ADDITIONAL CONSTRUCTION* In the event of a drive- a way being built across an existing sidewalk, the existing sidewalk E ? shall be removed and a new sidewalk constructed with a minimum thick- ness of six (6) inches of concrete reinforced with mesh. .' . Section 7. STANDARDS FOR ISSUANCE OF A PERMIT.. The City Building Inspector shall issue a permit hereunder when he finds: (1) That the plans for the proposed operation have been approved by the City Engineer, to whom they shall be forwarded by „ "- the City Building Inspector within a reasonable time after receipt thereof; E (2) That the work shall be done according to the standard t specifications of the City for public work of like character;° I. (3) That the operation will not unreasonably interfere with vehicular and pedestrian traffic, the demand and necessity for park- ing and the means of egress to and from the property affected and adjacent properties. t (4) That the health, welfare and safety of the public will not be unreasonably impaired. Section 8. ORDER TO ALTER CURB-CUT. Where the use convenience and necessity of the public require, the City Engineer shall have the authority to order the owners, or agents in charge of property adjacent ' to which curb-outs are-maintained, to alter the curb-cut in such manner as he shall find reasonably necessary under the circumstances. ?. The regulations for cutting driveways shall be in accordance" with the provisions set out in Chapter 28, Article III, Section 21., of "The Code of the City of Clearwater,, Florida, 1950.11 (1) Notice of Alteration Order. The notice required by this ? i Section shall (a) require compliance by permittee within thirty (30) i days of said notice, (b) be in writing, and (c) be served upon permittee ? ' in person or by mail addressed to the last known address of the permittee. f Section 9.
